Presentation of Medal of Valor to Firefighter Dakota Stroud. Fire Chief Jonathan Peacock presented the Medal of Valor to Firefighter Dakota Stroud for heroic actions to remove a young man from an automobile accident where the vehicle was on fire. Presentation from County Judge Pat Deen on use of 1/2 cent sales tax. County Judge Pat Deen presented this information. No action was required or taken regarding this item.

Consent agenda, approved as one vote (5-0, on the motion of Kevin Cleveland, second by Jeff Robinson): Approved the minutes of the City Council meeting held August 10, 2021. Awarded contract for audit services to Pattillo, Brown & Hill, L.L.P., a qualified firm of certified public accountants, to audit the City's financial statements for the fiscal year ending September 30, 2021, 2022 and 2023, with the option of auditing its financial statements for each of the two subsequent fiscal years. Approved a preliminary plat for a replat of Milliken Heights, Block 11, 16 lots on 3.537 acres bounded by East First Street, East Second Street, Duke Street, and Oldham Avenue, City of Weatherford, Parker County, Texas, SBD2021-0052, subject to all requirements of the subdivision ordinance and, specifically, the following conditions: 1. Existing conditions sheet should be a part of the plat package, including title block and written/graphic scale. 2. Incorporate water, sanitary sewer, and storm drain concept sheets into proposed subdivision sheet. 3. Include a written scale with the graphic scale on all sheets. WMC 11-4-3(a) 4. Indicate location of proposed street and sidewalk pavement. WMC 11-4-4(b-c) 5. Indicate easement for the proposed wastewater and storm drain lines on Lot 4R (Reference Weatherford Municipal Code. WMC 11-4-4(e) 6. Show the document number(s) for the right-of-way abandonment of East Second Street and Oldham Avenue. 7. Include adjacent subdivision, lot, right-of-way, and tract information within 125' from the subject tract on the existing conditions sheet. WMC 11-4-5(a). Approved a final plat for the Parkers Draw, Section 2 subdivision, 50 lots on 13.11 acres at the intersection of Charles Street and Newport Road, City of Weatherford, Parker County, Texas, SBD2021-0056, subject to all requirements of the subdivision ordinance and, specifically, the following conditions: 1. Include a description of the property by metes and bounds. Weatherford Municipal Code (WMC) 11-5-2(k) 2. Include the missing Lots 26 and 27, Block B in the lot area tables. WMC 11-5-2(l) 3. 30' emergency access (Doc. No. 201934157) and 20' drainage and utility (201934156) easements have been abandoned by separate instrument and should be removed from the plat. WMC 11-5-2(m) 4. Label and dimension all right-of-way dedication; specifically, what appears to be dedication along Newport Road is not labeled as such. WMC 11-5-2(m) 5. Show the location of the two required concrete monuments on the plat. WMC 11-5-2(n) 6. Provide documentation that at least 50 percent of the total street centerline length is curvilinear. WMC 11-6-3(d) 7. Indicate a wall maintenance easement at least 5' wide along Newport Road where a screening wall will be installed. Engineering Design and Construction Manual (EDCM) 7.5.6 8. Note 11 states Lot 1, Block D is an HOA lot. This appears to be referencing Lot 9, Block D as Lot 1 is in the previous phase. Correct as appropriate. 9. Correct overlapping dimension labels on Lot 32, Block A. Authorized the city manager to execute a professional services contract with Pacheco Koch engineering in the amount of $58,360 to design an erosion protection project near the intersection of Lakeway Drive and Running Creek in Lakeway Estates. Approved a final plat for the Marlon Gaunt Addition, 3 residential lots being 16.496 acres situated in a being a portion of the John Snyder Survey, Abstract No. 1170, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas, SBD2021-0061, subject to the following conditions which must be met prior to approval: 1. Correct the spelling of "Snyder" on the title block as well as the legal description. 2. Remove Finished Floor Elevations from the plat. Authorized the City Manager to utilize additional funds not to exceed $50k for contracted services with Johnny Campbell Consulting for the remainder of FY21. Approved a final plat for Santana Ridge, 118 residential lots being 244.805 acres and called to be portions of the SM. Wood Survey, Abstract No. 1607; the MC. Hendrick Survey, Abstract No. 267; the JM. Richards Survey, Abstract No. 2419; the JF. Bates Survey, Abstract No. 122 and the S. Coin Survey, Abstract No. 231 in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas, SBD2021-0043, subject to the following conditions which must be met prior to certification and filing: 1. Remove minimum finished floor elevations from the plat (Reference Weatherford Municipal Code (WMC) §11-5-2). 2. Include a written scale with the graphic scale on each sheet (Reference Weatherford Municipal Code (WMC) §11-5-2(e)). 3. Include the number of lots in the subdivision in the title block (Reference Weatherford Municipal Code (WMC) §11-5-2(h)(1)(c)). 4. Include a note on the plat stating that all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat (Reference Weatherford Municipal Code (WMC) §11-5-2(m)). Provide an exhibit showing the location of proposed cluster mailboxes. Provide a signed letter from the Weatherford Post Office stating they accept the proposed location of the cluster mailboxes (Reference Weatherford Municipal Code (WMC) §11-5-3(e)). 5. Add block for: Approval by City Council. (Reference Weatherford Municipal Code (WMC) §11-5-9(q)(4)). 6. A boundary is not shown between the Old Dennis Road right-of-way and the property owned by Franklin Norman Beckley, Document No. 202027332. Revise to show the property boundary. Adopted Ordinance O2021-49 on the proposed voluntary annexation of "Ranch Lake Estates" being 10.81 acres situated in the J.L. EDWARDS SURVEY, ABSTRACT NO. 416, Parker County, Texas, being a portion of that certain tract of land described in deed to Wilson Ranch and Development, LLC, recorded in Instrument Number 202025436, Official Public Records, Parker County, Texas and being a portion of the existing Right-of-Way of White Settlement Road to enlarge and expand the boundary limits of the City of Weatherford. Authorized staff to hire Devil Dog's Concrete per bid # 2019-024 for the construction of a parking area to include 64 car parking spaces or 32 truck and trailer parking spaces at the Marina for a total cost of $390,000.00.

Hold a PUBLIC HEARING and consider approval of ordinance O2021-48 amending Title XII, Zoning Ordinance, concerning commercial zoning districts, uses, and definitions. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval of the proposed amendments including any grammatical, formatting, or minor adjustments required from Legal, and/or Planning staff. At their August 11, 2021 regular meeting, the Planning and Zoning Commission voted unanimously (6-0) to recommend approval of the proposed amendments with one additional change to require a conditional use permit for liquor stores in the Central Business District. Updates are summarized as follows: a. Update use charts and categories: fix redundancies, contradictions, and errors b. Reduce most mercantile and personal service categories to General Retail; define General Retail c. Categorize animal-related commercial uses; define Domestic Animal Services, Livestock and Large Animal Services d. Define artisan manufacturing/small-scale production use 1. Examples include microbreweries, handmade crafts, clothing, fashion accessories, and packaged food. 2. Distinguished from industrial uses by size (less than 7,500 square feet) and absence of adverse impacts. e. Hold a PUBLIC HEARING and consider adoption of Ordinance O2021-47, a request for a zoning map amendment to change the zoning from (AG) Agricultural to (SF 8.5) Single Family 8.5, Being 10.74 acres of land situated in and being a portion of the T. P. RR. Co. Survey, Section 141, Abstract 1447, Weatherford, Parker County, Texas. ZCH2021-0009. Mr. Kentner presented this item as well. Staff recommended approval. At the August 11, 2021, meeting the Planning and Zoning Commission approved (6-0) the zone change. Mayor Paschall opened the public hearing at 7:23 p.m. As there were no speakers, Mayor Paschall closed the hearing at 7:23 p.m. On the motion of Kevin Cleveland, second by Jeff Robinson, the Council voted unanimously to approve the zone change. Motion carried 5 - 0.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2021-45, a request for conditional use permit approval for a small rental business located at 1506 Fort Worth Highway, City of Weatherford, Parker County, Texas. CUP2021-0009. Mr. Kentner presented this item as well. Staff recommended approval subject to the following conditions: 1. Alter existing building to comply with Section 12-3-400(B)(1) Design Standards: All buildings in Commercial Corridor Overlay must have a minimum height of 20 feet which also must include at least 5 feet of a solid parapet to cover any roof top units or equipment as applicable, not to exceed 45 feet in height. The minimum height can be achieved with a front façade. Parapets or architectural designs such as arches may be used to achieve the front height requirement. Compliance shall be met within 90 days of certificate of occupancy. 2. Full compliance with Landscaping and Tree Preservation per Section 12-4-102(B)(1)(a). 3. All surfaces with parking and/or storage of dumpsters shall be maintained free from weeds and loose gravel. 4. Repair of equipment not owned by Buffalo Rental is prohibited. 5. Outside storage and dumpsters shall be screened from public view. 6. Full compliance must be maintained; if a third violation notice is issued within an 18-month period all operations must cease until compliance is met. 7. This conditional use permit [...]

Hold a PUBLIC HEARING on the City Manager's Proposed FY22 Budget. Finance Director Dawn Brooks presented this item. Mayor Paschall opened the public hearing at 7:40 p.m. As there were no speakers, Mayor Paschall closed the hearing at 7:40 p.m. No action was required at this time.

Receive recommendation regarding funding outside agency requests for the City's FY22 Budget. Ms. Brooks presented this item as well. Council recommended the following: General Fund Requests: Hotel Occupancy Tax Funds: CASA $5,000 Chamber of Commerce $96,000 CAC of Parker County $5,000 Doss Heritage and Culture Center $5,000 Freedom House $5,000 Manna Storehouse $5,000 Parker County Committee on Aging $5,000 On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this item as presented. Motion carried 5 - 0.

Vote to Propose the City of Weatherford Property Tax Rate for FY22. Ms. Brooks presented this item as well. Before proceeding with the required public hearing, the governing body must hold a recorded vote to propose a tax rate for FY22. The FY22 proposed budget recommends setting the City's property tax rate at $0.4581 per $100 valuation. This rate is equal to the no-new-revenue tax rate of $0.4581 per $100 valuation and less than the voter approved rate of $0.5276 per $100 valuation. A public hearing for this proposed rate will be scheduled for September 14, 2021 and a vote to adopt the rate will also be held on September 14th; as the adoption of the tax rate is required to be held within seven days of the public hearing. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to propose a tax rate of 45.81 cents per $100 of valuation for the fiscal year 2022 budget. Motion carried 5 - 0.

Update regarding Downtown Northeast Quadrant improvements. Director of Transportation and Public Works Manny Palacios presented this update which was for informational purposes. No action was required or taken.
