Consent agenda, approved as one vote (4-0, on the motion of Jeff Robinson, second by Kevin Cleveland): Approved the minutes of the City Council meeting held June 23, 2020. Approved Resolution R2020-14 authorizing City of Weatherford representatives to perform activities associated with the City's investment accounts at TexPool. Approved the COBRA Continuation of Coverage (COC) administrative agreement with TML Intergovernmental Employee Benefits Pool. Appointed Dr. Beau Rees, Superintendent of Weatherford ISD, to the Weatherford Economic Development Board; appointed John Thielepape to the vacant position on the Weatherford Housing Authority; appointed Lance Gerry from alternate to a full member seat on the Building and Standards Commission; and appointed Philip Vandagriff to the vacant alternate seat on the Building and Standards Commission. Adopted ordinance O2020-32 establishing traffic control devices at various locations within the City and adopted ordinance O2020-33 to revise the existing school zone for Silverstone Drive and revising the speed zone limits for Azle Highway. The ordinances are captioned as follows: ORDINANCE O2020-32 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS, AMENDING WEATHERFORD CODE OF ORDINANCES, TITLE X MOTOR VEHICLES AND TRAFFIC, CHAPTER 3 TRAFFIC-CONTROL DEVICES, SECTION 10-3-12 SPECIFICALLY CONTROLLED STREETS BY ADDING THERETO CERTAIN INTERSECTIONS FOR THE ENFORCEMENT OF TRAFFIC CONTROL DEVICES ON RIGHT-OF-WAYS IN THE CITY OF WEATHERFORD, TEXAS, PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING A SAVINGS CLAUSE, ESTABLISHING A PENALTY. ORDINANCE O2020-33 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS, AMENDING TITLE 10, CHAPTER 17, SECTION 10-17-2 BY AMENDING THE SCHOOL ZONE OF SAID SECTION TO AMEND SCHOOL ZONE TIME REQUIREMENTS FOR THE DESIGNATED SCHOOL ZONES; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; PROVIDING A SAVINGS CLAUSE; AND PENALTY. Approved Ordinance O2020-34 ratifying the Council's June 23, 2020 unanimous vote to repeal Ordinance O2019-25 which added Chapter 5 - Pawn Shops to Title V Business Regulations of the City Code. The ordinance is captioned as follows: ORDINANCE NO. O2020-34 AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS REPEALING TITLE V "BUSINESS REGULATIONS," CHAPTER 5 "PAWN SHOPS" IN ITS ENTIRETY PROVIDING THAT ALL ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT THAT THEY ARE IN CONFLICT; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. Approved a request for historical appraised tax value exemption for an individual local historic landmark at 605 South Waco Street, City of Weatherford, Parker County, Texas.
Hold a PUBLIC HEARING and consider approval of Ordinance O2020-35, a request for a conditional use permit for an Automobile Wash located at 701 Fort Worth Highway, being a 1.007 acre tract of land defined as parts of lot 6 & 7; block 001, Old Fair Ground addition; City of Weatherford, Parker County, Texas. CUP2020-0005. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended denial of the conditional use permit for the following reasons: 1. The applicant has requested that vacuums must remain at the front of the property. Staff’s current understanding and direction is to de-emphasis automobile uses and excessive cars along the U.S. 180 corridor. 2. The U.S. 180 Corridor Vision Plan outlines a plan to enhance and maintain Weatherford’s western heritage, incorporate historic significance, cultural identity, or embellish Americana qualities. Staff does not interpret a themed car wash as meeting those qualities and goals. At their July 8th, 2020 meeting the Planning & Zoning Commission recommended approval (7 - 0) of the CUP with the following conditions: 1. Adequate parking for office spaces and carwash in accordance with Section 12-5-4. 2. Signage and fountain should not distract from Weatherford’s western heritage. 3. Consider a request for final plat approval for Fox Hollow Phase VI, 38 lots on 9.279 acres situated in the Sarah Monk Survey, Abstract No. 906 and the Robert P. Baker Survey, Abstract No. 150, City of Weatherford, Parker County, Texas. SBD2020-0030. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval. On the motion of Jeff Robinson, second by Matt Ticzkus, the Council voted to approve the final plat for Fox Hollow Phase VI. Motion carried 4 - 0.
Consider a request for a PRELIMINARY PLAT located at 3680 Greenwood Road, described as being 65.910 acres of land situated within the William V.D. Survey, Abstract No. 1169, Parker County, Texas. ZCH2020-0007. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval with the following conditions: 1. Provide the phone number of the developer on the plat. Ref. WMC §11-4-3(f). 2. Identify the street and right of way width of Greenwood Road. Ref. WMC §11-4-4(b) and §11-4- 5(a). 3. Revise the dates in Title Block for Sheet 1 and Sheet 2 as they do not match (JULY on sheet 1 and JUNE on sheet 2) Ref. WMC §11-4-3(d)2. 4. Provide the names and locations of adjacent subdivisions, lots, rights-of-way/streets, and tracts on or within one hundred twenty-five (125) feet of the subject tract. Refer to WMC §11-4-5(a). 5. Parker County's thoroughfare plan shows a principal arterial crossing this property. Provide the required right of way dedication. Consider a request for final plat approval for the two-lot Harmony Flats Addition, located on Harmony Circle and described as 4.518 acres out of the J.M. Bradley Survey, Abstract 118, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2020-0032. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval subject to the following conditions, which must be met prior to certification and filing: 1. Remove all physical features of or on the land. Sec. 11-5-2 2. Update the title block to reflect that this is a final plat rather than a preliminary plat. Sec. 11-5- 2(h) 3. Call out the existing right-of-way widths as such. Sec. 11-5-2(m) 4. Right-of-way dedication should extend to a point 30’ from the centerline of the roadway. Sec. 11- 6-2(c) 5. Improvements to Harmony Circle are required as it is an existing substandard roadway. Consider a request for final plat for 4 lots at 1709 East Bankhead Drive in the City of Weatherford, Parker County, Texas. SBD2020-0033. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval subject to the following conditions, which must be met prior to certification and filing. 1. Provide the name, address, and phone number of the developer. Subdivision Ordinance 11-5-2(j). 2. Provide the required certificates. Subdivision Ordinance 11-5-2(q). At their July 8, 2020 meeting, the Planning and Zoning Commission voted (7 - 0) to approve the plat subject to conditions indicated by staff. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted to approve this item with the two conditions. Motion carried 4 - 0.
Consider approval of Memorandum of Understanding (MOU) between the City of Weatherford and Weatherford College for a partnership at the Weatherford Parker County Animal Shelter. Director of Municipal and Community Services Dustin Deel presented this item. Michael Endy, Weatherford College Vice President of Instruction and Student Services, spoke on behalf of Weatherford College President Dr. Tod Allen Farmer, in support and favor of this program and partnership. On the motion of Kevin Cleveland, second by Matt Ticzkus, the Council voted to approve this item. Motion carried 4 - 0.
Discuss and consider nominees for the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election/Ballot. City Manager James Hotopp presented this item. On the motion of Matt Ticzkus, second by Jeff Robinson, the Council voted to nominate City Manager James Hotopp and Assistant City Manager/CFO Brad Burnett for places 1 and 3. Motion carried 4 - 0.
