Discuss Chandor Gardens operations. Shannon Goodman, Director of Parks, Recreation and Special Events introduced Karen Nantz, Chandor Gardens Manager. Ms. Nantz discussed the operations at the gardens. She reviewed the fee schedule and the staff assistance that is available for each of the types of rentals. Hold a public hearing and consider approval of Ordinance 754-2015-43, amendments recommended by the Historic Preservation Commission to Title XII Zoning Ordinance, Section 12-3-12 Overlay and special districts, subsection (b) Historic Overlay District regarding notice, council voting and other provisions for the creation of Historic Overlay Districts. MCA2015-0004 Craig Farmer, Director of Planning and Development, presented this item. He summarized the proposed changes recommended by both the Historic Preservation Commission and the Planning and Zoning Commission. Mayor Hooks opened the public hearing at 6:42 p.m. As there were no speakers, Mayor Hooks closed the hearing 6:42 p.m. On the motion of Craig Swancy, second by Dale Fleeger, the Council voted unanimously to approve Ordinance 754-2015-43. Motion carried 5 - 0.

Survey, Abstract No. 1453, and the George Staggs Survey, Abstract No. 1196, Parker County, Texas. Survey, Abstract No. 1447, Parker County, Texas and being those certain tracts conveyed to Lumar Development, Inc. by deeds recorded in Volume 1852, Page 356 and Volume 1852, Page 359 of the Real Records of Parker County, Texas. Consider a Preliminary Plat for Cutters Crossing Addition, for property located at 2001 S. Bowie Drive, City of Weatherford, Parker County, Texas. SBD2015-0011 Craig Farmer, Director of Planning and Development, presented this item. Cutters Crossing is the subdivision at the corner of Bowie Drive and IH-20. The adjacent frontage roads are in the final stages of completion. Mr. Farmer stated that the Planning and Zoning Commission met December 9th and recommended unanimous approval of the plat contingent upon finalizing the access agreements with the properties to the north; and a minor correction to the easement width. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Consider a Preliminary Plat for Phillips Addition, for property located northwest of 501 W. Lake Drive, City of Weatherford, Texas. SBD2015-0039 Mr. Farmer presented this item. On the motion of Jeff Robinson, second by Dale Fleeger, the Council voted unanimously to approve this item. Motion carried 5-0.
Consider a waiver from perimeter street improvement requirements for property located northwest of 501 W. Lake Drive, City of Weatherford, Parker County, Texas. Mr. Farmer presented this item as well. Mr. Farmer noted that the property owner would normally be required to pay money or improve adjacent streets. The general rule on waivers from street improvements CC121515 Page 2 of 6 is that if the City has plans to improve the road section within 10 years, then the applicant would be required to escrow the money. Major improvements to this road section are not in the City's plans within the next ten years. This is a rural road section. The City will maintain it; however, we have no plans to curb/gutter this section. He stated that the Planning and Zoning Commission voted unanimously to approve these waiver requests. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the waiver from perimeter street improvement requirements. Motion carried 5 - 0.
Consider a waiver from road improvement and sidewalk extension requirements for property located at 816 and 818 W. Park Ave., City of Weatherford, Parker County, Texas. Mr. Farmer presented this item noting that West Park Avenue is not improved in the area adjacent to the subject property. On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to approve a waiver from road improvement and sidewalk extension requirements. Motion carried 5 - 0.
Consider a waiver from water and sewer requirements, and perimeter street improvement requirements for the property located at 1350 North Bend Road, City of Weatherford ETJ, Parker County, Texas. Craig Farmer presented this item. This property is in the northern portion of the community near the Ellis Creek development. The applicant has purchased two acres for development. They are required by the City and the County to plat the property. The streets are a well-maintained county road section. The City is requiring a full right-of-way and we have no anticipation of improving the roads within the next 10 years. The Planning and Zoning Commission recommended unanimous approval of the waivers from water/sewer and perimeter street requirements. On the motion of Dale Fleeger, second by Craig Swancy, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Consider a waiver from water, sewer, and perimeter street improvement requirements for property located at 400 Trailwood Drive, City of Weatherford ETJ, Parker County, Texas. Mr. Farmer presented this item. This development is 3.75 acres. The owner is proposing the sale of a 2- acre tract to the applicant. The City requires the applicant to plat the property and will ensure that we have right-of-way. The request is for waivers from water/sewer and perimeter street requirements. The Planning and Zoning Commission recommended approval at their meeting on December 9th. The following were called to speak regarding this item: Rick Hernandez, 2543 Hayley Drive, a resident of the adjacent Elk Hollow Estates and a member of their homeowner's association (HOA), spoke in opposition of this item and referred to sections 11-1-13, 11-1-2, and 11-1-9(a) of the City's subdivision ordinance. Dr. Kenneth E. Spaeth, 2526 Hayley Drive, a resident of the adjacent Elk Hollow Estates and a member of their HOAs architectural committee, spoke in opposition of this request and referred to section 11-1-2 of the subdivision ordinance with regard to environmental concerns relating to water pollution because the land is a wetland and water and springs stand on the ground. Ron Kearney, seller, stated that he has owned the property for 20 years and that there are no springs on or around the property. [...]
Mayor Hooks and Mr. Robinson voted in opposition of tabling this item. Mayor Pro Tem Craig Swancy excused himself from the meeting. Consider a waiver from water and sewer, cul-de-sac length, two-points of access, and street construction standard requirements for property located at 3400 F.M. 920 (Peaster Hwy.), City of Weatherford ETJ, Parker County, Texas. Craig Farmer, Director of Planning and Development, presented this item. He reviewed the ingress/egress checklist. A second way in/out is not required for emergency access because the development has less than 30 lots. Because this area is in the ETJ, the City's fire code does not apply. When applying the subdivision ordinances, there may be some concerns regarding ingress/egress. The applicant is requesting waivers before submitting the plat. Ottis Lee with Baird Hampton Brown spoke on behalf of the property buyer. The fire code does not apply since this property is in the City's ETJ even though the City does service the area with via the ESD3 contract. Regardless of the length of the cul-de-sac, the development is still fewer than 30 homes. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted to approve this item. Motion carried 4 - 0.
Consider a waiver from sewer requirements and perimeter street requirements for property located at the southeast corner of Charles St. and Newport Road, City of Weatherford, Texas. Mr. Farmer presented this item. Charles Street is curbed and guttered near Wright Elementary. The applicant has agreed to escrow the money or improve a portion of Charles Street. The Planning and Zoning Commission recommended granting a waiver to sewer requirements and perimeter street requirements for Newport Road. On the motion of Jeff Robinson, second by Dale Fleeger, the Council voted to approve this item. Motion carried 4 - 0.
Consider and/or act upon approval of Ordinance 750-2015-39 creating a Juvenile Case Manager position and fund. Chief Financial Officer Brad Burnett presented this item. The Texas Code of Criminal Procedures allows a municipal court, upon approval of the City Council, to employ a juvenile case manager. Advantages of having a juvenile case manager include: allowing better management and the ability to custom fit a program that best fits the juvenile's needs. A $5 fee will be assessed to each violation and receipts are estimated between $25,000 to $30,000 annually. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted to approve this item. Motion carried 4 - 0.
Discuss and receive direction on Tax Increment Reinvestment Zone (TIRZ). Assistant City Manager James Hotopp presented this item. Tax Increment Reinvestment zones were discussed during the October 20, 2015 meeting. A TIRZ would be another economic development tool for the City. Staff will work with outside consultants to develop contracts, an ordinance, a feasibility plan, a financial plan, and reimbursement resolutions from the TIRZ to the City Council. Staff requested Council direction before moving forward with the consultant. Ms. Wilder mentioned concerns about cities being bound to contracts and obligations in these types of reinvestment zones. She asked that Council and staff research this item. Council consensus was to move forward with a work session on January 12 to discuss this topic and the next steps.
