Presentation of Environmental Project of the Year Award from the Texas Chapter of the American Public Works Association for Holland Lake Corridor Preservation Project. This award was presented by Civil Engineer Chad Marbut. Issue proclamation for "Pray Weatherford Day". This proclamation was read by Jeff Robinson, City Council Place 2.
Consent agenda, approved as one vote (5-0, on the motion of Kevin Cleveland, second by Heidi Wilder): Approved the minutes of the Special City Council meeting held August 10, 2020 and the Regular City Council Meeting held August 11, 2020. Approved the conveyance of a surplus police vehicle to the Weatherford College Public Safety Programs for use by the Law Enforcement Academy. Approved Ordinance O2020-39 amending the FY20 Adopted General City Budget. Adopted Resolution R2020-17 ratifying the Council's approval of an exception to the distance requirements for the sale of alcohol at 901 South Main Street. Adopted Ordinance O2020-40 releasing, vacating and abandoning a portion of a utility easement located in Lot 22, Block 1, Lakeway Estates, as recorded in Plat Cabinet D, Slide 17, Plat Records, Parker County, Texas and authorize the Mayor to execute a Quit-Claim deed of the abandoned section of the easement to Roger Wade McMillin and Amy L McMillin.
Hold a PUBLIC HEARING on the voluntary annexation of approximately 5,100 feet of roadway of the East Loop being an approximate 25.785 acre tract of land situated in the J. M. Ruth Survey, Abstract No. 2256 the Johnson Woosley Survey, Abstract No. 1641, and the Thomas Jackson Survey, Abstract No. 745, Parker County Texas and being all or a portion of those tracts of land described in Document Numbers 201900840, 201730332, 201824870, 201731699, 201731513 and 201916683 of the Deed Records of Parker County, Texas and a portion of Farm to Market Road 730 to enlarge and extend the boundary limits of the City. City Manager James Hotopp presented this item. This is the first of two public hearings. The second public hearing will be on August 31, 2020 as well as the reading of the ordinance. Hold a PUBLIC HEARING and consider approval of Ordinance O2020-43 for a zoning district change from C1 Commercial to R1 One-Family Residential and a conditional use permit to permit a 810 square foot shed and porch for the lot at 702 and 702 ½ South Elm Street being lot PT5, Block 11, Brackene Subdivision, City of Weatherford, Parker County, Texas. ZCH2020-0011 & CUP2020-0007. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval of the zoning change. Staff recommended approval of the CUP subject to the following conditions: 1. Shed may be used for non-dwelling and/or noncommercial uses. 2. Parking in front of any accessory structure must be on paved surface (Concrete or Asphalt). 3. Porch/shed shall be subordinate to the primary structure in size and height. At their August 12th meeting, the PZC voted (6 - 1) to approve the zone change and CUP for an accessory structure. Hold a PUBLIC HEARING and consider adoption of Ordinance O2020-42 repealing Title XII of the City Code of Weatherford, save and except Section 12-5-2 and adopting Title XII as appended to the ordinance save and except 12-4-100 which is a recodification of 12-5-2, and adopting the administrative rules for implementation of Title XII Chapter 4, Sections 102 through 103 (Landscape and Tree Manual). Staff recommended adoption of Ordinance O2020-42, the updated zoning regulations including any grammatical, formatting, or minor adjustments required from Legal and/or Planning staff. The PZC voted (6 - 0) to approve the zoning regulations including any grammatical, formatting, or minor adjustments required from Legal and/or Planning staff with the additional amendments to address the following concerns: 1. Lot sizes for the R1 district - staff increased from 50' x 110' (5,500 S.F) to 60' x 100' (6,000 S.F.). 2. Minimum lot size for Accessory Dwelling Units (ADU) - staff added a minimum lot size of 6,000 sq. ft. for ADUs and a table for different sized lots. 3. Add North Main Street to the Commercial Corridor overlay - staff added North Main Street from the railroad right-of-way to Ric Williamson Memorial Highway. 4. Consider a request for final plat for 1 lot at 1724 East Bankhead Drive in the City of Weatherford, Parker County, Texas. SBD2020-0039. Director of Development and Neighborhood Services Kaleb Kentner presented this item. Staff recommended approval of the plat subject to the following conditions which must be met prior to certification and filing: 1. Remove Note 11 from plat with zoning information (Subdivision Ordinance 11-5-2). 2. State the owners name on the owner's dedication certificate. 3. Revise the label for the "Area Reserved by City of Weatherford" to reflect a right-of-way reservation. 4. Show the right-of-way centerlines of East Bankhead Drive and the future collector (Subdivision Ordinance 11-5-2(m)). 5. Remove the physical features of the land shown on the plat (Subdivision ordinance 11-5-2). 6. Adjust the centerline radius for the right of way reservation to 480' (Weatherford Engineering Design and Construction Manual (EDCM) Table 2.1). 7. The future collector roadway intersection with East Bankhead is required to be tangent for at least 100' (EDCM 2.4.4). 8. Staff recommended approval subject to the following conditions, which must be met prior to certification and filing of the plat: 1. Provide legal description of right of way dedication for Parker County. 2. Show entire centerline of North Lake Drive (Subdivision Ordinance 11-5-2(m). 3. Provide a 25' x 25' Visibility, Access, and Maintenance (VAM) easement on the corner of Lot 9 (Ref Weatherford Engineering Design and Construction Manual (EDCM) §2.6.3.B). 4. Provide dimensions along the entire property line on lot 3 (Subdivision Ordinance 11-5-2(k). 5. Use provided language in the signature P & Z and City Council Signature Blocks (Subdivision Ordinance 11-5-2(q). 6. Provide dimensions to the Floodway Management Area Easement along the southwest and southeast property lines. Consider a request for final plat approval for the Eureka Townhome Addition, 53 lots on 13.869 acres situated in the John E. Miller Survey, Abstract 890, City of Weatherford, Parker County, Texas. SBD2020-0040. Director of Development and Neighborhood Services Kaleb Kentner presented this item. At their August 12th, 2020 meeting, the PZC unanimously passed a motion to approve the plat subject to the following conditions specified by staff: 1. Remove Lot 1X from the note dedicating lots to the City of Weatherford. Lot 1X will not be accepted by the City. 2. Remove the physical features (railroad tracks) of the land. WMC 11-5-2. 3. Include the number of lots within the subdivision in the title block. WMC 11-5-2(h)(1)(c). 4. Show the limits of the R&P Railroad Company right-of-way. WMC 11-5-2(m). 5. Show the right-of-way centerline for Eureka Street. WMC 11-5-2(m). 6. Label the flood plain area as the 100-year flood plain. WMC 11-5-2(o). 7. Provide a recorded HOA agreement for the maintenance of open space lots and screening walls. WMC 11-5-3(d). 8. Receive recommendation regarding funding outside agency requests for the City’s FY21 Budget. Finance Director Jessica Doss presented this item. Each year, the City of Weatherford receives requests from local organizations for distributions from General Fund and Hotel Occupancy Tax revenue. The requests are as follows: From the General Fund: $25,000 • Parker County Committee on Aging: • CASA Hope for Children: $5,000 $5,000 o funded in FY19 for $5,000 o funded in FY20 for $5,000 o no application submitted for FY20 From the Hotel Fund: $101,000 • Children's Advocacy Center: $5,000 • Doss Heritage & Culture Center: $5,000 o funded in FY20 for $5,000 o funded in FY20 for $5,000 • Freedom House: $5,000 • Weatherford Chamber of Commerce: o funded in FY20 for $5,000 $96,000 • Manna Storehouse: $5,000 o funded in FY20 for $96,000 o funded in FY20 for $5,000 On the motion of Heidi Wilder, second by Matt Ticzkus, the Council voted unanimously to approve the aforementioned requests in the amounts as stated. Budget work session to discuss the FY21 City Manager's proposed budget Finance Director Jessica Doss presented this item. Ms. Doss presented the following comparison of property tax rates by cities comparable in size, location, and/or amenities: It was noted that, in this comparison, only Aledo’s tax rate is less than Weatherford’s. It was also noted that Aledo has neither police nor fire departments. The current and FY21 proposed property tax rate of 48.79 cents is shown; however, the City Manager’s proposed budget is based on a proposed tax rate of 48.29 cents, a decrease of one percent. Considering two moderately priced home values of $150,000 and $175,000, the one percent decrease in property tax rates would equate to an annual savings of $7.50 for a home value of $150,000 and an annual savings of $8.75 for a home value of $175,000. Ms. Doss stated that the budget is balanced with the proposed FY21 tax rate of 48.29 cents. The City is providing quality and consistent services at a competitive value, continuing to reserve funds for capital needs, and demonstrating conservative fiscal management. The FY21 Proposed Budget is $40.3 million, which is an increase of $688K or 1.7 percent over the FY20 budget.
