(D-Winc) Board Member Ryan Zamarron shared D-Winc’s mission, provided an overview of the board, reviewed the success of the 6th Annual Sunset on the Square event, and introduced new Executive Director Amme O’Grady. Ms. O’Grady reviewed new processes, strategic goals centered on “Repair, Rebuild, Refocus, and Refresh,” and upcoming engagement efforts for the Peach Festival. The Wine & Whiskey Walk event was also announced for October 3, 2026, in Downtown Weatherford.

8.f: Consider a request for a facade improvement grant for 202 West Oak Street in an amount not to exceed $5,597. Director of Economic Development Ashley Seiler presented a request for a facade improvement grant at 202 W. Oak St., submitted by the Parker County Historical Commission. On the motion of Rod White, second by Matt Ticzkus, the City Council voted unanimously to approve a façade improvement grant for 202 West Oak Street as presented, in an amount not to exceed $5,597. The motion carried 4 - 0.

8.h: Discuss and consider the appointment of City Council Members to City Boards, Commissions, and Committees, the designation of Council Liaisons to City Boards, Commissions, and Committees, and the selection of Mayor Pro Tem. He highlighted the plan’s core elements and supporting master plans, including the Master Thoroughfare Plan, Water and Wastewater Master Plan, Parks & Recreation Master Plan, and the Downtown Action Plan. Mr. McDonald reviewed the implementation strategy carried out through the annual budget, Capital Improvement Program, Zoning and Development Code, and incentive tools such as Tax Increment Reinvestment Zones and Chapter 380 agreements. 5.a: Downtown Weatherford, Inc. Bi-Annual Update. Lyndzie Montgomery, Executive Director of Downtown Weatherford, Inc. (D-Winc), gave a brief update on the organization’s progress and answered questions from the Council. Mayor Paschall requested that financial statements be provided at least 10 days prior to the next presentation for review.

8.i: Hold a PUBLIC HEARING and consider adoption of Ordinance O2025-22 amending Title IV, "Building and Property Maintenance Regulations and Historic Preservation" ordinance by adopting the 2021 editions of the international codes and the 2020 National Electrical Code with amendments. Assistant City Manager Chad Marbut presented a summary of the proposed code amendments, noting that the City was operating under the 2009 International Codes and 2008 National Electrical Code. He explained that adoption of the 2021 International Codes and 2020 Electrical Code, with amendments, would align the City with current safety standards, construction practices, and state requirements. Mr. Marbut reviewed major changes and improvements to the Fire Code, including fire sprinkler requirements, and outlined the impact the proposed codes would have on the community. He added that the new codes would take effect upon adoption, with plans allowed under current codes through December 31, 2025, to provide contractors time to adjust. Parker County Hospital District Board of Directors, Jan. 23, 2025: 6 items; approve the minutes as presented

Reports from Parker County Hospital District Departments. Administration: Mr. Bacus updated the Board on the activities in Administration. He noted that Larry Hayward, PA-C, is resigning from the Campbell Clinic after 16 years of service. Mr. Hayward has been an asset to the clinic over the years and he will be missed. Mr. Bacus noted that several construction projects are in the works including a new Helipad for Springtown, a new septic system for Springtown, a new EMS storage room as well as various improvements at the Brock Station. Mr. Bacus reported that there was a recent power outage and all three of the main campus generators started and ran uninterrupted throughout the outage. Mr. Bacus noted that two RFPs have been released. One is for Lawn Services and the other is for Payroll Software enhancements. Mr. Bacus noted that the Hospital District’s Historical Tax Rate is now available on the Hospital District’s website. Mr. Bacus noted that the new Medical City CEO has arrived, and he will be meeting with him as soon as possible. Consider and/or act upon a recommendation to City Council to approve Resolution R2023- 11 setting the rate per unit of electric power and water sold, and wastewater treated, to be transferred from the Municipal Utility Fund to the General Fund as gross receipts charge and a return on investment for Fiscal Year 2024. Director of Finance Dawn Brooks presented this item. Mrs. Brooks explained that Article X, Section E and F of the City of Weatherford Charter requires that the Municipal Utility System pay the City an annual gross receipts charge and an annual return on investment charge. The amount transferred to the General Fund is based on a per-unit rate, and the total dollar amount transferred increases as more units are sold. Historically, the per-unit rate was regularly adjusted based on the annual change in Consumer Price Index (CPI). Since Fiscal Year 2011, the rates for both the gross receipts charge and the return-on-investment charge have been frozen. Staff is recommending unfreezing the per-unit rates and resuming the established policy adopted to update the rates annually by an amount equal to the change in the twelve-month CPI as of March of each year. On the motion of Zack Smith, second by Heidi Wilder, the Council voted to approve this item. Motion carried 4 - 0.

Assistant City Manager Brad Burnett presented this item. The Weatherford Economic Development Board recommended approval at their meeting on November 10, 2022. Discussion included whether or not neon signs are prohibited in the current design regulations, the granting of a facade improvement agreement for a sign as opposed to a building, and that this sign is historically significant to the identity of Downtown Weatherford. Staff stated that this sign is not “neon” and therefore is not prohibited. On the motion of Kevin Cleveland, second by Matt Ticzkus, the Council voted to approve this item as presented. Motion carried 3 - 1. Mayor Pro Tem Heidi Wilder voted in opposition.

Consider a request for designation of an individual local historic landmark at 405 West Lee Avenue, City of Weatherford, Parker County, Texas. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval. At their October 26, 2022 regular meeting, the Historic Preservation Commission voted unanimously (5-0) to forward the request for local historic landmark designation to the City Council with a recommendation of approval. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this item as presented. Motion carried 5 - 0.

An approved preliminary plat is required before the final plat can be approved (WMC §11- 5-4(b)). Public improvements are required to be accepted before the final plat is recorded (WMC) §11-5-9(c)(1)). A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements (WMC §11-5-9(c)(2)). 6. If Vanderbilt Drive is constructed before Dartmouth Drive is, a temporary turnaround bulb will be required at the east end of Vanderbilt Drive (EDCM §2.1.23). 7. The Vanderbilt Drive and Dartmouth Drive intersection should be tangent for at least 100’ (EDCM §2.4.4). All other intersections are required to be tangent for at least 50’. 8. Preliminary plat submittals show the segment of land west of Lots 25 and 26, Block 16 that is within the City limits as part of this property. Receive a report, hold a discussion, and give staff feedback regarding the Weatherford Housing Analysis. Jason Claunch with Catalyst Commercial gave a report on the housing study. He addressed the following items: purpose of the study; the process; national housing trends; regional trends; development trends; existing conditions; SWOT analysis; median household income; multifamily development and five-year outlook; single-family development; Council Retreat feedback; responsible growth; high-quality development target audience; common themes; and developer feedback. Recommendations included: review engineering design standards; create architectural and design standards; consider increased density as part of a planned unit development; continue construction of hike and bike trails; safe routes to school infrastructure; complete and implement Downtown Master Plan; complete and implement Parks Master Plan; consider incentives for infill development; consider Greenfield Residential Development incentives. Staff will schedule a joint work session with the PZC in the fall.

Historically, the City of Weatherford has cast its votes alongside Weatherford Independent School District (WISD) as the City does not have enough votes to elect any board member on its own. WISD cast its 1,190 votes for Jerry Durant and John Hinton. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to approve Resolution R2021-23 casting 123 votes for Jerry Durant and 122 votes for John Hinton. No action was taken or required. Ms. Doss presented the City Manager’s FY21 Proposed Budget. She stated that this budget continues progress from previous years. The budget is balanced. It focuses on keeping service levels current while managing future risks and opportunities. The budget maintains a 120-day fund balance, maintains financial flexibility, and includes facility renovations and remodels. Major focuses include major capital projects such as the police and fire stations, and the Downtown Project. This budget encompasses $63.8 million, includes 23 different funds, 17 different departments, 316 employees, and every city program except utility-related functions. Weatherford City Council, Feb. 25, 2020: 7 items; public hearing and consider approval of Ordinance #O2020-13 for a zoning district change

Downtown Work Session regarding progress of the downtown bypass project including a project timeline with deadline-based deliverables and dates, regular updates for City Council, with a focus on the start and completion of the project. Director of Capital Projects Terry Hughes presented this Work Session. Mr. Hughes stated that this project is set in three phases: Phase 1 is the Northern bypass; Phase 2 is the Southern bypass; and Phase 3 is Heritage Square. Mr. Hughes provided a map of the overall area, the timeline for phases 1 thru 3 beginning 2020 thru 2026 and discussed funding mechanisms and partners. Mr. Hughes will provide quarterly updates to the Council.

Hold a PUBLIC HEARING and consider a request for a zoning district change to allow a C1 Commercial to a C1 Commercial with a Conditional Use Permit (CUP) for a Recycling and/or Drop Off Kiosk, Bin or Reverse Vending Machine at a property located at 2034 Fort Worth Highway and described as being 0.460 acres, Abstract 535, “Fina” Good Hannibal Survey, City of Weatherford, Texas. ZCH2018-0019. Mr. Farmer presented this item as well. This site is adjacent to The Malt Shop. The applicant requested a drop off/collection box at this site. The Malt Shop has not requested the placement of the donation box but is agreeable to such placement. The location is zoned commercial. Such a box could be placed in this location with a CUP. Historically, these types of collection boxes require constant monitoring and partnerships in order to keep from becoming eyesores. The PZC recommended denial of this request at their last meeting. Mayor Swancy opened the public hearing at 7:07 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 7:07 p.m. On the motion of Curtis Tucker, second by Heidi Wilder, the Council voted unanimously to deny this request. Councilmembers Robinson and Wilder voted in opposition. Discuss and consider award of Bid# 2018-023 and authorize the City Manager to enter into a contract for the construction and stabilization of Black Warrior Creek in the Heritage Park area. Director of Capital Transportation Projects Terry Hughes presented this item. He stated that Black Warrior Creek bisects the Heritage Park area and the soils are highly alluvial and easily eroded. This project is designed to stabilize and stop the erosion with a modular block wall system and a walk bridge. The project is approximately 800 feet long and estimated to cost $2,140,000. The project was advertised in August and bids were opened on September 18, 2018. Six bids were received ranging from a high bid of $2,835,420.96 by Joe Funk Construction to a low bid of $1,587,702.61 by Reytech Services, LLC. Since the bid opening, staff has vetted Reytech to ensure that they and their subcontractors met the established experience requirements. Reytech does meet the requirements and staff and our consultant are comfortable recommending that Council authorize the City Manager to execute a contract with Reytech Services, LLC for the construction of the Black Warrior Creek Channel Stabilization project in the amount of $1,587,702.61. Remove and replace Exhibit 6.16 Downtown Mobility Bypass on Page 6-27 of the Weatherford General Plan. Mr. Farmer presented this item. He reviewed page 6-27 of the General Plan, which does show an alignment and does show some roundabouts for a downtown bypass. The General Plan was adopted in January 2018; however, staff started working on chapter 6 in early 2017. The map on page 6-27 was one of the concept maps, but staff now recommends removing or replacing the map because it is misleading. The only approved document is from the 2013/2014 Downtown Action Plan. Several people would like to see additional alignments on the north side of downtown. It is recommended that page 6-27 be removed and replaced with a new diagram from the Downtown Action Plan, along with the following amended language: "Downtown Circulation Plan - With local control of the main conduits into the downtown area, an updated and redesigned traffic circulation system can be implemented. Exhibit 6.16 shows the Downtown Action Plan approved in 2013 after a year-long series of public meetings and workshops shows the approved northern bypass with an improved circulation system for Downtown. It allows the Downtown area to again achieve its original purpose as the community’s focal point. Consider approval of a two-year agreement for budget software as a service for the Finance Department from OpenGov, Inc. not to exceed a total cost of $96,010. This item was removed from the Consent Agenda for separate consideration. Assistant Director of Finance Kyle Lester presented this item. He stated that the City does not currently have budget software which makes succession planning difficult. Software would make the process much more efficient and reduce potential errors. Mr. Lester stated he is seeking a two-year agreement because that would carry the City up to the point of an overall ERP (enterprise resource planning) software. Mr. Lester stated that the budget software will integrate with the current accounting system and that it is driven by GL data. All of the datamining will be on actual audited numbers. Mr. Lester stated he was uncertain if the software will perform all calculations automatically, but the software will make it easier for staff to work with the calculations. Update regarding storm water projects. Terry Hughes, Director of Capital Transportation, presented this item. Mr. Hughes stated that one significant project recently completed was on the Underwood Branch. He showed a video where runoff water had washed out a manhole and affected a City sewer pipeline. Mr. Hughes then presented a video of the finished project. That same system is expected to be used on improvements at the Black Warrior Creek near the Heritage Park Amphitheater. During that project, a bridge will connect the parking area to the amphitheater. The Underwood Branch improvements were built with a substantial wall system that will not wash away and will not undercut the walls. Improvements will be made along the Town Creek trail system as well. Another goal includes debris collection within a containment system. The first of these systems will be implemented near the Roger Williams dealership. Holland Lake Dam final designs are to be received mid-July. Staff is near finalizing the Town Creek Trail System. Mr. Hughes stated this system also includes a traffic signal at Holland Lake and Santa Fe Drive. All three projects will be coming together for bids at the same time. The City has applied for a grant through the North Central Texas Council of Governments (NCTCOG) to study the entire 9.6 miles of Town Creek. Consider the Preliminary Preferred Scenario for the Weatherford General Plan. Craig Farmer, Director of Planning and Development, gave a brief introduction regarding the Preferred Preliminary Scenario (PPS) and introduced Karen Walz. Ms. Walz reviewed the work that has been done with the Advisory Committee (AC) towards the development of the PPS. The recommendations from the AC include: 1) using Downtown Focus instead of Business as Usual; 2) using Concentrated Retail instead of Business as Usual on the Ric Williamson Loop, as well as including potential for hotels and event/conference centers; 3) using a combination of Suburban Living, Agriculture, and Cluster Residential while balancing population with jobs in agriculture areas; and 4) continuing Business as Usual in other areas. Approximately 75 percent of the AC agreed that the PPS is consistent with their own view of Weatherford's best possible future. Approximately 55 percent of the Committee agreed that the current trends/business as usual is very inconsistent with their own view of Weatherford's best possible future. Announcement and recognition regarding Spark in the Park. Mayor Swancy announced that 'Spark in the Park' was a tremendous success. The entertainment was excellent, the amphitheater was crowded, and the vendors were happy. Staff estimates approximately 5,000 to 7,000 people gathered in the amphitheater with an estimated total of 10,000 in all of Heritage Park. Based on discussions with police and fire, estimates include that an additional 10,000 people watched from along Fort Worth Highway, Santa Fe Drive, Foster Lane, the square, the market, and the hospital. Reports are that it was the biggest and best fireworks show in the Metroplex. City Manager Hayes expressed appreciation for all departments involved in this event.

CC062816 Page 2 of 4 Consider approval of a ten (10) year license agreement for use of the sidewalk and two adjacent parking spaces in front of Justice Burger, 105 College Avenue for restaurant purposes. Debra Wakeland, Main Street Director, presented this item. Justice Burger located at 105 College Avenue has requested the use of the sidewalk for outdoor tables for restaurant seating. He has also requested the use of two adjacent parking spaces in front of Justice Burger for the same use after five on weekdays and all day Saturdays and Sundays. Unobstructed passage for pedestrians on the sidewalk will still be required. This agreement is in line with the Downtown Action Plan adopted in February 2014 which encourages sidewalk cafes and dual use parking. The rate is $855 per year. Justice Burger will carry $1,000,000 insurance to protect the City. Staff will monitor parking and pedestrian issues to make sure this license does not adversely affect the downtown and to also determine uses of such agreements for other downtown restaurants. Either party can revoke the license with 30 days’ notice. On the motion of Dale Fleeger, second by Jeff Robinson, the Council voted unanimously to approve this agreement. Motion carried 5 - 0.

Update regarding Pleasant Valley emergency access easement. Mr. Hamrick gave this update. He stated that the parties have worked out an access easement that is currently gravel, which is a viable option for an emergency access road. The portion that is in Pleasant Valley will be paved, but the portion that is in the county will be maintained in its present state. Report on ‘Spark in the Park’ at Heritage Park on July 4th, 2016. Shannon Goodman, Director of Parks, Recreation, and Special Events, gave this update. The website www.weatherfordtx.gov/spark is available for event information and the schedule is to be posted on June 29th. Several food trucks and vendors are expected in the amphitheater area and the middle lot on Santa Fe. The north and south lots on Santa Fe are designated for parking and tailgating. Activities for kids will also be available. Staff has been told that the fireworks should be visible from three to four miles away. Local FM station 89.5, Chuck FM, has choreographed music for the fireworks and radios can be tuned to 89.5 during the show. Staff is expecting a crowd and are excited to put on a local show for our citizens.

Discuss and consider adoption of Ordinance 779-2016-25 amending Title IV Building and Property Maintenance Regulations, Chapter 13. Historic Preservation, to provide for alternative tax incentive for historic preservation and authorize the Council to provide additional tax incentives for historic properties in general and for new and replacement structures in the Central Business District (CBD) that maintain the historic character of the district. Craig Farmer, Director of Planning and Development, presented this item. He stated that the Historic Preservation Commission (HPC) met last Wednesday night and unanimously recommended four amendments to the historic preservation ordinance. Mr. Farmer reviewed the proposed amendments. Specifically, one of the amendments is a new paragraph for tax incentives for new and replacement CC042616 Page 1 of 2 buildings in the CBD. It states that: ‘The Council, upon recommendation of the HPC, may authorize tax incentives for a compatible new or replacement structure in the CBD to preserve the historic character of the district.’ Mr. Farmer reiterated that the Council has the final determination, and that dollars for these incentives have yet to be budgeted. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted unanimously to approve Ordinance 779-2016-25. Motion carried 4 - 0.

Update on Heritage Park improvements and progress. (Shannon Goodman) Shannon Goodman, Director of Parks, Recreation, and Special Events, presented this report. He stated that the landscaping in the north lot has been completed. He mentioned the sign feature that will be located on the corner of the north lot. He spoke about the progress at the amphitheater and stated that the grand opening is scheduled for April 22 from 6:00 to 10:00 p.m. Mr. Goodman noted that 24 events have already been scheduled for Heritage Park and that does not include First Monday weekends. The park is growing and the people like what the City's doing. Staff are processing special event applications daily and people are asking to rent the amphitheater for personal events. The sign feature will cost approximately $25,000 and may be completed this year. Mr. Goodman will report to the Council in April.

Chapter 11, section 9¬ 11-1 (4) to allow the Special Events Permit process to grant the permission for the use alcoholic beverages within City of Weatherford special events. Shannon Goodman, Director of Parks, Recreation & Special Events, presented this item. He stated that staff recommends changing the ordinance to allow the use of alcohol at certain events through the city's special CC022316 Page 3 of 5 event application process. This is a streamlined process which the Parks' special events division already manages. By a vote of 4-1 at their January meeting, the Parks Board voted to recommend an amendment to the ordinance. The Board requested City Council review of event applications that include alcohol. Mr. Goodman provided the following overview of the steps within the special event application process: • Step 1. With a citizen, group or business asking to sell or provide alcohol at a Special Event at Heritage Park. • Step 2. Staff would ask for the Special Event application to be completed with as much detail as possible. • Step 3. Consider and/or act upon authorizing the city manager to execute a contract with Pacheco Koch for surveying, environmental permitting, geotechnical investigation and engineering design services for the Black Warrior Creek Stabilization Project. Terry Hughes, Director of Capital Transportation Projects, presented this item. He spoke about the drainage at Black Warrior Creek stating that it threatens the Heritage Park area and the existing Town Creek Trail on Santa Fe. The drainage is undercutting the sandy creek bed and is causing a loss of trees along the creek. The proposal is to design and build a fabricated block wall system, which is a long term fix. This type of system will be will be on both sides of the creek. It will be stabilized and will tie in with what the Parks Department is doing in Heritage Park with regard to parking and the amphitheater. The total cost of this contract is $338,860. The stream further north of this location is relatively stable, but staff does anticipate the need for a phase two over the next few years. The portion involved in this project is moving at a rapid pace and needs to be addressed now. Update regarding Animal Shelter facility needs assessment. Dustin Deel, Director of Animal Services, presented this item. He provided details regarding the shelter's live release rate, other statistics, and the need for major facility improvements. The improvements consist of a three phase plan. Phase 1 includes Infrastructure, Medical, Isolation, Intake, Meet/Greet Yards, and renovations to existing buildings. Phase 2 includes Feline, Livestock and Support Kennel Expansions. Phase 3 is anticipated to be 15+ years from now and will include additional kennels as growth demands; however, a new feasibility study will be necessary by that time. Mr. Deel presented a rough diagram of the proposed changes. Cost is a concern. Staff intends to renovate what can be renovated and to be good stewards of is currently available. Citizens have supported this cause in the past and we hope they will be willing to do so again. No action was required or taken on this item. Mayor Hooks called for a brief recess at 7:50 p.m. the Council reconvened at 8:00 p.m. Update on Heritage Park Projects. Proclamation recognizing White's Funeral Home, the recipient of the first Texas Historic Commission Texas Treasure Business Award in Weatherford. Mayor Hooks issued the proclamation to representatives of White's Funeral Home. Proclamation naming May 2015 as Motorcycle Safety and Awareness Month in Weatherford. Mayor Hooks issued the proclamation to local riders and enthusiasts.

Discuss plans for the Bankhead Highway 100th Year Celebration in 2016 and the June 6, 2015 proof of concept event. Craig Farmer, Director of Planning and Development, presented this report. He provided history about the Bankhead Highway noting that at one time, it connected Washington DC to San Diego. In Texas it was also known as State Highway 1, which later became Highway 80 and then Highway 180. The Texas Historical Commission suggested events in Big Spring, Mount Vernon, and Weatherford where portions of the Bankhead Highway are still named and in use. The event is to be held on the second weekend of September 2016 and includes an antique car show, a parade of cars in chronologic order by age, stray days events (the predecessor to the First Monday Trade Days), and a theatrical group who will be in period costume and provide history of the time. Staff is considering a great deal more promotion for the historic Bankhead Highway to include murals and historic signage signifying State Highway 1 and Bankhead Highway. This year, a proof of concept event will be held on June 6. Staff will keep the Council posted on this event and the larger celebration planned for next year.

Historic Overlay District to coordinate and remove duplicative language to be found in other Titles. MCA2015-0001 Craig Farmer, Director of Planning and Development, presented this item stating that the Historic Preservation Commission (HPC) and the Planning and Zoning Commission (PZC) have spent approximately six months reviewing and drafting the amendments presented tonight. Mr. Farmer noted that certain sections of this ordinance have been relocated to Titles II and IV, which will be discussed later in tonight's meeting. Mr. Farmer reviewed portions that are proposed to remain in Title XII. Two controversial items, 100% participation within an historic overlay district and voluntary removal from a district if a property owner chose to remove themselves, have been left alone in this draft. These items have procedural issues, but staff has left them alone for the time being. Staff anticipates review and consultation with attorneys before bringing these items forward for consideration this summer. Discuss and consider approval of Ordinance 718-2015-07 amending Title II, Commissions and Boards, Chapter 1- General Standards for Boards, Commissions and Committees, section 2 and Chapter 9- Historic Preservation Commission. MCA2015-0002 Mr. Farmer spoke about this item noting that the Council previously adopted changes to Title II, Commissions and Boards, which moved the section regarding HPC from Title XII, to Title II with all other City boards and commissions. Mr. Farmer stated that approximately 80 percent of this ordinance has not been changed, approximately 15 percent of the changes proposed tonight have been taken from the Texas Historical Commission’s (THC) model ordinance, and approximately five percent of the changes have been suggested by the HPC and the PZC. Mr. Farmer reviewed the recommended changes. City Secretary Malinda Nowell spoke about an amendment to section 2-1-2 pertaining to appointment, terms, and qualifications. After reviewing certain upcoming appointments and reappointments, it was discovered that the present ordinance is unclear as to whether a person serving on a board, commission, or committee in an alternate seat should be considered a full seat for the purpose of defining the number of consecutive terms a person has served on a given board. Discuss and consider adoption of Ordinance 720-2015-09 amending Title IV Building and Property Maintenance Regulations, adding Chapter 13. Historic Preservation, to coordinate and remove duplicative language to be found in other titles. MCA2015-0003 Mr. Farmer presented this item as well. These amendments add Historic Preservation to the name of Title IV. Title IV of the Code currently relates to building and property maintenance regulations and this amendment creates a new chapter, number 13, which specifically relates to historic preservation. Mr. Farmer reiterated that these sections were previously codified in Title XII Zoning, but they are more CC032415 Page 3 of 7 procedural in nature and do not require the legal zoning processes. He reviewed amendments proposed by staff via the THC model ordinance, and amendments recommended by the City's HPC. The PZC also reviewed these amendments; they were not required to make a recommendation. Mr. Farmer discussed the tax incentives and other incentives for historic preservation. No dollar amount is listed in the proposed amendments; instead, the proposed amendment includes the words "to a maximum of the amount approved in the fiscal year budget by the City Council." Mr. Clayton explained that Chapter 312 of the Texas Tax Code governs the designation of the reinvestment zones and granting of tax abatements. The City Council approved Resolution R2014-13 on May 13, 2014 pursuant to Chapter 312.002 of the Texas Tax Code, establishing the current City of Weatherford Guidelines and Criteria Governing Tax Abatement Agreement, effective for a period of two years, ending February 2016. The City Council and economic development department periodically receive requests for consideration for a tax abatement from various businesses, and the City Council is asked to consider the revisions to the approved with the following provision added under Section II. Minimum Standards for Tax Abatement. Briefing on Downtown Code Enforcement Efforts. Mr. Farmer presented this item as well. Staff recently initiated a process to gain compliance with some of our downtown buildings. The old theater has been boarded up. It will be sealed. Exterminators have been contacted. The exterior will look good with rest of downtown. Staff is following up in some other areas and both the Parks and Streets departments have increased their efforts with street sweeping and the application of herbicides.  Bobbie Narramore, 209 West First Street, spoke in favor of improvements to make downtown buildings aesthetically pleasing.

Weatherford City Council, Oct. 13, 2014: 6 items; Presentation regarding Chandor Gardens recognition to National Register of Historic Places

Presentation regarding Chandor Gardens recognition to National Register of Historic Places. Shannon Goodman, Director of Parks and Recreation, spoke briefly about this item and introduced Bill Warren, a member of the Chandor Garden Foundation. Mr. Warren stated that the gardens will be listed in the National Register of Historic Places, among approximately 3,100 other Texas listings. The City can include this recognition in advertising and the gardens are now eligible for additional grants through the National Trust for Historic Preservation as well as other foundations. Presentation on transportation projects and request support for the November 4 constitutional amendment proposition for increased state funding for transportation. Terry Hughes, Director of Capital Transportation Projects, spoke about a resolution of support, on tonight's Consent Agenda, regarding a constitutional amendment for increased state funding for transportation. If passed, the amendment will allow funding to be transferred from the state's rainy day fund into the state's general fund for disbursement for transportation projects. This amendment is known as proposition 1 on the November 4 ballot.

Update on Downtown Improvement Plan. Terry Hughes, Director of Capital Transportation Projects, presented this item. He provided information about the proposed inner loop around downtown Weatherford and the potential for one-way streets and head-in parking. Mr. Hughes spoke about the proposed traffic flow in the downtown area. Traffic counts and analysis were performed to collect data on how traffic flows east and west through the square. In both AM and PM traffic counts, between 60 to 80 percent of the east/west and west/east traffic is through traffic. Mr. Hughes spoke about the downtown plan improvements including one-way streets, a round- about, three-lane and four-lane sections, modified intersections, and dual right turns. Update on Heritage Park. Shannon Goodman, Director of Parks and Recreation, presented this update. He provided information regarding the projects that have been started and/or completed during this fiscal year. Those projects include the renovation of the middle lot, additional vendor parking, the opening of the dog park, and additional walkways. Construction has begun and continues on the food court. He provided before/after pictures of recent renovations. He provided the following timeline beginning with City Council’s adoption of the downtown action plan in January 2014, the adoption of the 2009 building codes, and Planning and Development assuming Main Street and Code enforcement duties in the spring of 2014. Mr. Farmer also spoke about issues facing the City’s Code Enforcement Division, and the impact that the adoption of the 2009 International Code Adoptions on Code Enforcement and the downtown area. Some areas of interest include emphasis on historical building upgrade exemptions, a reduction on the number of restrooms required, a reduction on the number of accessible restrooms required, an allowance for live- work businesses throughout City. The 2009 International Property Maintenance Code changes offer a better definition of exterior premises condition violations, and a better definition of exterior structure condition violations. Mr. Farmer provided some examples. Mr. Farmer mentioned difficult, prominent cases, in the downtown area and that the City has hired outside attorneys to assist in these cases. Consider a request for and approval of a ten year license agreement for use of the sidewalk and two adjacent parking spaces in front of Big John's Burgers, 105 College Avenue for restaurant purposes. Mr. Farmer referred to the City's approved Downtown Action Plan, noting similar uses in the future. He discussed the conditions of the agreement. The City will install the bollards. Either party can terminate the agreement with 30 days' notice. Bobbie Narramore, 209 West First Street, spoke in opposition due to limited parking in the area. John Shepherd, business owner, stated that adjacent businesses are in favor and that the use of the parking spaces will be after 5:00 p.m. and on the weekends. He provided Fiscal Year 2013-14 data on weather, attendance, space rentals, and revenue for First Monday. He spoke about developments at Heritage Park including a dog park, an outdoor amphitheater, a food court, the potential for food truck rallies, and recreational vehicle (RV) parking. He also mentioned potential renovations to the South Lot, to include vendor spaces, landscaping, parking, additional walkways, and an all-accessible playground. The intent is to maintain the same visual theme throughout all development in Heritage Park in order to create a smooth transition from one area to the next. It was suggested that the City look into operating an RV camp year round.

Mr. Farmer stated that the Downtown Committee and the Historic Preservation Commission recommend the adoption of this plan. The plan has also been showcased with the Heritage Society. Mr. Farmer noted two of the priorities are already underway: the recent adoption of the 2009 building codes, and the way finding signage which will be discussed tonight. By posting no smoking signs in parks, CC 011414 Page 5 of 7 any City employee can state that an area is non-smoking. That person can then put out their smoking product or leave the area. If they refuse, then it is a trespassing issue. If parks are considered in an ordinance, then it can only be enforced by the police department. We anticipate that 90 to 95 percent of the people will comply simply with the placement of the signs. While not all of our parks are dedicated parkland, it was the Council's direction to include all park-like areas such as the hike/bike trail, the ball fields, and other city-owned public places. It was not the direction of the Council to post signs on vacant properties owned by the City. Harberger Hill, First Monday, and Heritage Park would be included for signage. Hold a work session on the FY14 proposed budget. Topics will include proposed changes to the employee retirement plan, a walk-forward of changes made to the budget proposal since August 6, and responses to questions raised during the August 17 budget retreat. Mr. Hamilton requested a 25 minute time limit on each of the Work Session items. Chad Janicek, Director of Office of Management and Budget (OMB), presented this item. He mentioned the Council's proposal for an unchanged tax rate, and spoke about the Budget Retreat held on August 17. Mr. Janicek gave details on the following Fiscal Year 2014 (FY14) expenditure changes: Discussion included the proposed tax rate, the anticipated property tax revenue, recommendations to further reduce the budget, Library programs, organizational structure, and budgeting certain expenditures as one-time or ongoing. Receive a presentation regarding Weatherford's Downtown Plan. Sharon Hayes, Assistant City Manager, introduced this item. Kim Thieme, Main Street & Special Events Manager, gave a report about the Main Street program stating that Weatherford became recertified in 2009. Ms. Thieme provided details about the organizational and fundamental groundwork that has gone into the Downtown Plan since that time. Ms. Thieme provided a comprehensive downtown work plan. She discussed the tangible/visible accomplishments of the program including more holiday decorating, downtown building placards, the demolition of the former police station at 215 York Avenue, and the future potential for green space, restrooms, and beautification aspects. She gave details about event-oriented items in Downtown Weatherford each quarter. The Chamber organizes the Peach Festival and Christmas on the Square in the summer and winter; the City organizes Weatherford Blooms and Hometown Heritage in the spring and fall. A number of partnerships have been forged and have contributed to these accomplishments. City Secretary Malinda Nowell stated that, due to anticipated changes with the Weatherford Economic Development Authority, Staff reviewed Title II, Commissions and Boards, and recommended changes to include chapters for the Weatherford Economic Development Board (WEDB), the Animal Shelter Advisory Committee, and the Historic Preservation Commission, as well as other cleanup measures throughout. Receive a draft copy of proposed amendments to City Code of Ordinances, Title II, Commissions and Boards. City Secretary Malinda Nowell presented this item to the Council. With forthcoming changes to the Weatherford Economic Development Authority, Staff has reviewed Title II of the Code of Ordinances. The Weatherford Economic Development Board has been included, as well as chapters for Animal Shelter Advisory Committee, and Historic Preservation Commission, which were previously recorded in other titles. Additional cleanup measures have been made throughout Title II and are noted in the redline copy that was provided in the agenda documents. Mrs. Nowell noted one additional change regarding the Weatherford Economic Development Board members. In order to keep the board organized as closely as possible to the manner in which the current board functions, it is necessary that we add a statement that the residency requirements found in section 2-1-2 (c) do not apply to the Weatherford Economic Development Board. On the motion of Waymon Hamilton, second by Craig Swancy, the Council voted unanimously to grant permission for the placement of a memorial honoring Larry Hagman at a location in Heritage Park with the details and location to be approved by the Parks Board and the Council under the parameters of the policy that is being developed at this time, and to be funded by private dollars. Chad Janicek, Director of Office of Management and Budget reviewed the monthly report and updated the Council regarding the FY14 budget process. Due to changes, cuts, and reorganizations over the last several years, it is difficult to provide an “apples to apples” comparison, but staff has compiled the below Historical Spending chart which provides a close comparison: Departments submitted target budgets in April; the target budgets are flat, but departments had the flexibility to move dollars around within their accounts if needed. Each department identified, itemized, justified, and prioritized supplemental requests for services or items over and above their current budget. This item, placing a Larry Hagman statue, has not been through the Park Board. The City has no existing policy. This process would help the City begin to establish a policy. Staff is looking at the potential for a collective location where notable citizens could be recognized. In May 2011, Council adopted Resolution R2011-13 officially dedicating a 0.15 acre tract of land at the corner of Eureka Street and Santa Fe as the future home of the Parker County Veterans Memorial Park. Proclamation for "National Volunteer Week" April 21-27, 2013. Mayor Hooks issued the proclamation and thanked all of our volunteers including board, commission, and committee members. Recognize First Monday Committee members. Danielle Felts, Director of Parks and Recreation, thanked the First Monday Committee members for their service over the last several years. Parks and Recreation staff members Michael Howard and Karen King presented engraved paper weights to committee members Don Johnston, Woody Stovall, Sherry Wyler, Kathy Matthews, and Andrea Lynn. Woody Stovall, Andrea Lynn, and Don Johnston thanked the Council for their support of the First Monday Trade Days, which is a vital part of Weatherford, and for the revitalization of First Monday and Heritage Park. Receive City of Weatherford 2013 Strategic Plan. Chad Janicek, Director of Office of Management and Budget, introduced Marty Wieder who presented official copies of the 2013 Strategic Plan, which the Council adopted on February 26, 2013. The hope is that Staff can use this as a tool as the City begins the budget planning process for Fiscal Year 2014 and beyond.

Receive a report from the Larry Hagman Memorial Committee; discuss and consider recommendations and possible locations. City Manager Jerry Blaisdell introduced Sherry Watters, a representative with the Larry Hagman Memorial Committee. Ms.Watters discussed finding a location in the City of Weatherford for the Larry Hagman Statue. The committee is requesting an outdoor location. Ms. Watters stated that the committee is in favor of Heritage Park and believes it is an ideal location. It will take six to nine months for the sculpture to be completed. Dr. Harold Lawrence, the Chair of the Parker County Historic Commission, stated that an historical marker is feasible; however, the State of Texas requires it to be ten years after his death. A site can be designated now and when the time arrives to apply for the marker the Historic Commission will help with the process. The Council discussed Heritage Park and other locations. They are in favor of Heritage Park as a location but also wish for other local icons to be represented as well. No action was taken on this item.
