Presentation of award for the Comprehensive Annual Financial Report (CAFR). Accounting Manager Sidney Kirk and GFOA Representative Janina Jewell presented this award to Mayor Swancy and the City Council. This is the 30th consecutive year that Weatherford has received this award. Recognition of Texas Amateur Athletic Federation's (TAAF) Regional City of the Year awarded to the City of Weatherford. Parks and Recreation Advisory Board Vice Chair Lexie Lee and Assistant Director of Parks, Recreation, and Special Events Jaycob Kirkpatrick presented this award to the Mayor and Council.
Consent agenda, approved as one vote (5-0, on the motion of Jeff Robinson, second by Kevin Cleveland): Approved the minutes of the City Council meeting held November 27, 2018. Approved an Interlocal Agreement with the North Central Texas Council of Governments (NCTCOG) and the City of Weatherford to help update the Parker County Hazard Mitigation Action Plan. Approved hiring the consultant firm of Quorum Architects, Inc. to develop architectural plans for the construction of the Animal Shelter's Master Plan. Approved the purchase of a BFX Fire Apparatus, Type 6 Brush Truck Wildland Engine. Ratified Ordinance 945-2018-60 approving a rate adjustment for Texas Gas Service as discussed and voted upon during the November 13, 2018 City Council meeting. The ordinance is captioned as follows: ORDINANCE 945-2018-60 AN ORDINANCE ESTABLISHING MAXIMUM RATES TO BE CHARGED FOR GAS SOLD TO CUSTOMERS BY TEXAS GAS SERVICE COMPANY, A DIVISION OF ONE GAS, INC., AN OKLAHOMA CORPORATION, IN THE CITY OF WEATHERFORD, TEXAS AND DECLARING THIS ORDINANCE TO BE A FINAL DETERMINATION OF RATES. Approved additional cost to BID 2019-007 (Cherry Park Pool Renovation) which was awarded by City Council on November 27, 2018 to include performance and maintenance bonds of $16,781 making the total cost of the project $1,328,086. Awarded fleet vehicle purchase to Holiday Chevrolet through the Tarrant County Cooperative competitive bid contract #2016-006 for two 2019 Chevrolet Tahoe Police package patrol vehicles for the amount of $65,125.16 and awarded fleet vehicle purchase to Sam Pack Five Star Ford through the Tarrant County Cooperative competitive bid contract #2019-014 for a 2019 Ford F250 XLT crew cab truck for the amount of $35,354.36. Total purchase price of vehicles is $100,479.52. Approved the purchase of furniture for Old City Hall from KI Furniture through Sourcewell, a cooperative purchasing organization, for an amount not to exceed $54,210.
Hold a PUBLIC HEARING and consider approval of Ordinance 946-2018-61 for a zoning district change from C-2 Commercial/Interstate to I Industrial for sales of outdoor equipment including heavy trucks at 1222 W Interstate 20 and described as being approximately 7 acres out of the Clarence A Lovejoy Survey, Abstract 837, City of Weatherford, Texas. ZCH2018-0029 Director of Development and Neighborhood Services Department Craig Farmer presented this item. The property is currently zoned C2. The applicant has requested I Industrial. The building needed several repairs and the applicant has not been able to sell it. The General Plan calls for ‘community commercial’ in the area. The Planning and Zoning Commission (PZC) approved the request by a vote of 5 - 2. Applicant Max Thompson, 1226 West Park Avenue, spoke about this project. He stated this will be a New Holland franchise selling tractors, trailers, lawnmowers, and possibly RVs. Mr. Thompson stated he has committed to putting stucco on the entire east side of the building. There will be glass on the east and south sides. Hold a PUBLIC HEARING and consider approval of Ordinance 947-2018-62 for a zoning district change from C-1 Commercial and AG Agricultural to C-1 Commercial with a Conditional Use Permit for an Eating Establishment/Restaurant (with Drive-Thru Service) at 2082 Mineral Wells Highway, described as being a 1.767 acre tract of land and a 0.486 acre tract of land out of the George Staggs Survey, Abstract 1196, City of Weatherford, Texas. ZCH2018-0034. Mr. Farmer presented this item as well. He stated that the convenience store and restaurant do not require a CUP but the drive-thru does. The PZC approved this request 7 - 0 at their last meeting. Mohamad Sharaf was called to speak. He stated the restaurant will be called Go Loco. They will sell street tacos and burritos. Mr. Sharaf presented design images from some of their other locations. He stated Go Loco was originally a joint venture between Victron and Blue Mesa Grill. This will be authentic Mexican cuisine and the brand is proud of the awards they have won. Hold a PUBLIC HEARING and consider approval of Ordinance 948-2018-63 for a zoning district change from C-1 Commercial to R-1 One-Family Residential at 109 N Alamo Street, described as being a portion of Lot 1, Block 42 of the Original Town of Weatherford, City of Weatherford, Texas. ZCH2018-0035. Mr. Farmer presented this item as well. This case is on Alamo Street north of Palo Pinto. The applicant has requested residential zoning. The General Plan shows both residential and commercial along that area. The rezoning to residential is requested for mortgage purposes. The PZC approved the request 7 - 0. Mayor Swancy opened the public hearing at 7:11 p.m. Realtor Frieda Schmiedel spoke on behalf of the buyer. She stated this property is to be used as a residence and it is listed in both the MLS and at the Parker County Appraisal District as residential. As there were no other speakers, Mayor Swancy closed the public hearing at 7:12 p.m. Council discussed the fact that the recent code amendment that was expected to solve some of the commercially zoned residential property issues did not work for the lender in this case. Mr. Farmer suggested a long-term review of some of the areas that were zoned commercial but may actually serve as residential. Hold a PUBLIC HEARING and consider approval of Ordinance 944-2018-59 Designating a Geographical Area within the City of Weatherford as a Tax Increment Reinvestment Zone Pursuant to Chapter 311 of the Texas Tax Code, to be known as Reinvestment Zone Number Two, City of Weatherford. On the motion of Curtis Tucker, second by Heidi Wilder, the Council voted unanimously to remove this item from the table. Motion carried 5 - 0.
Deputy City Manager James Hotopp stated that this is a continuation of a public hearing that originally began on November 27th. This item is for the creation of TIRZ No. 2 which spans 1,845 acres and is for a 30-year term. The proposed ordinance appoints the initial board of directors who is charged with developing the final project and finance plan. Mr. Hotopp stated that the public hearing on November 27th was tabled and continued strictly for the preliminary project and finance plan, which is now available. Mr. Hotopp also mention that wo owners had requested removal from the TIRZ 2 boundary and that those letters were provided to the Council at the November 27th meeting. The City’s consultant Trent Petty with Petty and Associates spoke about the TIRZ. He stated that the TIRZ may not issue bonds, the TIRZ may not exercise eminent domain; and the TIRZ may not assess new taxes. There is no negative impact to residential property located within the TIRZ. There is no requirement that the TIRZ fund 100 percent of the proposed projects. Mr. Petty stated it is still unknown if any of the other taxing entities will participate. The preliminary plan has been developed with very conservative estimates, from the City being the only participating entity, to all the entities participating. Consider approval of Ordinance 949-2018-64 Which amends Ordinance 928-2018-43 as it pertains to urban chickens within the City of Weatherford. City Manager Sharon Hayes presented this item. She stated that, at the last meeting, the Council appointed Kevin Cleveland and Jeff Robinson to work with two representatives of the initiating committee. The negotiating committee met last week and agreed on a compromise. The proposed changes included in the ordinance relate to: 1) distance and setbacks 2) number of hens 3) variance option if the agreed-upon distance/setback is problematic for a resident The variance/waiver is open and could allow for students who wish to have chickens as a 4-H or FFA project. On the motion of Curtis Tucker, second by Kevin Cleveland, the Council voted unanimously to approve the new compromise ordinance 949-2018-64. Motion carried 5 - 0.
Consider approval of Ordinance 931-2018-46 for a zoning change for property currently zoned AG Agriculture to I Industrial with a Conditional Use Permit for a Transfer Station for property located at 3306 Old Brock Road and described as being an approximate 14.638 acre tract of land in the I.C. Spence Survey, Abstract 1193 and the S.F. Jones Survey, Abstract 748, City of Weatherford, Parker County, Texas. ZCH2018-0022. On the motion of Curtis Tucker, second by Heidi Wilder, the Council voted unanimously to remove this item from the table. Motion carried 5 - 0.
Assistant City Manager Brad Burnett presented this update. Mr. Burnett stated that he and Mr. Deel made a non-scheduled visit to the Waste Connection Transfer Station in Shreveport, Louisiana on November 21st. This facility has been in operation for approximately three months. It is a two-sided building with the same dimensions as those proposed for the Weatherford Transfer Station. This building is approximately 200 feet from the roadway; the building proposed for Weatherford is over 300 feet from the roadway. The Shreveport facility had minor landscaping. Staff did not observe any issues with smell or wind-blown debris. Staff did not observe the facility in the dark and could not comment regarding light pollution. Staff did not observe any noise issues. The site was not visually impressive. Crews stated that they maintained the property and picked up wind-blown trash regularly. The facility currently receives 400 tons daily and the proposed for Weatherford is approximately 800 tons daily. Mr. Burnett provided images of the facility. He noted that the facility is in an industrial area with no close residential properties. Mr. Burnett and Mr. Deel met with three neighboring businesses, none of which had any issues with odor, trash, or traffic. Consider acceptance of the 2nd Quarter Investment Report. This item was tabled on September 25, 2018. On the motion of Heidi Wilder, second by Curtis Tucker, the Council voted unanimously to remove this item from the table. Motion carried 5 - 0.
This item was considered in conjunction with item 6d Consider acceptance of the 3rd Quarter Investment Report, which was removed from this meeting’s Consent Agenda for separate consideration. Kyle Lester, Director of Finance, presented these items. He provided a comparison of the second and third quarters. He spoke about national unemployment, economic outlook, the City’s current portfolio, the WAM, the portfolio performance, comparison of City yields, diversification, and maturities. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to accept both the second and third quarter reports. Motion carried 5 - 0.
Discuss and consider the appointment of a City Council Member to the Audit Committee. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to appoint Curtis Tucker to the Audit Committee. Motion carried 5 - 0.
Report regarding public communication methods and efforts with regard to Council and Board agendas and meetings. City Manager Sharon Hayes presented this report. City Secretary Malinda Nowell provided information about Civic Plus, the City’s website, and the agenda subscription lists which are available for residents to subscribe to. Director of Communications and Marketing Blake Rexroat spoke about other communication avenues including Blackboard, the MyWeatherford mobile app, Facebook, Next Door, and Melt Water. Director of Development and Neighborhood Services Craig Farmer spoke about development notifications, the processes and additional options. Development and Neighborhood Services Department will send an extra notice letter on 'controversial' cases, as well as communicate with persons that fill out speaker cards at PZC and Council meetings.
