Presentation of the project of the year award from the Texas Chapter American Public Works Association for the Northeast Downtown Project. Transportation Operations Manager Matt Leppla presented this award.

Consent agenda, approved as one vote (4-0, on the motion of Heidi Wilder, second by Kevin Cleveland): Approved the minutes of the City Council meeting held June 28, 2022. Authorized the City Manager to utilize additional funds not to exceed $100k for contracted legal services with Taylor, Olson, Adkins, Sralla & Elam, LLP (TOASE) for the remainder of FY22. Disapproved a final plat, for Branch Creek, 116 single-family residential lots and five open space tracts, being 42.181 acres situated in the J. Beverly Survey, Abstract No. 74; J. Hart Survey, Abstract No. 592; J. Beverly Survey, Abstract No. 175; City of Weatherford, Parker County, Texas, SBD2022-0030, on recommendation of the Planning and Zoning Commission (PZC), for the following 22 unmet conditions: 1. Remove zoning information from the final plat (Weatherford Municipal Code (WMC) §11- 5-2). 2. The vicinity map does not show the correct location (WMC §11-5-2(g)). 3. The metes and bound legal description appears to be missing the last property line segment along the north side (WMC §11-5-2(k)). 4. Include the area of each lot on the plat (WMC §11-5-2(l)). 5. Show the names of proposed streets (WMC §11-5-2(m)). 6. Show the limits of the Tin Top Road right-of-way (WMC §11-5-2(m)). If the right-of-way width is less than 90’, dedication will be required (WMC §11-6-2(c)). 7. Show all existing easements (WMC §11-5-2(m)). At a minimum, there is an existing wastewater and lift station easement and at least one gas easement on this property. 8. Provide recording information for all easements (WMC §11-5-2(m)). 9. Include a note on the plat stating all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat (WMC §11-5-2(m)). 10. Indicate the easement for the proposed lift station as required by the Agreement for Wastewater Facilities Branch Creek (WM §11-5-2(m)). 11. Show the two required concrete monuments as required by the City Engineering Design and Construction Manual (EDCM) (WMC §11-5-2(n)). 12. An approved preliminary plat is required before the final plat can be approved (WMC §11- 5-4(b)). 13. Provide an executed homeowner’s association agreement verifying ownership and maintenance responsibility for common areas (WMC §11-5-3(d)). 14. Provide an exhibit showing the location of cluster mailboxes and a signed letter from the Weatherford Post Office stating that they accept the proposed location (WMC §11-5-3(e)). 15. Public improvements are required to be accepted before the final plat is recorded (WMC §11-5-9(c)(1)). A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements (WMC §11-5-9(c)(2)). 16. Documents released by a Registered Professional Land Surveyor are required to have a seal and signature or the following statement: “Preliminary, this document shall not be recorded for any purpose and shall not be used or viewed or relied upon as a final survey document” (Refer to Texas Administrative Code (TAC) Title 22, Chapter 663.18). 17. Provide a drainage easement to define creeks and floodplain along with associated access route(s) (EDCM §1.8.8.F). 18. The minimum roadway centerline radius is required to be 300’ (EDCM Table 2-1). 19. The location of Street F is not approved. The proposed location will leave a long narrow strip on the Riedel property that may be challenging to develop. Coordinate a suitable location with the City. 20. At least 50% of the total centerline length of all streets within a residential subdivision shall be curvilinear in design. Provide calculations demonstrating this requirement is met (EDCM §2.1.14.C). 21. The property owner information shown north of the subject property does not appear to be correct. 22. Additional easements and/or a revised layout may be necessary upon review of the civil plans. Approved a preliminary plat for Parker Meadows, 14 residential lots being 30.263 acres located at Zion Hill Loop, in the extraterritorial jurisdiction (ETJ) of the City of Weatherford, Parker County, Texas, SBD2022-0028, on recommendation of the PZC, subject to all requirements of the subdivision ordinance and, specifically, the following conditions: 1. Include a written scale on the existing conditions sheet (WMC 11-4-3(a)). 2. Add a note stating that no access will be granted to lots 1, 2, 3, 14, 13, and 12 from Zion Hill Loop. Approved a final plat for Parker Meadows, 14 residential lots being 30.263 acres located at Zion Hill Loop, in the ETJ of the City of Weatherford, Parker County, Texas, SBD2022-0029, on recommendation of the PZC, subject to all requirements of the subdivision ordinance and, specifically, the following conditions: 1. The metes and bounds legal description is not consistent with the bearings and distances on the plat map (WMC 11-5-2(k)). 2. Provide a signed letter from the Weatherford Post Office stating they accept the location and placement of cluster box units (WMC 11-5-3(e)). 3. Public improvements are required to be accepted before the final plat is recorded (WMC 11- 5-9(c)(1)). A surety as required by Parker County will be required to record the plat prior to acceptance of public improvements (WMC 11-5-9(c)(2)). 4. Add a note stating that no access will be granted to lots 1, 2, 3, 14, 13, and 12 from Zion Hill Loop. Approved a preliminary plat for Stone Lake, Phase 2 subdivision, 41 lots on 5.3 acres located in the 400 Block of East B.B. Fielder Road, City of Weatherford, Parker County, Texas, SBD2022- 0032, on recommendation of the PZC, subject to all requirements of the subdivision regulations and, specifically, the following condition: 1. Show the recording information for the temporary turnaround easement on Edgewater Drive (WMC 11-4-4(e)). Approved a final plat for Stone Lake, Phase 2 subdivision, 41 lots on 5.3 acres located in the 400 Block of East B.B. Fielder Road, City of Weatherford, Parker County, Texas, SBD2022- 0033, on recommendation of the PZC, subject to all requirements of the subdivision regulations and, specifically, the following conditions: 1. The metes and bound legal description is not consistent with the boundaries shown on the plat. An example is that BL2 is not consistent between the table and the description (WMC 11-5-2(k)). 2. Show the recording information for the temporary turnaround easement on Edgewater Drive. This easement should be abandoned before the plat is filed as it makes several lots unbuildable (WMC 11-5-2(m)). 3. Include the recording information for the storm water detention pond easement (WMC 11-5- 2(m)). 4. Public improvements are required to be accepted before the final plat is recorded. A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements. (WMC 11-5-9(c)(1-2)). 5. Additional easements and revised layout may be necessary upon review of the civil plans. Approved a preliminary plat for Bethel Place, 2 lots on 29.728 acres located at the 2552 Bethel Road, City of Weatherford, Parker County, Texas, SBD2022-0034, on recommendation of the PZC, subject to all requirements of the subdivision ordinance, which must be met prior to certification and filing: 1. The preliminary plat should consist of a single document containing the existing and proposed conditions sheets with the same title block on each sheet. The sheet numbers show sheets 1 and 2 of sheet 2, but the plat is 3 sheets total. Update the sheet numbers on the plat (WMC 11-4-3). 2. Fleet Street is required to have a 60’ right-of-way as shown on the previous submittal. Revise the label to reflect this. 3. Provide dimensions for the proposed pavement width of Fleet Street on the proposed conditions sheet. The roadway width should be 40’ (WMC 11-4-4(b)). 4. Provide a statement of improvements that will be installed and a timeline for such improvements (WMC 11-4-6(d)). 5. Right-of-way dedication is required along Bethel Road as opposed to reservation (WMC 11- 6-2(c)). Right-of-way can be dedicated to TxDOT by plat. 6. The minimum centerline radius of Fleet Street is required to be 480’. A variance to this requirement may be considered if a sight visibility analysis is provided. The City’s minimum sight visibility requirements will need to be met. Additional easements may be required for sight visibility (EDCM Table 2-1). 7. The intersection of Fleet Street and Bethel Road is required to be 90 degrees and tangent for at least 100’. A variance to this requirement may be considered if a sight visibility analysis is provided. The City’s minimum sight visibility requirements will need to be met. Additional easements may be required for sight visibility. (EDCM 2.4.4). 8. The lot south of Fleet Street is required to be labeled with lot number and block identification and include the designation on the plat that it is an HOA lot for perpetual ownership and maintenance. Approved a final plat for Bethel Place, 2 lots on 29.728 acres located at the 2552 Bethel Road, City of Weatherford, Parker County, Texas, SBD2022-0035, on recommendation of the PZC, subject to all requirements of the subdivision regulations, and specifically the following conditions which must be met prior to certification and filing: 1. Provide sufficient information to accurately reproduce all easements on the ground (WMC 11-5-2(m)). Provide additional information to locate the various water and sanitary sewer easements. Also provide enough information to reproduce the variable width drainage easement containing the detention pond. 2. Public improvements are required to be accepted before the final plat is recorded (WMC 11- 5-9(c)(1)). A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements (WMC 11-5-9(c)(2)). 3. Right-of-way dedication is required along Bethel Road as opposed to reservation (WMC 11- 6-2(c)). Right-of-way can be dedicated to TxDOT by plat. 4. Perimeter screening wall is required to be installed prior to approval of the final plat (Development Agreement O2022-02 Exhibit B §F). 8. Additional easements, alignment adjustments, and/or a revised layout may be necessary upon review of the civil plans. Additional utility easements will be required for the installation of the electric distribution facilities depending on the final layout of this development. 9. The lot south of Fleet Street is required to be labeled with lot number and block identification and include the designation on the plat that it is an HOA lot for perpetual ownership and maintenance. Adopted Resolution R2022-20 to deny a proposed rate change by Oncor Electric Delivery Company, LLC.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-16, a request for a zone change from C1 General Commercial to R3 Multifamily Residential with a Planned Unit Development overlay at the northeast corner of the intersection of Martin Drive and Red Oak Lane for a multifamily development on a 13.324-acre tract of land situated in the Southpark Addition, City of Weatherford, Parker County, Texas. ZCH2022-0007. Director of Development and Neighborhood Services Kaleb Kentner announced that this item had been withdrawn by the applicant. However, because a public hearing had been advertised, Mayor Paschall opened the public hearing at 6:38 p.m. As there were no speakers, Mayor Paschall closed the hearing at 6:38 p.m. No action was taken.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-17 amending Title XII, Zoning Ordinance, concerning commercial zoning districts, uses, definitions, and Planned Unit Developments. Mr. Kentner presented this item including a summary of proposed amendments. Staff recommended approval as presented. At their July 13, 2022 regular meeting, the PZC voted unanimously (7-0) to recommend approval of the proposed amendments as presented. Mayor Paschall opened the public hearing at 6:46 p.m. • Lonnie Pennington, 110 Candleridge Court, representing Grand Adventure, LLC, spoke in favor of proposed amendments pertaining to “amusement.” As there were no other speakers, Mayor Paschall closed the hearing at 6:47 p.m. On the motion of Kevin Cleveland, second by Jeff Robinson, the Council voted to approve this item as presented. Motion carried 4 - 0.

Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-18 closing, vacating, and abandoning a portion of Duke Street in the Milliken Heights Addition of the City of Weatherford. Mr. Kentner presented this item as well. Staff recommended approval. Mayor Paschall opened the public hearing at 6:50 p.m. • Applicant Carroll Dawson, 2113 Woodland Hills Lane, was available for questions. As there were no other speakers, Mayor Paschall closed the hearing at 6:51 p.m. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted to approve this item as presented. Motion carried 4 - 0.

Consider a request for final plat approval for Milliken Heights, Block 18, Lot 1R, a one-lot replat of a portion of Milliken Heights, Block 18, Lot 1 and a portion of the adjacent Duke Street right- of-way, located at 507 Edna Street, City of Weatherford, Parker County, Texas. SBD2022-0027. Mr. Kentner presented this item as well. Staff recommended approval subject to all requirements of the subdivision regulations and the following conditions. At their July 13, 2022 regular meeting, the PZC voted unanimously (7-0) to approve the proposed final plat subject to the following conditions: 1. Include the missing document number in the title block. 2. Callout the right-of-way abandonment along Duke Street. (WMC 11-5-2(m)) 3. Perimeter street improvements are required along Common Street and Edna Street. (EDCM) 2.1.7) 4. Abandonment of the Duke Street right-of-way will create a dead end on Edna Street. A Type III dead end barricade is required. 5. Include the approval block for the City Council as well as the approval block shown for the Planning and Zoning Commission. This plat is being referred by staff to both approval bodies for their consideration. 6. Approval of this plat is conditioned on the approval of the related abandonment of a portion of Duke Street. Weatherford Public Safety Building Update Assistant City Manager Lance Arnold stated this would be the last quarterly update as the ribbon cutting and grand opening has been set for October 13, 2022 at 10:00 a.m. The building will be fully operational by November 1, 2022. Mr. Arnold presented photographs of the status of the building. Discuss and consider nominees for the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election/Ballot. City Manager James Hotopp presented this item stating that seats 6-9 are up for election this year and that elected officials or staff are eligible to serve. Mr. Hotopp expressed interest. Staff will submit Mr. Hotopp’s name for nomination. Ballots will be distributed to member cities at a later date.
