Consent agenda, approved as one vote: 6.a: Consider the reappointment of Howard McClurkin to the Municipal Utility Board; and the reappointment of Paul Paschall to TIRZ Boards #1 and #2; and the appointment of Zack Smith to TIRZ Boards #1 and #2. On the motion of Heidi Wilder, second by Matt Ticzkus, the City Council approved the reappointment of Howard McClurkin to the Municipal Utility Board, the reappointment of Paul Paschall to TIRZ Boards #1 and #2; and the appointment of Zack Smith to TIRZ Boards #1 and #2. The motion carried 4 - 0. Council Member Zack Smith recused himself from the vote. On the motion of Kevin Cleveland, second by Heidi Wilder, the City Council voted unanimously to approve the following Consent Agenda Items 6.b. through 6.j. The motion carried 5 - 0. 6.b: Adopted Ordinance O2023-50, on first and final reading, amending portions of Title X Motor Vehicles and Traffic, Chapter 4 Parking Regulations, Section 10- 4-21 Prohibited Parking of the City of Weatherford to include an all-time No Parking Zone along the 100 Block of West Spring Street. 6.c: Approved a request for final plat approval for PMJK Addition, being 4 residential lots on a 3.718-acre tract, generally located at 1701 East Bankhead and situated in Abstract No. 906, City of Weatherford, Parker County, Texas. SBD2023-0048. 6.d: Authorized the purchase of furniture for Weatherford City Hall from GL Seaman & Company under Omnia Cooperative Purchasing Program for an amount not to exceed $68,394.23. 6.e: Approved/authorized the purchase of hardware and software from SHI Government Solutions using applicable cooperative agreements and state bid contracts in an amount not to exceed $130,000.00. (Total expenditure amount with SHI, inclusive of previous approvals, not to exceed $326,833.29). 6.f: Authorized the procurement of waste disposal services through Waste Connections, Inc., in an amount not to exceed $280,000.00. 6.g: Approved the purchase of emergency vehicle equipment and upfitting for six patrol units from D&M Leasing dba Commercial Vehicle Leasing LLC through the Texas BuyBoard Cooperative Purchasing contract 652-21 for $172,958.51. 6.h: Authorized the City Manager to execute a contract with Graham Associates, Inc. for professional engineering services related to Texas Department of Transportation Project CSJ 0314-07-070, Interstate 20 Ramps, in the amount of $165,650.00. 6.i: Authorized the purchase of network hardware and support from Maverick Computer Supplies in the amount of $59,186.31 using the Texas DIR Contract (TX DIR-TSO-4288). 6.j: Canceled the purchase order with USA Shade and authorized Victory Awning to construct and install shade structures for the pickleball complex located at Love Street Park in the amount of $407,850.00 utilizing BuyBoard purchasing contract #637-21.

7.a: Consider authorizing the City Manager to execute a Shared Parking Agreement between the City of Weatherford and First Baptist Church. Director of Development & Neighborhood Services Kaleb Kentner presented Item 7.a. and Item 7.b. together regarding a shared parking agreement with First Baptist Church; and closing, vacating, and abandoning a portion of West Church Street. On the motion of Matt Ticzkus, second by Zack Smith, the City Council voted unanimously to authorize the City Manager to execute a Shared Parking Agreement between the City of Weatherford and First Baptist Church. The motion carried 5 - 0.

7.b: Hold a PUBLIC HEARING and consider adoption of Ordinance O2023-49 closing, vacating, and abandoning a portion of West Church Street (a 50-foot public right-of-way) being a portion of land in the Parker County School Land Survey, Abstract No. 1071, and being in the Original Town of Weatherford Plat, City of Weatherford, Parker County, Texas. Mayor Pascall opened the Public Hearing at 6:14 p.m. As there were no speakers, Mayor Paschall closed the Public Hearing at 6:14 p.m. On the motion of Matt Ticzkus, second by Zack Smith, the City Council voted unanimously to approve Ordinance O2023-49 closing, vacating, and abandoning a portion of West Church Street. 7.c: Consider approval of a Chapter 380 Economic Development Agreement with Downtown Weatherford Square Initiative ("DWSI") for a one-year term beginning October 1, 2023 in the amount of $150,000.00. Assistant City Manager Brad Burnett presented this item regarding a Chapter 380 Economic Development Agreement with Downtown Weatherford Square Initiative. The City Council discussed and expressed their thoughts, support, and concerns regarding the agreement with Downtown Weatherford Square Initiative (DWSI). • Bill Warren, 605 S. Waco, expressed his concerns with the agreement. • Lynn Baber, 2126 Timber Cove Ct., expressed her concerns with the agreement. On the motion of Kevin Cleveland, second by Matt Ticzkus, the City Council voted to approve a Chapter 380 Economic Development Agreement with Downtown Weatherford Square Initiative in the amount of $150,000.00 for a one-year term beginning October 1, 2023. The motion carried 3 - 2.

7.d: Hold a PUBLIC HEARING and consider the adoption of Resolution R2023-24 adopting a Tax Abatement for the City of Weatherford, Texas and electing to become eligible to participate in tax abatement. Assistant City Manager Brad Burnett presented this item regarding the adoption of a Tax Abatement Policy. Mayor Pascall opened the Public Hearing at 6:57 p.m. As there were no speakers, Mayor Paschall closed the Public Hearing at 6:57 p.m. On the motion of Kevin Cleveland, second by Matt Ticzkus, the City Council voted unanimously to approve Resolution R2023-24 adopting a tax abatement policy and electing to become eligible to participate in tax abatement. 7.e: Consider adoption of Resolution R2023-25 authorizing a variance for the sale of alcohol at 1222 Fort Worth Highway, Suite A, a location less than 300 feet, along the property lines of the street fronts and from front door to front door, from Victory Baptist Church. City Manager James Hotopp presented this item and explained the local ordinance distance requirements related to alcohol sales and churches in the City of Weatherford and the process provided by the ordinance to request a variance from the distance requirements. • Rob Catuto, Senior Pastor Victory Baptist Church, 1649 Silverstone Dr., spoke in opposition of the variance request. • Nathan Thomas, Applicant, 11808 River View Way, spoke regarding his variance request. On the motion of Matt Ticzkus, second by Heidi Wilder, the Council voted unanimously to deny Resolution R2023-25 authorizing a variance for the sale of alcohol at 1222 Fort Worth Highway, Suite A. On the motion of Kevin Cleveland, second by Zack Smith, the City Council voted unanimously to approve the preliminary plat for Sapphire Addition subject to all requirements of the subdivision ordinance and, specifically, the following conditions: 1. Fielder and South Main Street, generally located at 2551 South Main Street and being situated in Abstract No. 785, 1792, 2019, 2057, and all of Lots 1-3 of the Causbie Addition, City of Weatherford, Parker County, Texas. SBD2023-0047. Director of Development & Neighborhood Services Kaleb Kentner presented this item and explained that it was directly related to the previous item, 7.r. He added that due to state platting requirements, the Planning and Zoning Commission recommended denial of this preliminary plat request; however, the applicant would have the ability to reapply. On the motion of Heidi Wilder, second by Matt Ticzkus, the City Council voted unanimously to deny the request for a preliminary plat approval for QuikTrip 1948 Addition, at 2551 South Main Street, without prejudice. The motion carried 5 - 0.

Future agenda items: Council Member Kevin Cleveland requested a residential density update at a future City Council Meeting in February 2024.
