Proclamation naming November 2022 as Home Care and Hospice Month in the City of Weatherford. Council Member Jeff Robinson presented this proclamation to Terri Smith of Interim Healthcare and to Don Webster of Beyond Faith Homecare.

Consent agenda, approved as one vote (5-0, on the motion of Kevin Cleveland, second by Jeff Robinson): Approved the minutes of the City Council Regular and Executive Sessions held October 25, 2022. Adopted Ordinance O2022-44, on first and final reading, amending Section 9-11-1 "General Regulations" of Chapter 11, “Public Parks,” of Title IX, “Public Ways and Property” of the Code of Ordinances prohibiting the use of Class 2 and Class 3 Electric Bicycles (E-Bikes) in public parks and city trails; repealing all ordinances or parts of ordinances in conflict; providing a severability clause; providing a savings clause; providing for inclusion in the Code; finding and determining that the meeting at which this ordinance is passed is open to the public as required by law; providing for an effective date and publication; and providing penalties. Authorized the City Manager to renew the support contract of Azteca Systems, LLC for the City Works system in the amount of $57,000.00. Authorized the City Manager to renew the support contract with Tyler Technologies for the Munis software system in the amount of $85,153.78. Approved the purchase of one 2023 Ford F550 Super Cab 4X4 brush truck in an amount not to exceed $205,140 from Rockdale Country Ford, through the Texas Buy Board Cooperative bid contract #601-19. Approved the purchase of one 2022 Dodge RAM 2500 Tradesman Pickup Truck in an amount not to exceed $55,410 from Blue Ribbon Auto Group. Approved the purchase of one fully equipped Pierce Custom Enforcer Pumper, 2nd Generation, build number 859, through HGAC Buy Board FS12-19 (Fire), in an amount not to exceed $994,054 from Siddons-Martin Emergency Group. Accepted the FY22 4th Quarter Investment Report for quarter ended September 30, 2022. Approved a preliminary plat for West Oak Estates, six lots being 4.056 acres located at southeast corner of West Spring Street and North Bowie Drive, City of Weatherford, Parker County, Texas, SBD2022-0058, on recommendation of the Planning and Zoning Commission (PZC), subject to all requirements of the subdivision ordinance and specifically the following conditions: 1. Show building setback lines and dimensions on the proposed conditions sheet (Reference Weatherford Municipal Code (WMC) §11-4-4(f)). 2. Provide an exhibit showing areas contributing drainage to the proposed subdivision. The information shall include the area, slope, and type of development in the contributing area (Reference Weatherford Municipal Code (WMC) §11-4-4(h)). 3. Show existing utilities, such as the wastewater line, on the property on the existing conditions sheet (Reference Weatherford Municipal Code (WMC) §11-4-5(c)). 4. Provide a statement of improvements that will be installed and a timeline when such improvements will be completed (Reference Weatherford Municipal Code (WMC) §11-4- 6(d)). 5. Perimeter street improvements are required along adjacent streets (Reference Engineering Design and Construction Manual (EDCM) §2.1.7). 6. A downstream drainage analysis is required to be submitted before the final plat is approved (Reference Engineering Design and Construction Manual (EDCM) §3.6). Any adverse effects are required to be mitigated. 7. Due to the need for services to be installed for the proposed lots, pavement repair will be required. North Bowie Street will need to be resurfaced within this block prior to approval of the final plat. 8. Provide a 10' utility easement along all road frontage for all properties. Approved a final plat for West Oak Estates, six lots being 4.056 acres located at southeast corner of West Spring Street and North Bowie Drive, City of Weatherford, Parker County, Texas. SBD2022-0059, on recommendation of the PZC, subject to all requirements of the subdivision ordinance and specifically the following conditions: 1. An approved preliminary plat is required before the final plat can be approved (Reference Weatherford Municipal Code (WMC) §11-5-4(b)). 2. The north section of right-of-way dedication along North Bowie Drive is difficult to see. Provide additional details for clarity. 3. Perimeter street improvements (curb, gutter, and sidewalks) are required along adjacent streets (Reference Engineering Design and Construction Manual (EDCM) §2.1.7). 4. A downstream drainage analysis is required to be submitted before the final plat is approved (Reference Engineering Design and Construction Manual (EDCM) §3.6). Any adverse effects are required to be mitigated. 5. Provide required water services, wastewater services and associated pavement repairs (Reference Engineering Design and Construction Manual (EDCM) §4.4, Standard Detail S2.3). 6. Provide a 10' utility easement along all road frontage for all properties. 7. Private Access easement shall be constructed with concrete prior to issuance of Certificate of Occupancy. Approved a final plat for Brackett Addition, three lots being 0.821 acres located at southeast corner of Narrow Street and North Mill Street, City of Weatherford, Parker County, Texas, SBD2022-0060, on recommendation of the PZC subject to all requirements of the subdivision ordinance and specifically the following conditions: 1. Perimeter street improvements (curb and gutter) are required along adjacent streets before the plat is approved (Reference Engineering Design and Construction Manual (EDCM) §2.1.7). An asphalt tie-in between existing pavement and new curb and gutter is also required. 2. Sidewalks will be required when building permits are submitted if they are not constructed with the curb and gutter improvements. 3. Since the adjacent roadway is less than 5 years old, services for each lot will need to be provided before the plat is approved. Pavement repair shall be in accordance with City detail S2.3. 4. Provide a 10' utility easement along all road frontage for all properties. Approved a final plat for Hooper Lee Lane, two lots being 9.423 acres located at 291 Lee Lane, in the extraterritorial jurisdiction (ETJ) of the City of Weatherford, Parker County, Texas, SBD2022-0061, on recommendation of the PZC subject to all requirements of the subdivision ordinance and specifically the following conditions: 1. Remove old lot lines from the plat (WMC) §11-5-2. 2. Show and dimension the right-of-way limits of Lee Lane (WMC) §11-5-2(m). 3. Show the right-of-way centerline of Lee Lane (WMC) §11-5-2(m). 4. Include a note on the plat stating all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat (WMC) §11-5-2(m). 5. If the existing Lee Lane right-of-way is less than 60', dedication will be required (WMC) §11-6-2(c). 6. Documents released by a Registered Professional Land Surveyor are required to have a seal and signature or the following statement: "Preliminary, this document shall not be recorded for any purpose and shall not be used or viewed or relied upon as a final survey document" (Texas Administrative Code Title 22, Chapter 663.18). Reappointed Ken Davis to the Municipal Utility Board; and reappointed Erik Thompson, Dr. Joshua Tarbay, and John Hinton to the PZC; and reappointed Heidi Wilder, Kevin Cleveland, and Matt Ticzkus to TIRZ Boards #1 and #2; and reappointed Randy Bacus to TIRZ Board #1. Adopted Resolution R2022-26 declaring and publishing the intention to issue certificates of obligation, Series 2022, for the purpose of purchase of land in connection with construction of a City-owned convention center facility. Approved Resolution R2022-25, a Joint Resolution between the City of Weatherford and the City of Hudson Oaks to adjust the boundary between the ETJ of the two cities. Disapproved a preliminary plat, based on the 17 unmet conditions, for Freeman Ranch, 84 residential lots being 176.46 acres located at West Lambert Road, in the ETJ of the City of Weatherford, Parker County, Texas. SBD2022-0062. Disapproved a final plat, based on the 15 unmet conditions, for Freeman Ranch, 84 residential lots being 176.46 acres located at West Lambert Road, in the ETJ of the City of Weatherford, Parker County, Texas. SBD2022-0063. Authorized the City Manager to purchase a public safety radio coverage system (also known as a Bi-Directional Amplifier or BDA) for the Weatherford Public Safety Building from Mobile Communications America, Inc. (MCA) in the amount of $64,220.06. Authorized the City Manager to purchase phone and network hardware from General Datatech, Inc. (GDT) for the Weatherford Public Safety Building in the amount of $169,616.40 using the Texas Department of Information Resources (DIR) contracts DIR-TSO-4167 and DIR-TSO- 4288.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-41 concerning amendments to Title XII, Zoning Ordinance, Section 12-5-102, Accessory Structures and Accessory Dwelling Units. Director of Development and Neighborhood Services Kaleb Kentner gave a summary of issues and opportunities, as well as proposed amendments to the text of the zoning ordinance. Staff recommended approval as presented. At their November 9, 2022 regular meeting, the PZC voted unanimously (6-0) to recommend approval as presented. Mayor Paschall opened the public hearing at 6:41 p.m. As there were no speakers, Mayor Paschall closed the hearing at 6:41 p.m. On the motion of Matt Ticzkus, second by Kevin Cleveland, the Council voted unanimously to approve this item as presented. Motion carried 5 - 0.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-35 concerning a request for a conditional use permit (CUP) regarding Community Center use on a 2.599-acre tract of land located at 602 West Water Street, City of Weatherford, Parker County, Texas. CUP2022-0011. Director of Development and Neighborhood Services Kaleb Kentner presented this item. During the regularly scheduled October 25th, 2022, meeting, City Council voted (5-0) to table the public hearing regarding the CUP request until the November 15th, 2022, regularly scheduled City Council meeting. After being tabled, the applicant provided additional narrative and site plan details. In review of the additional materials supplied, staff has concerns about the proposed improvements related to aesthetics, traffic congestion, and overall impact generated by the use. Based upon the additional materials submitted and questions unanswered, staff recommended tabling the item until the December 13, 2022 City Council meeting to allow the applicant additional time to submit needed information. At their October 12th, 2022, regularly scheduled meeting, the PZC voted unanimously (5-0) to recommend approval of the CUP request, subject to the conditions as recommended by staff. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to remove this item from the table . Motion carried 5 - 0.

Mayor Paschall opened the public hearing at 6:46 p.m. • Hanna Adams spoke in favor and on behalf of the applicant and was available for questions. • Anita Henslee, 407 Hobson Street, inquired about parking and a lack of communication. • Wayne Kauffman spoke in favor and on behalf of the applicant and was available for questions. As there were no other speakers, Mayor Paschall closed the hearing at 6:50 p.m. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to table this item until December 13, 2022. Motion carried 5 - 0.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-37 concerning a request for a CUP regarding Auto Sales use on a 1.884-acre tract of land located at 1405 Fort Worth Highway, said tract being Lots 1-4, Block 7, Majors Industrial Addition, City of Weatherford, Parker County, Texas. CUP2022-0013. Director of Development and Neighborhood Services Kaleb Kentner presented this item. During the regularly scheduled October 25th, 2022, meeting, City Council voted (5-0) to table the public hearing regarding the CUP request until the November 15th, 2022, regularly scheduled City Council meeting. At their October 12th, 2022, regularly scheduled meeting, the PZC voted unanimously (5-0) to recommend approval of the CUP request, subject to the following conditions as recommended by staff: 1. All refuse and service areas shall be subject to current screening requirements as outlined in the Landscape and Tree Manual. Dumpsters for the site shall be kept inside approved enclosures with doors shut. 2. Used vehicle display and storage area shall be limited to the areas as shown on the site plan. 3. All existing and new signage for the entire property shall be brought into conformance with current sign regulations as outlined in Section 12-4-101 of the Title XII Zoning Ordinance. Pole signs are prohibited within the Commercial Corridor Overlay, existing pole sign shall be removed. [...]

Mayor Paschall opened the public hearing at 6:57 p.m. • Owner/Applicant Ty Howorth spoke about this request, the signage, and stated he read the list of conditions. Mr. Howorth stated he has completed all the items that he can being that he is not the property owner. As there were no other speakers, Mayor Paschall closed the hearing at 7:03 p.m. Council, staff, and the applicant discussed the signage concerns. On the motion of Matt Ticzkus, second by Kevin Cleveland, the Council voted to approve this item with the aforementioned conditions striking item 3 from the conditions. Motion carried 3 - 2.

Hold a PUBLIC HEARING to consider adoption of Ordinance O2022-40 concerning a request for a CUP regarding an Accessory Dwelling/Security Guard Residence - non rental on a 3.75-acre tract of land located at 2730 White Settlement Road, City of Weatherford, Parker County, Texas. CUP2022-0016. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval subject to the following conditions which must be met prior to issuance of the certificate of occupancy. At their November 9th, 2022, regularly scheduled meeting, the PZC voted unanimously (6-0) to recommend approval of the CUP request, subject to the following conditions as recommended by staff: 1. All permitting, associated review processes, approvals and inspections are required. 2. Minimum Parking regulations as outline in Section 12-4-105 of the Title XII Zoning ordinance shall apply and be reviewed during the permitting process. 3. Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-39 concerning a request for CUP approval for a bail bonds use at 115 North Weilland Street, City of Weatherford, Parker County, Texas. CUP2022-0014. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended disapproval of the CUP request. At their November 9, 2022 regular meeting, the PZC voted unanimously (6-0) to recommend approval of the proposal subject to the following conditions: 1. Hours of operation shall be limited to 8:00 a.m. to 8:00 p.m. 2. Property shall be brought into compliance with landscape and screening requirements as outlined in the zoning ordinance and Landscape and Tree Manual. Consider a request for designation of an individual local historic landmark at 405 West Lee Avenue, City of Weatherford, Parker County, Texas. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval. At their October 26, 2022 regular meeting, the Historic Preservation Commission voted unanimously (5-0) to forward the request for local historic landmark designation to the City Council with a recommendation of approval. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this item as presented. Motion carried 5 - 0.

Consider adoption of Resolution R2022-24 authorizing a variance for the sale of alcohol at 1115 Fort Worth Highway, a location less than 300 feet, property-line to property-line, from Weatherford ISD's Crockett Elementary School. City Manager James Hotopp presented this item. The applicant, Bandi Lou’s Steakhouse, provided a letter of no-opposition from the Weatherford Independent School District and which letter is attached as an exhibit to the resolution. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve this item as presented. Motion carried 5 - 0.
