5.a: Presentation of awards by the Department of War Employer Support for the Guard and Reserve to the City of Weatherford. Assistant City Manager Chad Marbut introduced Department of War Employer Support of the Guard and Reserve (ESGR) Texas State Chair Richard Noriega and Texas ESGR North Region Director Wyvette McLendon. Mr. Noriega provided an overview of ESGR's mission and recognized the City of Weatherford with the Pro Patria Award for its support of employees who serve in the National Guard and Reserve. Ms. McLendon presented Patriotic Employer Awards to Fire Chief Jonathan Peacock, nominated by Fire Department Finance Specialist/Staff Sergeant Sarah Allen, and City Manager James Hotopp, nominated by Assistant City Manager/Major Chad Marbut. She also presented the Above and Beyond Award and Pro Patria Award to the City of Weatherford and announced the City's nomination for the Freedom Award, representing the only municipality in Texas nominated in the government category. Mayor Paschall recessed the meeting at 6:31 p.m. for a short break. The meeting was reconvened at 6:38 p.m.

8.c: Discuss and consider nominees for the Texas Municipal League Intergovernmental Risk Pool Board of Trustees. City Manager James Hotopp reviewed the background and purpose of the Texas Municipal League Intergovernmental Risk Pool (TMLIRP) and advised that trustee Places 1 through 4 were open for nomination. On the motion of Paul Paschall, second by Matt Ticzkus, the City Council voted 5 – 0 to nominate City Manager James Hotopp for Place 4 on the Texas Municipal League Intergovernmental Risk Pool Board of Trustees.

8.e: Consider Resolution R2026-13 supporting the appointment of the Parker County Judge as the primary representative for the Parker/Wise County cluster on the Regional Transportation Council of the North Central Texas Council of Governments. City Manager James Hotopp presented a resolution supporting the appointment of representatives to the Regional Transportation Council (RTC) of the North Central Texas Council of Governments (NCTCOG). He explained that the resolution supports appointing Parker County Judge Pat Deen as the Parker/Wise County cluster's primary representative and Wise County Judge J.D. Clark as the cluster's secondary representative. On the motion of Luke Williams, second by Rod White, the City Council voted 4 – 0 to approve Resolution R2026-13 as presented.

8.a: Consider adopting a fiscal year meeting schedule. City Manager James Hotopp presented a proposed fiscal year 2025-26 meeting schedule. On the motion of Luke Williams, second by Zack Smith, the City Council voted to schedule: • one meeting in November 2025, on November 18; • two meetings in December 2025, on December 2 and December 16; and • two meetings in July 2026, on July 14 and July 28. The motion carried on a 3–2 vote, with Council Members Wilder, Smith, and Williams voting Yea, and Mayor Paschall and Council Member Ticzkus voting Nay.

8.b: Discuss and Consider Resolution R2025-16, Nominating Candidates to the Parker County Appraisal District Board of Directors. City Manager James Hotopp explained that the appraisal district is governed by a nine- member board, with five directors appointed by the taxing units. He noted that the terms of two appointed directors would expire on December 31, 2025, and submitted Richard Barret and Joe Wilkinson as candidates for Council consideration. On the motion of Matt Ticzkus, second by Luke Williams, the City Council voted unanimously to approve Resolution R2025-16 nominating candidates Richard Barret and Joe Wilkinson to the Parker County Appraisal District Board of Directors. The motion carried 5 - 0.

The City Council held a discussion regarding the price difference between Sargent’s R&B1 LP and Christian Brothers Automotive bids. Accounting Manager Hannah Seymour addressed questions from the Council. On the motion of Zack Smith, second by Luke Williams, the City Council voted unanimously to approve the award of RFP No. 2025-012 to Sargent’s R&B1 LP for the remainder of the fiscal budget year and not pursue the contract with Christian Brothers Automotive – Weatherford; and authorize the City Manager to execute the contract for fleet maintenance and repair services to support the upkeep of the City of Weatherford’s departmental fleet, for a cumulative amount not to exceed $125,000 annually. The motion carried 5 - 0.

8.i: Discuss and consider appointments of City Council liaisons to City Boards, Commissions, and Committees, and selection of Mayor Pro Tem. City Manager James Hotopp explained that it is customary for the City Council to review and appoint representatives and liaisons to various City boards, commissions, and committees following the May election each year. He added that the Mayor serves as Chair of the Municipal Utility Board and attends other meetings, speaking engagements, and ceremonial events, without additional assignments. 8.m: Consider approval of Resolution R2024-24 casting the City's votes for the Parker County Appraisal District Board of Directors (PCAD). City Manager James Hotopp explained that the City of Weatherford had been allocated 255 votes in the Parker County Appraisal District's (PCAD) Board of Directors election. He noted that, because the City did not have enough votes to independently elect a member, it traditionally aligned its votes with Weatherford ISD. Mr. Hotopp added that Weatherford ISD had cast its votes for Jerry Durant and John Hinton this year, and, based on that alignment, staff recommended casting 128 votes for Jerry Durant and 127 votes for John Hinton. On the motion of Matt Ticzkus, second by Heidi Wilder, the City Council voted unanimously to approve Resolution R2024-24 casting 128 votes for Jerry Durant and 127 votes for John Hinton to serve on the Parker County Appraisal District Board of Directors. The motion carried 5-0.

8.c: Consider and/or act upon approval of Resolution R2024-10 formally supporting the Parker County Judge for a seat on the Regional Transportation Council of the North Central Texas Council of Governments. City Manager James Hotopp explained that the Regional Transportation Council (RTC) serves as the policy body for the Metropolitan Planning Organization (MPO), comprised of forty-four elected and appointed officials within the MPO boundaries. He added that the RTC's bylaws stipulate only elected county officials can hold membership seats and that one membership seat is shared between Parker and Wise Counties, allocated based on a weighted percentage of the population. Each selected member serves a two-year term, with RTC mandating seat rotation to ensure fair representation. Mr. Hotopp reported that the Wise County Judge held the primary seat for the 2022-2024 term, and on May 13, 2024, the Parker County Commission's Court voted for Parker County Judge Pat Deen to occupy the primary membership seat. He noted that staff recommended adopting Resolution R2024-10 in support of Parker County Judge Pat Deen as the primary member and Wise County Judge JD Clark as the alternate representative. On the motion of Luke Williams, second by Paul Paschall, the City Council voted unanimously to approve Resolution R2024-10. The motion carried 5 - 0.

City Manager James Hotopp emphasized that this development would not impact existing resources, as sufficient capacity existed within the City’s water and wastewater treatment plants to support it. He added that the utility staff plans for developments decades in advance. The voluntary annexation request was received on August 5, 2020 from Rick Shaffer, Director of Water Utilities, regarding this property recently purchased by the City of Weatherford. Discuss and consider proposed changes to and adoption of the 2019 Council Policy Manual. City Secretary Malinda Nowell presented this item. Changes were discussed on pages five and six. The Consensus was to remove "avoid reference to personalities" from the redlined paragraph on page five. The redlined paragraph on page six will be removed completely. The social media participation policy will be included as recommended on the draft that was provided in the agenda packet. Council agreed with citizen comments on non-agenda items being located at the end of all future meeting agendas. Deputy City Manager James Hotopp noted that the nepotism policy is included as an attachment since it is part of the personnel policy and could be changed. Mrs. Nowell stated that these changes complete the review of the Council Policy Manual and that it will be placed on the Consent Agenda for adoption by resolution at the next regular meeting.

Consider approval of Ordinance O2019-04 repealing ordinances 1990-5 and 314-2007-80 and 549- 2011-30 and providing for an exemption from taxation for Goods-In Transit pursuant to section 11.253 of the tax code. Deputy City Manager James Hotopp presented this item. He stated that on November 7, 1989, Article VIII, Section 1-J was added to the Texas Constitution allowing for the exemption from ad valorem taxation of certain tangible personal property temporarily located in this state. However, the Legislature did allow for a municipality to hold a public hearing and take official action for this tax to remain in place locally. On March 27th, 1990 the city approved Ordinance 1990-05, which allowed for the taxation of these items. The Texas Legislature, in the 80th regular legislative session, enacted House Bill 621, which added Texas Tax Property Code section 11.253 for the purpose of exempting certain tangible personal property from ad valorem taxation, defined within the Section 11.253 and referred to it as ‘goods-in- transit’. The Legislature did allow for a municipality to hold a public hearing and take official action for this tax to remain in place locally. On November 27, 2007, the city passed Ordinance 314-2007-80 allowing for the taxation under Section 11.253 of the Texas Tax Property Code. Deputy City Manager James Hotopp stated that this is a continuation of a public hearing that originally began on November 27th. This item is for the creation of TIRZ No. 2 which spans 1,845 acres and is for a 30-year term. The proposed ordinance appoints the initial board of directors who is charged with developing the final project and finance plan. Mr. Hotopp stated that the public hearing on November 27th was tabled and continued strictly for the preliminary project and finance plan, which is now available. Mr. Hotopp also mention that wo owners had requested removal from the TIRZ 2 boundary and that those letters were provided to the Council at the November 27th meeting. The City’s consultant Trent Petty with Petty and Associates spoke about the TIRZ. He stated that the TIRZ may not issue bonds, the TIRZ may not exercise eminent domain; and the TIRZ may not assess new taxes. There is no negative impact to residential property located within the TIRZ. There is no requirement that the TIRZ fund 100 percent of the proposed projects. Mr. Petty stated it is still unknown if any of the other taxing entities will participate. Hold a PUBLIC HEARING and consider approval of Ordinance 944-2018-59 Designating a Geographical Area within the City of Weatherford as a Tax Increment Reinvestment Zone Pursuant to Chapter 311 of the Texas Tax Code, to be known as Reinvestment Zone Number Two, City of Weatherford. Deputy City Manager James Hotopp presented this item. He stated that at the November 13 meeting, a resolution was passed initiating the process of forming Tax Increment Reinvestment Zone (TIRZ) #2. The resolution required a public hearing to be held prior to adoption of an ordinance creating the TIRZ. Notice for the public hearing was published approximately 10 days ago. At the time the notice was submitted to the paper, staff anticipated having the preliminary project and finance plan available. Since the preliminary project and finance plans were not available, staff recommended opening the public hearing allowing comments, and continuing the public hearing until the December 11th meeting. Staff also recommended no action on the ordinance at this time. Mr. Hotopp introduced Trent Petty with Petty and Associates. Discuss and consider participation in a 'Sister City' program. Deputy City Manager James Hotopp presented this item. He provided background information on Sister Cities International (SCI). SCI is a nonprofit citizen diplomacy network that creates and strengthens partnerships between the United States and international communities. The City of Weatherford has been approached by the Parker County Economic Development Council (PCEDC) about participating in the SCI program with Toowoomba, Queensland (AU). Allison Baker, Chair of Weatherford SCI, spoke about the similarities between Weatherford and Toowoomba. Discussion included digital agriculture and using technology to improve agriculture yield and reduce costs. SCI is designed to be an international global exchange between cities. Ms. Baker spoke about plans to expand the current board of three to include Weatherford College, Weatherford ISD, City leadership, and others. She mentioned business, education and cultural benefits. May Ferguson, President and CEO of Fort Worth SCI spoke about the economic benefits, the tourism opportunities, citizen diplomats, global relationships, and educational opportunities. Ms. Baker stated the idea of digital exchanges for younger students is exciting. Weatherford City Council, June 27, 2017: 12 items; Recognition ceremony naming the City of Weatherford as a National Weather Service

Consider and/or act upon approval of Resolution R2017-16 to establish an economic development incentive policy. Deputy City Manager James Hotopp presented this item. The previous policy was adopted in 2015 pursuant to Chapter 312.002 of the Texas Tax Code and expired in March 2017. Since the City Council and Economic Development Board periodically receive requests for economic development incentives from various businesses, staff has worked with a consultant to develop a new incentive policy. The policy lays out several incentive programs staff could use to attract, retain and expand businesses. The policy gives Council final approval for economic incentive programs and may apply broad discretion as to project eligibility, amount of incentive, and qualification parameters. Upon approval and adoption, the Guidelines and Criteria for Economic Development Incentives will be established for the two (2) year period ending June 2019. Approval only gives the City the opportunity to consider such actions as economic development tools. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted to approve this item. Accept donation of Myers Map. James Hotopp, Assistant City Manager, stated that Mr. John Kirkpatrick recently donated three historic maps to the City of Weatherford. The maps are dated 1887, 1889, and 1905. The Myers Map from 1905 was adopted by ordinance as the official map of the City of Weatherford in 1905. The City recently had the maps restored and appreciates the donation from Mr. Kirkpatrick.

Weatherford City Council (Retreat), May 31, 2016: 1 item; City Council Retreat to discuss and consider City Council goals and objectives;

City Council Retreat to discuss and consider City Council goals and objectives; staff/departmental operational needs and capital priorities; policies; and strategies to address these goals, objectives, needs, and priorities. City Manager Sharon Hayes introduced Trent Petty, Petty and Associates, who reviewed the Staff Operations, Capital, and Capital Projects Prioritization questionnaire that directors completed for the City Manager’s Office approximately three weeks ago. Mr. Petty did not go into detail on the responses; however, he did state that, across the board with the exception of two departments, staffing was the number one operational issue. The Council and management need to be headed in the same direction because the City does not have a lot of extra dollars at the same time as we have many needs across the departments. City Manager Sharon Hayes gave a quick budgetary history beginning in 2006 and spoke about succession planning. Assistant City Manager James Hotopp spoke about personnel being the number one cost to the city, and other operational challenges including cost of service increases, aging facilities, aging fleet, aging work force, employee retention, and competitive work environments. Weatherford City Council, Jan. 26, 2016: 5 items; public hearing and consider a request for a Zoning Change for property zoned PD Planned

Discuss and consider approval of a contract with Black & Veatch to conduct a radio needs assessment. James Hotopp, Assistant City Manager, presented this item. The city has over 275 radios utilized by more than eight departments. Staff is beginning to plan for a radio system replacement driven by both technology changes and federal mandates which will cut the broadcast frequency in half. Mr. Hotopp stated this happened once in 2013 and will happen again in the next five years. Most of the city's current radios will become incompatible when the Federal Communications Commission (FCC) institutes the second round of narrow banding. To plan adequately for a radio system replacement, staff recommends hiring of a professional consultant to conduct a comprehensive needs assessment. The consultant would meet with departments to determine current and future needs. They will perform a complete evaluation of the city's equipment and what can be maintained or reused in future configurations. They will evaluate the public safety dispatch operation currently in place including staffing levels. They will provide a description of system alternatives along with budgetary cost estimates. Weatherford City Council, Dec. 15, 2015: 13 items, 1 split vote; Discuss Chandor Gardens operations

Discuss and receive direction on Tax Increment Reinvestment Zone (TIRZ). Assistant City Manager James Hotopp presented this item. Tax Increment Reinvestment zones were discussed during the October 20, 2015 meeting. A TIRZ would be another economic development tool for the City. Staff will work with outside consultants to develop contracts, an ordinance, a feasibility plan, a financial plan, and reimbursement resolutions from the TIRZ to the City Council. Staff requested Council direction before moving forward with the consultant. Ms. Wilder mentioned concerns about cities being bound to contracts and obligations in these types of reinvestment zones. She asked that Council and staff research this item. Council consensus was to move forward with a work session on January 12 to discuss this topic and the next steps.

Consider a Final Plat for Lockwood Estates, Phase III, located at the end of Ethan and Zachary Drives, more generally described as being an approximately ±11.3 acre tract in the John Rucker Survey, A-1144, City of Weatherford, Parker County, Texas. SBD2015-0038. Craig Farmer, Director of Planning and Development, presented this Final Plat which contains 46 lots. Existing roadways coming into this phase are Ethan Drive and Zachary Drive. This phase connects the Trace Ridge and Lockwood developments. The development will have access to the frontage road and Causbie Road. Assistant City Manager James Hotopp commented that the requirement for an offsite Enter Name of Meeting Body and Date Page 2 of 4 easement has been remedied. On the motion of Jeff Robinson, second by Dale Fleeger, the Council voted unanimously to approve the Final Plat. Motion carried 4 - 0.

Weatherford City Council, Feb. 11, 2014: 7 items; Presentation of Recognized Yard Awards for October through December 2013

Discuss and consider approval of the use of gas well royalties for engineering services for the Wastewater Effluent Reuse Project. James Hotopp, Director of Water/Wastewater and Engineering, presented this item. The Council and Utility Board authorized the use of gas well royalties for the development of an effluent reuse implementation plan in March 2013. The plan was presented to the Board in November and provides answers about location of a reuse collection point, discharge point, permit requirements, amount of effluent we can discharge into Lake Weatherford and required improvements at the Wastewater Treatment Plant. At the December Board meeting, staff discussed a preliminary project schedule showing an overview of several tasks for the project. In January, the Board approved the use of gas well royalties for preliminary engineering, survey/easement preparation, and permit preparation/submittal tasks. The estimated cost of these tasks is $400,000. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted to approve of the use of gas well royalties for engineering services for the Wastewater Effluent Reuse Project, not to exceed $500,000. Motion carried 4 - 0.

Consider appointing two councilmembers to work with staff and the consultant on prioritizing projects with the Holland Lake Watershed. Terry Hughes, Director of Capital Transportation Projects, asked that two Council members work with staff and the consultant in the prioritization of projects for the Holland Lake Watershed study. It will take approximately two hours and they are hoping to meet next week. Jeff Robinson and Waymon Hamilton CC 011414 Page 2 of 7 volunteered. Bobbie Narramore, 209 West First Street, requested that the appointed members know the area that is being considered and the watershed. Discuss and consider recommendations on water and wastewater impact fees. James Hotopp, Director of Water/Wastewater/Engineering Utilities, presented this item. Mr. Hotopp explained that impact fees are allowed under Chapter 395 of the Local Government Code. They were established in 2003 and updated in 2008. They must be reviewed and updated at least every five years and this item is the recommendation resulting from the review which was undertaken in 2013. Mr. Hotopp identified the review process. First, the committee was established on April 9, 2013 and consisted of Jim Duncan, Janis Saunders, Howard McClurkin, Eva Earl Rutledge, and Jeff Jones. Consider and/or act upon approval of Resolution R2013-08 supporting State Water Infrastructure Financing Programs. James Hotopp, Director of Water/Wastewater and Engineering, presented this item to the Council. Without raising taxes, this legislation would make a one-time $2 billion dedication of money already deposited in the State's Economic Stabilization Fund available as a virtually permanent source of funding to support State Water Infrastructure Programs already authorized by Texas voters. On the motion of Waymon Hamilton, second by Heidi Wilder, the Council voted unanimously to approve Resolution R2013-08. Motion carried 5 - 0.

Weatherford City Council, March 12, 2013: 8 items; Proclamation naming March as Red Cross Month

Discuss and consider adoption of Ordinance 610-2013-04 amending elements of the Water Conservation and Drought Contingency Plan. James Hotopp, Director of Water/Wastewater and Engineering presented this item. Mr Hotopp stated that the Water Conservation and Drought Contingency Plan are required by the Texas Commission on Environmental Quality (TCEQ). The Water Conservation Plan defines specific conservation or water loss reduction goals and the Drought Contingency Plan identifies triggers, stages, and actions. The City Council adopted a plan in August of 2002 by ordinance. It was revised in October 2004 to include requirements by TCEQ for updates and resubmission every five years. It was revised again in April 2009 to include targeted water conservation goals. Recent implementation of the plan include: a stage five restriction in 2010 due to a two month time period when the Water Plant was shut down, a stage two restriction in 2011 due to a record drought, and stages one and two restrictions that started in 2012 and are still in effect. Lessons learned from previous plans are that the plan needs to be simplified, it needs to be consistent with the metroplex mainly due to media coverage, and that it needs to be revised so that our trigger levels are tied to lake levels and Tarrant Regional Water District (TRWD) so that if TRWD is in conservation mode we are as well. Discuss and consider authorizing the City Manager to execute a contract with Freese and Nichols, Inc. to perform the Holland Lake Creek watershed study. Terry Hughes also presented this item. Mr. Hughes spoke regarding Holland Lake and the two tributaries that feed into Holland Lake. He spoke about hydraulics, hydrology, geomorphology, and sedimentation. Five engineering firms were interviewed on January 21, 2013. The interview panel included James Hotopp, Danielle Felts, Howard McClurkin, Paul Paschall, and Terry Hughes. Sharon Hayes, Bill Smith, and Manny Palacios also attended the interviews. Each team member used weighted matrix to score each firm. In the end, all scores were tallied to finalize the rating. Freese and Nichols, Inc. received the highest rating. On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to authorize the City Manager to execute a contract with Freese and Nichols, Inc. to perform the Holland Lake Creek watershed study. Motion carried 5 - 0.
