Proclamation supporting the Weatherford College Lady Coyotes and Coach Bob McKinley. Mayor Hooks presented the proclamation to Coach Bob McKinley and the Weatherford College Lady Coyotes.
Hold a PUBLIC HEARING and discuss and consider approval of Ordinance 607-2013-01 amending TITLE XII "ZONING" of the City Code of Weatherford by amending Section 12-5- 8 regarding garage sales. Craig Farmer, Director of Planning and Development, presented this item to the Council. This amendment incorporates language from the previous ordinance. Staff recommends no permit and no fee. This will be based upon complaints and as noted by Code Enforcement staff. Two per year is the limit. Additional language is included for block garage sales regarding the need for a special event permit. Mayor Hooks opened the Public Hearing at 6:37 p.m. As there were no speakers, Mayor Hooks closed the Public Hearing at 6:37 p.m. On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to approve Ordinance 607-2013-01 amending section 12-5-8 of the Code. Hold a PUBLIC HEARING and discuss and consider approval of Ordinance 608-2013-02 approving a Zoning Amendment for a Conditional Use Permit for property zoned C1 Commercial, located at 1913 Fort Worth Highway, City of Weatherford, Parker County, Texas. Mr. Farmer presented this item. The subject property is located at 1913 Fort Worth Highway and is zoned C1 commercial. The request was initiated by applicant Robert Dollak on behalf of James Wood Motors for an anticipated automobile sales lot. The property is platted and has utilities in place. According to the City's Future Land Use Map, the subject property has been designated Commercial and the request is consistent with the plan. The request is compatible with the surrounding zoning districts and existing land uses. A common access driveway will be located between the subject property and Dollar General. The applicant will plant trees and has a retaining wall, as well as areas for visitor parking. The request requires a conditional use permit with conditions as shown on the site plan included in the Ordinance. The Planning and Zoning Board voted 6 - 0 to approve this request. Discuss and consider a request for approval of a Master Plat for Silverstone subdivision, for property located at 905 Meadowview Road, City of Weatherford, Parker County, Texas. Craig Farmer presented this item. The request is to consider approval of a Master Plat of the Silverstone subdivision located at 905 Meadowview Road. The request was initiated by Parker Pearson, LP. According to the City's Future Land Use Map, the subject property has been designated Medium Density Residential; this request is consistent with the Future Land Use Plan. The request is compatible with the surrounding zoning districts and existing land uses. The current phases of this project have deviated from the original master plat to accommodate changes in the market. Staff has requested that the applicant update the master plat to reflect current and future plans. The applicant is requesting that the curvilinear street calculations be applied to the entire project as shown and not to individual phases. This item was reviewed by the Planning and Zoning Board on February 13, 2013. Discuss and consider a request for approval of a Preliminary Plat for Silverstone Phase 4, for property located at 905 Meadowview Road, City of Weatherford, Parker County, Texas. Craig Farmer presented this item. The request is to consider approval of a Preliminary Plat for Silverstone subdivision, Phase 4 located at 905 Meadowview Road. The request was initiated by Barron Stark Consulting. Approximately 30 lots are in development. Mr. Farmer noted that there is a slight drainage issue. According to the City’s Future Land Use Map, the subject property has been designated Medium Density Residential. This request is consistent with the Future Land Use Plan. The request is compatible with the surrounding zoning districts and existing land uses. Staff has identified a number of minor items that will need to be addressed before submittal of the final plat including: Provide cost estimates for all public improvements; Correct legal description or boundary description near the southwest portion of the property to be consistent with each other; Meet curvilinear street design requirements. Discuss and consider approval of Ordinance 609-2013-03 approving a Municipal Code Amendment to allow chickens inside the city limits. Sharon Hayes, Assistant City Manager, presented this item to the Council stating that section 6-2-14 of the City Code prohibits all fowl in the City except where properties are zoned AG Agriculture. Staff has received inquiries about the City's requirements for chickens. Animal Control Officers report an increase in stray chickens. In researching the topic, staff has noted that other cities and other parts of the country are supporting what is referred to as the "urban chicken movement." The goal of the amendment is to allow chickens without creating a nuisance. It prohibits roosters. No more than four hens will be allowed on any one property. No chickens will be allowed on multi- family property. The intent is to make sure there are no noise or odor nuisances. Amending this ordinance would allow owners to have organic chicken eggs. The Council discussed concerns about the Code Compliance and Animal Control departments already being taxed. This amendment does not involve the Code Enforcement division and will be handled strictly by complaint. Council was concerned about the ability to enforce the ordinance. Discuss and consider giving staff permission to seek grant funds from the Texas State Library and Archives Commission (TSLAC) through an Impact grant. The focus of Impact grants is to support library services that enhance library patrons' access to electronic information. Our request is to fund a pilot project that would supply popular magazines in electronic, downloadable format. The project would include the Weatherford, Azle, Aledo, Springtown and Millsap libraries (members of the Parker County Library Association (PCLA)). Dale Fleeger, Director of Library Services, presented this item to the Council. The Library has the opportunity to apply for a one-year Impact Grant. The focus would be to conduct a pilot project to offer downloadable magazines to Library patrons. Staff would review how they are used and whether this is something that should continue in subsequent years. Currently, the Library offers 170 periodicals including some for children and young adults. It is proposed to offer some of them in both electronic copy and print copy and to compare the usage data. On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to permit staff to seek grant funds from the TSLAC through an Impact grant. Motion carried 5 - 0.
Discuss and consider adoption of Resolution R2013-03 to use Storm Water Utility Funds to repay the General Fund. Terry Hughes, Director of Capital Transportation Projects, presented this item to the Council. Resolution R2013-03 resolves the Council's intent to utilize storm water utility funds to reimburse the general fund approximately $310,000 for the Holland Lake Creek watershed study, when sufficient storm water utility funds have been collected. This is expected to occur around October. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve Resolution R2013-03. Motion carried 5 - 0.
Discuss and consider authorizing the City Manager to execute a contract with Freese and Nichols, Inc. to perform the Holland Lake Creek watershed study. Terry Hughes also presented this item. Mr. Hughes spoke regarding Holland Lake and the two tributaries that feed into Holland Lake. He spoke about hydraulics, hydrology, geomorphology, and sedimentation. Five engineering firms were interviewed on January 21, 2013. The interview panel included James Hotopp, Danielle Felts, Howard McClurkin, Paul Paschall, and Terry Hughes. Sharon Hayes, Bill Smith, and Manny Palacios also attended the interviews. Each team member used weighted matrix to score each firm. In the end, all scores were tallied to finalize the rating. Freese and Nichols, Inc. received the highest rating. On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to authorize the City Manager to execute a contract with Freese and Nichols, Inc. to perform the Holland Lake Creek watershed study. Consider and/or act upon Resolution R2013-04 adopting the 2013 City of Weatherford Strategic Plan, Vision Statement, and City Council Mission Statement. CC 022613 Page 4 of 7 Chad Janicek, Director of Office of Budget and Management, presented this item to the Council. Since Council had no changes two weeks ago, staff is bringing back the resolution for approval. This plan will serve as a guideline during the budget discussion process. On the motion of Craig Swancy, second by Waymon Hamilton, the Council voted unanimously to approve Resolution R2013-04 adopting the 2013 Strategic Plan and the Vision and Mission Statements. Motion carried 5 - 0.
Mr. Janicek noted that Mr. Wieder will return to the Council with bound copies of the plan as soon as it is ready. Request applicants for boards, commissions, and committees and discuss and consider appointments and reappointments to the Building and Standards Commission, the Planning and Zoning Board, the Board of Adjustment, the Historic Preservation Commission, the Parks and Recreation Board, the Library Board, and the Animal Shelter Advisory Committee. The Council thanked all citizens for applying. On the motion of Heidi Wilder, second by Waymon Hamilton, the Council voted unanimously to appoint Marsha Brown to the Animal Shelter Advisory Committee. Motion carried 5 - 0.

On the motion of Waymon Hamilton, second by Heidi Wilder, the Council voted unanimously to appoint Kevin Cleveland and Patrick McGhee to the Building and Standards Commission, and to reappoint Billie Forbes to the Commission for her second full term. Motion carried 5 - 0.
On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to appoint Ron Chandler to the Historic Preservation Commission for his first full term. Motion carried 5 - 0.
On the motion of Waymon Hamilton, second by Heidi Wilder, the Council voted unanimously to appoint Justin Allison to the Library Board for his first full term effective 6/30/13 to fill Kathleen Wildwood's seat at the conclusion of her term. Motion carried 5 - 0.
On the motion of Waymon Hamilton, second by Heidi Wilder, the Council voted unanimously to reappoint Greg Shaw to the Parks Board for his first full term ending 5/31/15 and to appoint Michael Anderson and Thomas Moorman effective 5/31/13 filling the seats of Laura Anderson and Cathrine Redenbaugh at the conclusion of their terms. Monthly Management Report from the Director of Management and Budget, including the City's monthly financial report and a management highlight regarding the Transportation and Public Works Department and the Preliminary Summary of Street Maintenance Simulations. Chad Janicek, Director of Office of Management and Budget, presented this item to the Council. Mr. Janicek discussed the financials and the preliminary summary of street maintenance simulations. In 2013, Infrastructure Management Services (IMS) will update its initial pavement condition survey for the City. This new survey will be incorporated into the simulation model that was described tonight. The simulations will be re-run, and the results will be republished for consideration with the CC 022613 Page 5 of 7 Transportation and Public Works Department's FY14 budget request and future project list. No action was taken or required on this item. Update regarding mosquito control measures. Angel Rudolph, Consumer Health Inspector, provided this update to the Council. Staff recently met with Municipal Mosquito Company regarding various services they provide. Ms. Rudolph spoke about integrated pest management. Staff is developing a West Nile response plan for the City and will present it at the next Council meeting, along with cost estimates.
