Presentation of City's Economic Development video. Director of Communications and Marketing Blake Rexroat presented this video. Mr. Rexroat and city staff worked with a videographer and a company named Neon Cloud to develop several marketing videos for the city. This is the first of four that will be shown over the next several Council meetings. More videos will be created during this fiscal year.
Consent agenda, approved as one vote (5-0, on the motion of Heidi Wilder, second by Kevin Cleveland): Approved the minutes of the City Council meeting held January 22, 2019. Approved an Interlocal Agreement between the City of Weatherford and the North Central Texas Emergency Communications District for regional 9-1-1 services. Accepted the Weatherford Police Department Annual Contact Report for 2018. Authorized the Weatherford Police Department to apply for grant funding offered through the Texas Department of Transportation for a Special Traffic Enforcement Project (STEP) Grant and approved Resolution R2019-04 authorizing the City Manager to execute in the name of the City of Weatherford all necessary applications, contracts, and agreements to implement and carry out the purposes of the grant. Adopted Ordinance O2019-02 releasing, vacating and abandoning a sanitary sewer easement located in the James A. Yeoman Survey, Abstract No. 1693, Parker County, Texas as described in Document 201522378, Deed Records, Parker County, Texas and authorizing the mayor to execute a Quit-Claim Deed of the easement to Shay Lynn Voorhees dba 3V Properties. Adopted Ordinance O2019-05 establishing Stop and Yield Signs at various street locations within the city. Approved a cooperative purchase agreement with Intermountain Slurry Seal Inc. for Micro- surfacing various city streets. Renewed Bid#2018-012 for asphalt paving on various city streets to Weldon C. and Bill Jordan Construction, Inc. based on lowest most responsive overall bid. Consider approval of Resolution R2019-05 adopting the City of Weatherford Investment Policy and Strategy and approval of the City's broker/dealer list. This item, 6f, was removed from the Consent Agenda for separate consideration. Finance Director Kyle Lester presented this item. He stated that all investment policies serve the same basic purpose which is to safeguard government funds from fraud, abuse and risk. He stated that the investment policy applies to all funds invested by the city. The primary focus is safety, liquidity and diversity. The secondary focus is yield. Staff did not recommend any changes to the investment policy that was adopted in 2018. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to approve the resolution and investment policy. Motion carried 5 - 0. Consider acceptance of the 4th quarter investment report. This item, 6g, was removed from the Consent Agenda for separate consideration. Mr. Lester presented this item as well. He provided data regarding the employment outlook, the city’s current portfolio, the WAM (Weighted Average Maturity), the portfolio performance, and the comparison of city yield to T- Bill rates. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to accept the investment report. Motion carried 5 - 0.
Receive quarterly financial report and consider and/or act upon approval of Ordinance O2019-03 amending the FY19 Adopted General City Budget. Finance Director Kyle Lester presented this item. He stated that the city closed the fiscal year by decreasing the fund balance by only $306k. Revenues were over projections by $761k and expenditures were under by more than one million, which totals a $1.8m increase over staff’s projections. General Fund departments have $846k that will need to be rolled over into this fiscal year. The gain over FY18 plus rollovers totals $731,971. Roll-over items include: 1. After the first quarter of each year, city staff takes an inventory of all items that were budgeted for the previous fiscal year, but unable to be spent. These items are subsequently added to the current year’s budget in order to complete the originally planned projects, with priority given for projects with active purchase orders. For FY18, these items total approximately $853,000. A brief synopsis of these items are as follows: a. The largest single category for our rollover items is facilities maintenance. Consider approval of Ordinance O2019-04 repealing ordinances 1990-5 and 314-2007-80 and 549- 2011-30 and providing for an exemption from taxation for Goods-In Transit pursuant to section 11.253 of the tax code. Deputy City Manager James Hotopp presented this item. He stated that on November 7, 1989, Article VIII, Section 1-J was added to the Texas Constitution allowing for the exemption from ad valorem taxation of certain tangible personal property temporarily located in this state. However, the Legislature did allow for a municipality to hold a public hearing and take official action for this tax to remain in place locally. On March 27th, 1990 the city approved Ordinance 1990-05, which allowed for the taxation of these items. The Texas Legislature, in the 80th regular legislative session, enacted House Bill 621, which added Texas Tax Property Code section 11.253 for the purpose of exempting certain tangible personal property from ad valorem taxation, defined within the Section 11.253 and referred to it as ‘goods-in- transit’. The Legislature did allow for a municipality to hold a public hearing and take official action for this tax to remain in place locally. On November 27, 2007, the city passed Ordinance 314-2007-80 allowing for the taxation under Section 11.253 of the Texas Tax Property Code. Consider a request for WAIVERS ONLY from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, pertaining to the approved preliminary plat for the 10.398 acre Heritage Ridge Subdivision, located on White Settlement Road, approximately three-quarters of a mile east of Pearson Ranch Road, and situated in and being a portion of the H.T. & B. RR Co. Survey, Section 11, Abstract No. 644, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2018-0010. City Planner Stan Hamrick presented this item. He stated that the Council previously approved a preliminary plat for this project; the applicant has since asked for waivers. The applicants, Jason Williams and Brian Evans, have received preliminary plat approval for the 8-lot Heritage Ridge subdivision. The site is 10.398 acres in the ETJ and has frontage on White Settlement Road. The applicants are preparing the site for development and request waivers from requirements to construct a screening wall abutting White Settlement Road and to improve the section of White Settlement Road on which this development fronts to a standard section. Consider a request for preliminary plat approval, including waivers for certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, for the Crown Valley Phase 1, Section 3 subdivision, described as being 53 lots on 12.92 acres located at 1180 Mikus Road and situated in the C.C. McCarver Survey, Abstract No. 908 and the Nathanial Watson Survey, Abstract No. 1665, City of Weatherford, Parker County, Texas. SBD2018-0032. Mr. Hamrick presented this item as well. This is a preliminary plat for a subdivision. The applicant, Horned Frog Investments, LLC, requests preliminary plat approval for the Crown Valley Phase 1, Section 3 subdivision of 53 lots totaling 12.92 acres. The site lies to the north of the completed Phase 1, Section 2 of Crown Valley, adjacent to Mikus Road. With preliminary plat approval, the applicant requests waivers to the following requirements of the subdivision ordinance: 1. Requirement for at least 50 percent of the total centerline length of all streets within a residential subdivision be curvilinear in design. 2. Requirement to construct Mikus Road to a standard collector section. 3. Requirement to pave all new streets to standards as specified in the city’s engineering design standards. Consider a request for WAIVERS ONLY from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, for a minor plat of 7.339 acres located at 3570 Mineral Wells Highway out of the J.M. Groundie Survey, Abstract No. 1755, an addition in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2018-0068. Mr. Hamrick presented this item as well. This is a rural subdivision on the edge of the city’s ETJ. The applicant, Arthur Griffin, Jr., has requested administrative approval of a plat of two lots totaling 7.339 acres. The site lies within the city’s ETJ and has frontage on Mineral Wells Highway. Tract Two includes a single-family dwelling at 3570 Mineral Wells Highway which is served by an existing private water well and onsite septic system. The applicant intends to construct a single-family dwelling on the two-acre Tract One, to be served by a new water well and septic system. The applicant requests waivers for requirements to connect each lot to the city’s water system and wastewater collection and treatment system. Consider a request for minor plat approval, including waivers, from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance and Title XII, Zoning Ordinance, for a two-lot subdivision located at 815 W. Ball Street, and described as being 0.268 acres situated in and being a portion of Lot 3, Block 9, Ball’s First Addition, an addition in the City of Weatherford, Parker County, Texas. SBD2018-0069. Mr. Hamrick presented this item as well. The applicant, Richard Craig Stanislav, has requested administrative approval of a plat of two lots totaling 0.268 acres. The site lies at the intersection of West Ball Street and Harcourt Street. The proposed Lot 3R1 includes an existing single-family dwelling at 811 West Ball Street. The proposed Lot 3R is vacant following the demolition of an additional single-family dwelling. Future construction of a new single-family dwelling is proposed for Lot 3R. The applicant requests waivers from development standards pertaining to lot size, dimensions, and setbacks. Mr. Hamrick stated that there is no real way to create two lots that will meet the requirements. Staff recommended denial and the PZC concurred. On the motion of Curtis Tucker, second by Heidi Wilder, the Council voted unanimously to deny this request. Motion carried 5 - 0.
Discuss and consider a Right of Way Use license agreement with ZAYO Group, LLC. Manny Palacios, Director of Transportation and Public Works presented this request for a right-of-way use agreement from Zayo Group, which is a fiber/telecommunications company. He stated that Zayo wants to run fiber through town and connect to cell towers. Mr. Palacios stated there are approximately five towers in town. Zayo does provide fiber to the schools and they do have an agreement for that purpose. Some of the fiber Zayo proposes to run will be underground and some will be above ground. Mr. Palacios stated that the proposed agreement has been negotiated with attorneys and that if the fiber is to be attached to any Weatherford poles, then there is a separate agreement and a separate fee for that. The agreement provides that Zayo will compensate the city an annual fee of $1.50 per linear foot of fiber optic cable installed in the city’s right-of-way. According to Zayo's proposed plan, it is estimated that 35,236 linear feet of fiber optic cable will be placed within city right-of-way. The estimated annual fee after installation of all proposed fiber optic within the city right-of-way is $52,854. Discuss and consider the award of Bid #2019-12 and authorize the City Manager to enter into a contract agreement with Reytech Services, LLC for the construction of the College Park and Martin Drive roundabout. Mr. Palacios presented this item as well. This request is for the construction of a modern roundabout at the intersection of College Park and Martin Drive. The intersection has a high traffic flow during peak hours causing traffic congestion. A modern roundabout at this location will help improve traffic flow, pedestrian safety, and aesthetically improve the area. The existing underground storm water system will be reconstructed to city standards. The city and Weatherford College mutually agreed on a memorandum of understanding in which the college will provide water and maintenance to the landscaping improvements plus construct landscaping improvements in the center of the roundabout. The city will construct the modern roundabout infrastructure. This project was initially intended to be constructed in- house by department crews but due to unforeseen circumstances, city staff had to bid out this project. This project was advertised December 29, 2018 and January 5, 2019. Bids were opened January 14, 2019 at 2:00 PM. A total of six bids were submitted. Discussion regarding Parks and Recreation User Agreements. Shannon Goodman, Director of Parks, Recreation and Special Events presented this work session item. This item was discussed with the Parks and Recreation Advisory Board earlier this month. The proposal is in an effort to make the user agreements and fees standard, across the board, for the Weatherford Little League (WLL), the Weatherford Soccer Association (WSA) and the Weatherford Youth Association (WAY) since those organizations have exclusive use agreements with the city. Terms of the agreement include the following; WLL • Fees are reduced to balance with city rental rates and other exclusive use groups. • Define what WLL is expected to take care of during season. • How the WLL contacts the city. • Required to attend a Youth Sports Summit hosted by the city. WSA • Will start paying fees (this will be first updated agreement since 1987). • Define what WSA is expected to take care of during season. • How the WSA contacts the city. • Required to attend a Youth Sports Summit hosted by the city. WYA • This will be their first User Agreement; everything is new. • Will start paying fees (participants fee). • Required to attend a Youth Sports Summit hosted by the city.
