Proclamation recognizing Peacock's Feed and Boutique's 25th Anniversary. Council Member Kevin Cleveland presented this proclamation to Blaine and Tamara Peacock. Proclamation recognizing the 50th Anniversary of Bob Nuttall and The Karate University. Mayor Paul Paschall presented this proclamation to Grandmaster Bob Nuttall. Presentation of the Project of the Year Award from the American Public Works Association for the City's Church Street and Elm Street Improvements Project. Transportation Operations Manager Matt Leppla presented this award.
Consent agenda, approved as one vote (5-0, on the motion of Jeff Robinson, second by Kevin Cleveland): Approved the minutes of the City Council meeting held October 26, 2021. Approved the 2021 Water and Wastewater Impact Fee Study Update and adopted Ordinance O2021-59 updating water and wastewater impact fees. The ordinance is captioned as follows: ORDINANCE NO. O2021-59 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS AMENDING TITLE IX – PUBLIC WAYS AND PROPERTY, CHAPTER 8. - UTILITY RATES, SEC. 9-8-7. - IMPACT FEES IN ITS ENTIRETY, IMPOSING WATER AND WASTEWATER IMPACT FEES FOR FINANCING CAPITAL IMPROVEMENTS IN THE CITY OF WEATHERFORD, TEXAS; PROVIDING THAT ALL ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT THAT THEY ARE IN CONFLICT; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Reappointed Lindsey Hester to the Municipal Utility Board. Appointed Mary Ann Williamson and Eric Peterson to the Planning and Zoning Commission. Approved an Interlocal Agreement for cooperative purchasing between the City of Weatherford and Granbury Independent School District. Approved the US 180 Green Ribbon Design Supplemental Agreement. Approved a final plat for The Back 4 Phase 2 subdivision, being a 3.721 acre tract of land at the southeast corner of West Owens Street and Park Court, City of Weatherford, Parker County, Texas, SBD2021-0074, on recommendation of the Planning and Zoning Commission, subject to all the requirements of the subdivision ordinance and, specifically, the following conditions: 1. Dimension all existing right-of-way dedication. WMC 11-5-2(m) 2. Public improvements are required to be accepted before the final plat is recorded. A subdivision improvement agreement and surety is required to record the plat prior to acceptance of public improvements. WMC 11-5-9(c)(1-2). Approved a preliminary plat for Estancia, 50 residential lots being 65.910 acres situated within the William V.D. Shirley Survey, Abstract No. 1189, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas, SBD2021-0080, on recommendation of the Planning and Zoning Commission, subject to all requirements of the subdivision ordinance and the following conditions which must be met prior to approval: 1. Streets, showing the location, width, and names thereof, and showing the relationship of all streets to any projected streets shown on any development plan adopted by the City. WMC §11-4-4(b) 2. Location of centralized mail collection - to be considered for dedication to public use, or to be reserved by deed or covenant for the use of all property owners in the subdivision, and any conditions of such dedication or reservation. WMC §11-4-4(d) 3. Provide Supporting Documents: Proposed deed restrictions. WMC §11-4-6(c) 4. Approval Blocks for County Commissioner/Judges are not applicable and should be removed. 5. Metes and Bounds description(s) are missing on North Property Boundary on the proposed conditions sheet. Approved a final plat for Estancia, 50 residential lots being 65.910 acres situated within the William V.D. Shirley Survey, Abstract No. 1189, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas, SBD2021-0077, on recommendation of the Planning and Zoning Commission, subject to all requirements of the subdivision ordinance, and the following conditions which must be met prior to certification and filing: 1. The north property lines are missing bearings and total distances on the map. WMC §11-5- 2(k) 2. If the proposed roadways are to be private, they should be considered a lot. WMC §11-5-2(l) Provide a lot number and area for the streets. 3. There is what is assumed to be an easement on Lots 30 and 31 that is not labeled. WMC §11-5-2(m) 4. Include a note on the plat stating that all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat. WMC §11-5-2(m) 5. Water line/D&U easements on Lot 17/18 are inconsistent in location with preliminary plat. 6. Show location of proposed cluster box units (CBUs) for centralized mail collection. A signed letter from the Weatherford Post Office stating that they accept the proposed location and placement of CBUs. WMC §11-5-3(e) 7. Remove County Judge/Commissioners signature block and replace with the following certificates, or a substantially similar certificate for each: a. P&Z Signature Block - WMC §11-5-2(q)(3) b. CC Signature Block - WMC §11-5-2(q)(4). Approved a final plat for Lewis Farm, 1 residential lot being 11.016 acres situated within the T. BROWN SURVEY, ABSTRACT No. 133, and the T. ROLSON SURVEY, ABSTACT No. 1131, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas, SBD2021-0070, on recommendation of the Planning and Zoning Commission, subject to all requirements of the subdivision ordinance, and the following conditions which must be met prior to certification and filing: 1. Update Title block to reference FINAL plat. WMC §11-5-2(h) (1) 2. Remove old lot lines from the plat. Approved a final plat for Allison Hollow, 2 residential lots being 5.017 acres situated within the J.P. Hart Survey, Abstract No. 592, in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas, SBD2021-0075, on recommendation of the Planning and Zoning Commission, subject to all requirements of the subdivision ordinance, and the following conditions which must be met prior to certification and filing: 1. Remove physical feature of the land from the plat. WMC §11-5-2 2. Include a vicinity map on the plat. WMC §11-5-2(g) 3. Show the limits of the Tin Top Road right-of-way. WMC §11-5- 2(m) 4. Update title block description to FINAL plat. WMC 11-5-2(h)(1).
Consider approval of Resolution R2021-23 casting the City's votes for the Parker County Appraisal District Board of Directors (PCAD). City Manager James Hotopp presented this item. The City of Weatherford has 245 votes. Historically, the City of Weatherford has cast its votes alongside Weatherford Independent School District (WISD) as the City does not have enough votes to elect any board member on its own. WISD cast its 1,190 votes for Jerry Durant and John Hinton. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to approve Resolution R2021-23 casting 123 votes for Jerry Durant and 122 votes for John Hinton. Motion carried 5 - 0.
Notification of Funding Award for Town Creek Hike and Bike Trail Phase III Civil Engineer Chad Marbut presented this report, which was for informational purposes only. The City has a 20 percent match which totals over $200,000. A Texas Department of Transportation Advanced Funding Agreement will be brought before Council at a future meeting. No action was required or taken. Review funds received from the Cares Act and the American Rescue Plan Act. Assistant City Manager Brad Burnett presented this item, which was for informational purposes only. The City has received two rounds of Coronavirus Aid, Relief, and Economic Security (CARES) Act funding. The first round was used to provide utility assistance to our customers negatively affected by COVID. The second round of funding has no limitations on how the funds need to be spent and is currently available. The American Rescue Plan Act (ARPA) is an entitlement grant with strict spending guidelines. We received half of the funding this summer and will receive the other half next summer. We currently have $5,331,197 available to spend and will receive an additional $4,156,238 next summer. Staff has considered several projects and has narrowed them down to radio system upgrades and a new fire station.
Future agenda items: City Manager James Hotopp stated that if Council is supportive of the proposed uses for the CARES and ARPA dollars, staff will bring a radio communications contract forward at the December meeting.
