Consent agenda, approved as one vote (5-0, on the motion of Mayor Pro Tem Jeff Robinson, second by Heidi Wilder): Approved the minutes of the City Council meeting held November 13, 2018. Authorized the City Manager to utilize funds exceeding $50,000 with Datavox, Inc. for FY19. Reappointed Dr. Donald Phillips as the City Health Official and authorized the City Manager to execute the new two-year agreement with Dr. Donald Phillips including compensation of $3,000 per year and up to $3,000 for dues and training. Awarded bid #2019-008-annual plastic bags for plastic bags to Houston Poly Bag based on lowest and most responsive overall bid that complied with requirements. Authorized Weatherford Public Library staff to apply for a Jeanette & Jim Larson Grant from the Texas Library Association.

Hold a PUBLIC HEARING and consider approval of ordinance 938-2018-53 for a zoning district change from C-1 Commercial to C-1 Commercial with a Conditional Use Permit (CUP) for an oil change, quick lube, and minor automobile inspection facility at 1515 South Main Street and described as being .53 acres, Lot 1 of Papa John’s Addition, City of Weatherford, Parker County, Texas. ZCH2018-0025. City Planner Stan Hamrick presented this item. The lot is located north of the Bethel Road, College Park Drive, and South Main Street intersection. This is an odd lot; however, it has been platted. The General Plan calls for ‘community commercial’ in this area. The applicant has done quite a bit of work and met with staff several times. The applicant is proposing a one-bay oil change facility with a small office. Mr. Hamrick stated that staff recommended denial with regard to protecting the corridors leading into downtown as well as automotive uses in the corridor. The request does meet the ‘community commercial’ and zoning aspects. The Planning and Zoning Commission’s (PZC) motion to approve failed with a 3 - 3 vote. Their motion included the following conditions: 1) no inoperable or vehicle storage; 2) work to be done only inside the bay; and 3) elevation and site plan to be approved at a future PZC meeting. Hold a PUBLIC HEARING and consider approval of ordinance 939-2018-54 for a zoning district change from C1 Commercial and R1 One-Family Residential to C1 Commercial and C3 Commercial/Heavy for a 6.702 acre tract described as being all or portions of Lots 2AR, 5R, 1-12 in Block 47, and Lots 1-5 & 9-16 in Block 48, Carter's Addition, and located at 323 West 4th Street, City of Weatherford, Parker County, Texas. ZCH2018-0027. Mr. Hamrick presented this item as well. He stated that Mr. Carroll Dawson owns this property as well as the adjacent Triple D Liquor. Mr. Dawson seeks C1 and C3 zoning. This would also allow a rear driveway/entrance to the liquor store which will help alleviate traffic on 4th Street. The liquor store will remain in C1 zoning. Mr. Hamrick noted that any use allowed in C3 zoning would be allowed on the southern portion of the property and stated that the applicant is considering mini-warehouse, office/showroom, and office/warehouse. This area is shown as manufacturing/warehouse on the General Plan and is basically an extension of the uses on the west side of Jacksboro-Graham Road. Hold a PUBLIC HEARING and consider approval of ordinance 940-2018-55 for a zoning district change from C-1 Commercial to C-1 Commercial with a Conditional Use Permit (CUP) for an eating establishment/restaurant with drive-thru service at a 0.75 acre parcel described as being Lot 4R, Block 1, Weatherford Hilltop Addition, and located at 1718 South Main Street, City of Weatherford, Parker County, Texas. ZCH2018-0028. Mr. Hamrick presented this item as well. This is for a Kentucky Fried Chicken in the area of the Aldi shopping center. The area is designated as ‘community commercial’ on the General Plan. They will have a drive-thru with an escape lane. The PZC approved this request at their previous meeting. Mayor Swancy opened the public hearing at 7:11 p.m. As there were no speakers, Mayor Swancy closed the hearing at 7:11 p.m. On the motion of Kevin Cleveland, second by Heidi Wilder, the Council voted unanimously to approve this request. Hold a PUBLIC HEARING and consider approval of ordinance 941-2018-56 for a zoning district change from AG Agriculture & C1 Commercial to R1 One-Family Residential located at 722 West Park Avenue and described as being 23.68 acres, situated in and being a portion of the BBB&C RR Company Survey, Abstract 145; the J.A. Yeoman Survey, Abstract 1692; and the J.M. Gibson Survey, Abstract 509, City of Weatherford, Parker County, Texas. ZCH2018-0030. Mr. Hamrick presented this item. This property is located between Bowie Drive and West Park Avenue. The owner has requested the zoning change from AG and C1 to R1 for new residential. Mayor Swancy opened the public hearing at 7:13 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 7:13 p.m. On the motion of Kevin Cleveland, second by Mayor Pro Tem Jeff Robinson, the Council voted unanimously to approve this request. Hold a PUBLIC HEARING and consider approval of ordinance 942-2018-57 for a zoning district change from C-1 Commercial to PD Planned Development for multi-family residential located at Holly Oaks Lane & FM-730 and described as being 2.76 acres, Lot 1, Block A of the Holly Oak Addition, plat cabinet B, Slide 668, and Lot 1, Block A of the Wilson City of Weatherford, plat cabinet B, Slide 613, City of Weatherford, Parker County, Texas. ZCH2018-0031. Mr. Hamrick presented this item. Mayor Swancy opened the public hearing at 7:16 p.m. Janie Sidener, 201 Otto Drive, spoke about the drainage from the apartments and from the 26 houses that are located nearby. She stated that her property is washing away and the creek that divides her property is now a river. Mr. Hamrick stated that this ordinance does not authorize new buildings. The ordinance cleans up zoning and setbacks for the property owner so that they can seek refinancing. As there were no other speakers, Mayor Swancy closed the public hearing at 7:22 p.m. Staff recommended approval of a PD planned development with a base of R3 multifamily and the following stipulations: 1. Hold a PUBLIC HEARING and consider approval of ordinance 943-2018-58 for a zoning district change from C-1 Commercial to C-1 Commercial with a Conditional Use Permit (CUP) for an eating establishment/restaurant with drive-thru service at 1206-1208 S Main St., described as being 1.03 acres, part of Block 18, and part of State Street (closed), Anderson’s Addition, City of Weatherford, Parker County, Texas. ZCH2018-0033. Mr. Hamrick stated this is the property previously occupied by Wildberries Cafe. This zoning change request requires a CUP for the drive-thru only. The applicant intends to remodel the property into an HTeaO. This is a business that primarily sells tea, but other products as well. Mayor Swancy opened the public hearing at 7:25 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 7:25 p.m. Staff clarified that the applicant will tear down the existing building on the front of this property. The existing structure at the rear of this property will be maintained and the applicant will be working with that owner to refresh their property as well. The applicant will also provide proper screening from adjacent neighbors where required. Hold a PUBLIC HEARING and consider approval of Ordinance 944-2018-59 Designating a Geographical Area within the City of Weatherford as a Tax Increment Reinvestment Zone Pursuant to Chapter 311 of the Texas Tax Code, to be known as Reinvestment Zone Number Two, City of Weatherford. Deputy City Manager James Hotopp presented this item. He stated that at the November 13 meeting, a resolution was passed initiating the process of forming Tax Increment Reinvestment Zone (TIRZ) #2. The resolution required a public hearing to be held prior to adoption of an ordinance creating the TIRZ. Notice for the public hearing was published approximately 10 days ago. At the time the notice was submitted to the paper, staff anticipated having the preliminary project and finance plan available. Since the preliminary project and finance plans were not available, staff recommended opening the public hearing allowing comments, and continuing the public hearing until the December 11th meeting. Staff also recommended no action on the ordinance at this time. Mr. Hotopp introduced Trent Petty with Petty and Associates. Mr. Petty gave a presentation about the TIRZ formation to help answer questions and relieve concerns. Mr. Petty spoke about TIRZ 1, which was a new development area. Consider and/or act upon awarding Request For Proposal (RFP) # 2018-009 to Tyler Technologies Munis for an Enterprise Resource Planning (ERP) Software System. Troy Garvin, Director of Technology Services, provided a recap and update on the status of the ERP selection. Staff recommended awarding RFP #2018-009 to Tyler Technologies Munis. Mr. Garvin introduced Seth Hedstrom with BerryDunn. ERP is an industry term for a modular financial software package. Mr. Hedstrom gave an overview of the project approach and the work performed thus far. This was a collaborative process involving approximately 40 City staff members. Mr. Hedstrom stated the following challenges and areas of improvement were discovered during the process: 1. There is duplicate entry into multiple systems throughout the City 2. There is a lack of integration between Incode and other systems used in the City. 3. There are many paper-based processes throughout the City. 4. Several shadow systems are in use due to a reported lack of information accessible within the system. Proposed modules include Tyler Technologies Munis and ExecuTime software products for the following uses: • Financial Functionality (e.g. budgeting, purchasing) • Human Capital Management (e.g. payroll, employee records) • Utility Billing (e.g. citizen self service, incident management, GIS integration) • Time and Attendance The implementation [...]

Consider authorizing the City Manager to execute a professional services agreement with BerryDunn and Associates for services related to the implementation of an Enterprise Resource Planning software system. Mr. Garvin stated that staff identified the significant labor effort involved in this project, as well as the need for subject matter experts. Third party oversight of these types of projects are what made other projects successful. This is a 30-month implementation process. On the motion of Mayor Pro Tem Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve this item. Motion carried 5 - 0.

Consider a request for a waiver from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, for a minor plat of 15.43 acres situated in the F.C. Beard Survey, Abstract No. 194 and the T&P RR Co. Survey, Abstract No. 3, Block 2, Abstract No. 1514, City of Weatherford, Parker County, Texas. SBD2018-0023. City Planner Stan Hamrick presented this item. This is a minor plat. This property is technically inside the City limits but is literally located right on the county road. This is an existing county road that is in good condition. On the motion of Kevin Cleveland, second by Heidi Wilder, the Council voted unanimously to approve the request for a waiver from required street improvements on White Settlement Road. Motion carried 5 - 0.

Consider a request for a waiver from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, for a minor plat of 2.985 acres situated in and being a portion of the William Woosley Survey, Abstract No. 1642, an addition in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2018-0036. Mr. Hamrick presented this item as well. This is an existing site with an existing home. The applicant is basically giving the house to his daughter and is saving back a portion of the property to build a house for himself. In the General Plan, this property is located on the border of ‘suburban living’ and ‘agriculture.’ Since they are proposing to share a well and because the lots are smaller than typical lots, they will be tied together perpetually with this plat which shows a private easement for the well. If the well goes out, it will be replaced with one well to serve both properties. Mr. Hamrick stated that this property is far enough from City services that providing water and sewer is not feasible at this time. On the motion of Mayor Pro Tem Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the request for waivers from requirements to connect each lot to the City’s water and wastewater systems. Consider a request for waivers from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, for a preliminary plat of 73.06 acres being two tracts situated in the T & P RR Co. Survey, Section No. 99, Abstract No. 1446, and the J.J. Bradford Survey, Abstract No. 1931 in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2018-0050. Mr. Hamrick presented this item. This is a portion of a larger property which the developer is in the process of master platting. The applicant is proposing to develop the northern portion in a more rural fashion. In the General Plan, this property is located along ‘suburban living’ and ‘agriculture’ or ‘rural living’ to the north. The applicant is not proposing to develop all of the area at this time. The applicant has requested waivers from the requirement to provide water and sewer extensions and the waiver to provide a screening fence along the existing roads. Staff is supportive of the requests for this portion at this time. Staff anticipates having a preliminary plat on the Council’s December 11 agenda. All access requirements will be met. This proposed preliminary plat is all individual well and septic. Consider a revision to an approved preliminary plat for The Oaks Apartments Addition, being a portion of an approximately 27.046 acre tract located in the 1800 block of Fort Worth Highway, situated in and being a portion of the Elizabeth Crockett Survey, Abstract 214, City of Weatherford, Parker County, Texas. SBD2017-0052 Mr. Hamrick stated that this item is an amendment to an existing plat. A preliminary plat has already been approved for the northern portion of this property, including the road. The applicant is now moving forward on the road construction. The revision is to include a small portion of the future commercial lot into this preliminary plat. On the motion of Mayor Pro Tem Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve this request. Motion carried 5 - 0.

Consider a request for approval of a Final Plat for Crown Valley Addition, Phase 2, Section 2, being 10.22 acres situated in the Ann McCarver Survey, Abstract No. 910, City of Weatherford, Parker County, Texas. SBD2018-0034. Mr. Hamrick stated that this item is for the approval of a final plat for phase 2-2. There have been some situations in the past where Council has approved a final plat but staff will not certify or file it until all public improvements have been finaled and approved. In these cases, a bond or letter of credit is often provided as surety. For this request, the public improvements have been substantially completed. The developer is now working on the previous agreement for the emergency access road, all-weather surface, from phase through phase 2-3 all the way to fire lane standard, all the way to Norman Lane. The applicant previously agreed to improve Norman to a fire lane standard. The applicant is not as far along on phase 2- 3 as they would like to be at this point. The applicant has provided surety for an emergency access road that, if needed, could be built parallel to the road that accesses Norman. The developer anticipates six months, weather pending. Consider authorizing the City Manager to award Bid# 2019-007 for the renovation of Cherry Park Pool to Sunbelt Pools for $1,311,305.00. Direcor of Parks, Recreation, and Special Events Shannon Goodman presented this item. He reviewed the problems with the pool, which staff began to notice in the summer of 2017, and which included failure in the underground pipes and plumbing. Mr. Goodman stated that the pool is 76 years old and, while some cosmetic work has been performed aboveground over the years, none of the pipes/plumbing. Staff went through the bid process and recommends awarding the bid to the lowest bidder, Sunbelt Pools for $1,311,305. It has been suggested that it would be significantly cheaper for staff to purchase the play structure outside of this bid, so that cost is not included in this amount. Mr. Goodman stated the project is 160 construction days from the day that the contract is approved; therefore, the project completion date should be May 1st. This puts the pool in line for next year’s season which begins in May. On the motion of Heidi Wilder, second by Curtis Tucker, the Council voted unanimously to approve this item. Consider and/or accept a grant from the Rees-Jones Foundation to be used in the Giving Second Chances capital campaign toward the design and construction of the new Medical Surgical Center and Classroom building located at the Weatherford Parker County Animal Shelter. Director of Municipal and Community Services Dustin Deel presented this item. He stated that through the shelter’s ‘Giving Second Chances’ funding campaign to improve facilities, the shelter had the opportunity to apply for a grant from the Rees-Jones Foundation of Dallas. Between 2006 and 2016, the Rees-Jones Foundation has given away more than $300 million to non-profit organizations. Their grants are paid for child protection, child youth services, international causes, mental health coaching/treatment, education, chronic health conditions, and approximately three percent their giving goes to animal welfare. Mr. Deel explained that the representatives of the Rees-Jones Foundation thought the shelter’s partnering with Weatherford College to offer a new associates degree in vet technology was such an innovative idea that it should be offered everywhere. Mr. Deel stated that he received a phone call from one of the family members on November 15th stating that they were very impressed with the shelter’s operation, that they had no idea of the animal needs west of the DFW metroplex, and that the board members voted [...]

Council thanked the Rees- Jones Foundation for their generous gift to the Weatherford Parker County Animal Shelter.
