Recognition ceremony naming the City of Weatherford as a National Weather Service StormReady Community. Emergency Management Coordinator Cody Mulloy introduced Mark Fox, Warning Coordination Meteorologist for the National Weather Service in Fort Worth. He stated that the City is a storm ready recognized jurisdiction and that Weatherford is above and beyond other jurisdictions. He presented a storm ready sign that is TxDOT approved and also presented a recognition plaque to Mr. Mulloy for his work in this area.

Consent agenda, approved as one vote (4-0, on the motion of Heidi Wilder, second by Dale Fleeger): Approved the minutes of the City Council meeting held June 13, 2017. Reappointed Matt Anderson, Vance Barton, and Jenni Day to the Animal Shelter Advisory Committee; and reappointed Susan Cochran to the Library Board; and reappointed Clark Cofer, Chris Daniels, and Hayden Harbold to the Transportation Advisory Board. Appointed Courtney Butler to the Library Board in one of two vacant, advisory, non-voting positions as authorized by section 2-4-2 of the Code of Ordinances. Approved Ordinance 848-2017-32 amending the FY17 Adopted General City Budget. Awarded purchase to Freightliner of Austin through the competitively bid Buy Board contract for purchase of one 2017 Solid Waste Brush Truck for an amount not to exceed $196,816. Consider and/or act upon approval of Ordinance 847-2017-31 approving the Texas Gas Service Company 2017 Cost of Service Adjustment. This item was removed from the Consent Agenda for separate consideration. Councilmember Wilder thanked Texas Gas representatives for working with her to determine a reasonable Cost of Service Adjustment (COSA) for the City. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted to approve this item. Motion carried 4 - 0. The Ordinance is captioned as follows: ORDINANCE NO. 847-2017-31 AN ORDINANCE OF THE CITY OF WEATHERFORD, TEXAS APPROVING THE 2017 COST OF SERVICE ADJUSTMENT FILING RATES, TARIFFS, AND CHARGES OF TEXAS GAS SERVICE COMPANY, A DIVISION OF ONE GAS, INC. FOR NATURAL GAS SERVICE WITHIN THE CITY OF WEATHERFORD, TEXAS AND DECLARING THIS ORDINANCE TO BE A FINAL DETERMINATION OF RATES.

Hold a PUBLIC HEARING and consider approval of Ordinance 849-2017-33 a request for a Zoning Change for property zoned AG Agricultural to be rezoned R1 One-family Residential for property located at 1508 Old Dicey Rd and being an approximate 9.23 acre tract of land predominately in the Sarah Monk Survey, Abstract No. 906, City of Weatherford, Texas. ZCH2017-0014 Stan Hamrick, City Planner, presented this item. This development is not Fox Hollow Subdivision, but is basically a continuation of it. The applicant proposes approximately 38 lots that will be a similar size, configuration, and product as what is seen in the Fox Hollow Subdivision. Water and sewer are generally available in the area. Mayor Swancy opened the Public Hearing at 6:39 p.m. As there were no speakers, Mayor Swancy closed the Hearing at 6:39 p.m. On the motion of Dale Fleeger, second by Heidi Wilder, the Council voted to approve this rezoning. Motion carried 4 - 0.

Hold a PUBLIC HEARING and consider a request for a zoning district change for property zoned R1 One-Family Residential to a R1 One-Family Residential with a Conditional Use Permit (CUP) for an Accessory to a Residential Structure (greater than 400 square feet) for property located at 3501 Cliff View Loop, also described as Lot 18, Block 10 of the Lake Hills Addition Phase 1, Section 2, City of Weatherford, Parker County, Texas. ZCH2017-0015 Mr. Hamrick presented this item as well. This property is southwest of Lake Weatherford in an established neighborhood. While in the process of working two code enforcement complaints, staff discovered an accessory building in the back that had been built without permits. It was a residential accessory structure used as an apartment for the applicant's mother who has since passed away. The applicant has requested to have and maintain the structure as a proposed photography studio and has submitted a building permit application. The CUP is required due to the size of the structure. If Council approves the CUP, then the building permit process will be completed and, at that point, it will be a legal structure. When the Public Hearing was held at the Planning and Zoning Commission (PZC), the Commission denied the request by a vote of 6-0. Consider a request to Preliminary Plat the Pearson Ranch Estates, located along the north side Pearson Ranch Road off Hwy. 730 just northeast of Lake Weatherford more generally described as being approximately 21.71 acres of land situated in the Solomon Frazier Survey, Abstract No. 466, Extra- Territorial Jurisdiction, Parker County, Texas. The request includes a waiver from the requirements to connect to city water and sanitary sewer. SBD2017-0023 Mr. Hamrick presented this item as well. This property is located on the northeast side of the City's ETJ. The property is a long way from any City utilities, hence the waiver request from City water and sewer. All the lots have existing frontage on Pearson Ranch Road. All lots are two acres or larger. The largest lot has an existing house on it. The applicant has provided the additional right-of-way dedications along Pearson Ranch Road and on the eastern side for a future collector street. This is presented as a Preliminary Plat because it has more than the number of lots typically allowed for a Minor Plat. A Final Plat will follow. It is a straight forward plat with no public improvements. On the motion of Dale Fleeger, second by Kevin Cleveland, the Council voted to approve the request. Motion carried 4 - 0.

Consider a request to Master Plat property located at 1609 Old Dicey Road, more generally described as being an approximately 21.13 acres, in the Desideno De La Cruz Survey, Abstract No. 223, City of Weatherford, Parker County, Texas. SBD2017-0025 Mr. Hamrick presented this Master Plat request. The subject property is on the north side of Dicey Road. Mr. Hamrick provided an image of the lot configuration that is being proposed. Since this is just the Master Plat, not a lot of detailed engineering has been conducted at this point. The development will have City water and sewer to the entire site. This is a long road that has the main entrance, a stub out to the west, and property for a stub out to the vacant property on the north. This development cannot connect to existing neighborhoods on the east and west because those neighborhoods are already fully developed. The applicant has proposed two drainage areas. The proposed development is under the threshold of 30 residences and therefore does not require a second way in/out. A follow up zoning case to change the zoning from AG Agriculture to RE Residential Estate, is forthcoming. The plat includes a 50 foot right-of-way for a full road in the future. Consider a Minor Plat for the Trailwood Addition, Lots 1 and 2, Block 1. The property is a 2.64 acre tract of land in the M. A. Simmon Survey, Abstract No. 2261, located along Trailwood Drive within the ETJ. SBD2017-0029 Mr. Hamrick presented this item as well. The plat was withdrawn previously so that the applicant could provide more information. The original owner had sold a portion of the property. The property had a well and a septic system; however, due to an issue with recordkeeping, it was uncertain where those were located. Documents have been provided now so that staff could ensure the property line was not drawn over any of those systems. Everything is complete now and the systems are permitted. On the motion of Kevin Cleveland, second by Heidi Wilder, the Council voted to approve this item. Motion carried 4 - 0.

Consider and/or act upon approval of Resolution R2017-16 to establish an economic development incentive policy. Deputy City Manager James Hotopp presented this item. The previous policy was adopted in 2015 pursuant to Chapter 312.002 of the Texas Tax Code and expired in March 2017. Since the City Council and Economic Development Board periodically receive requests for economic development incentives from various businesses, staff has worked with a consultant to develop a new incentive policy. The policy lays out several incentive programs staff could use to attract, retain and expand businesses. The policy gives Council final approval for economic incentive programs and may apply broad discretion as to project eligibility, amount of incentive, and qualification parameters. Upon approval and adoption, the Guidelines and Criteria for Economic Development Incentives will be established for the two (2) year period ending June 2019. Approval only gives the City the opportunity to consider such actions as economic development tools. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted to approve this item. Motion carried 4 - 0.
