Consent agenda, approved as one vote (5-0, on the motion of Jeff Robinson, second by Heidi Wilder): Awarded Bid #2012-015 for annual aggregate in part (items 1 through 5, and 7 through 9) to Vulcan Construction and part (item 6) to Zack Burkett Company based on best value. Awarded Bid #2012-016 for annual asphalt repairs to A-1 Concrete based on lowest most responsive overall bid. Awarded Bid #2012-017 for annual Concrete to A-1 Concrete based on lowest most responsive overall bid for combined concrete work on sidewalks, driveway approaches, valley gutters, curb and gutters, slabs, storm drain structures, and handicap ramps. Awarded Bid #2012-018 for annual street milling to Dustrol, Inc. based on bid price of all items combined. Approved a Participation Agreement with J.P. Morgan Chase Bank USA, N.A. for a Commercial Card Program. Approved Ordinance 589-2012-38 adopting an amended fee schedule for the City of Weatherford, Texas, to be made effective on October 1, 2012. The Ordinance is captioned as follows: ORDINANCE NO. 590-2012-39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS, ADOPTING AN AMENDED BUDGET FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2012, AND MAKING APPROPRIATIONS FOR THE SEVERAL DEPARTMENTS FOR SAID YEAR IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF WEATHERFORD, TEXAS AND THE LAWS OF THE STATE OF TEXAS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; AND PROVIDING A SAVINGS CLAUSE.
Hold a PUBLIC HEARING and discuss and consider approval of Resolution R2012-22 designating a certain area within the corporate boundaries of the City as a Reinvestment Zone, as authorized by Section 312, Texas Tax Code, for commercial/industrial tax abatement, for property identified as a certain 3.047 acres tract of land out of the J.L. Detiste Survey, Abstract No. 369, Parker County, “Weatherford Town Center”, City of Weatherford, Parker County, Texas; commonly known as 2124-2128-2132 Tin Top Rd., Weatherford, TX. Dennis Clayton, Executive Director of Weatherford Economic Development Authority (WEDA), stated that a taxing unit must designate a Reinvestment Zone before entering into a commercial/industrial tax abatement agreement, and that the City must hold a public hearing to consider a resolution to create the zone. The Council adopted a policy regulating tax abatement agreements in February 2012 and that policy is effective for two years. WEDA recommended approval. Mayor Hooks opened the Public Hearing at 6:39 p.m. As there were no speakers, Mayor Hooks closed the Public Hearing at 6:39 p.m. On the motion of Craig Swancy, second by Waymon Hamilton, the Council voted unanimously to approve Resolution R2012-22. Motion carried 5-0.
Consider and/or act upon adoption of Ordinance 591-2012-40 on first and final reading to approve the FY13 Weatherford Municipal Annual Budget. Chad Janicek, Director of Office of Management and Budget, presented this item to the Council. He summarized the changes recommended by the Council on September 11, 2012, and the following budget totals: CC 092512 Page 2 of 5 Mr. Janicek noted Council’s September 11, 2012 direction regarding the Hotel Motel Tax Fund disbursements as: Chamber of Commerce, $121,400; Chandor Gardens roof repairs, $30,000; Doss Center, $21,700; promotion of Chandor Gardens, $5,000; and hotel tax collection audit $2,500. The Hotel Motel Tax Fund total is as follows: Marilyn Carter, Texas Opry Theater, 315 York Avenue, inquired about the Hotel Motel Tax Funds being distributed for the upcoming fiscal year and stated that the Chamber of Commerce has unfairly been funded in full for the last three years. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to accept and adopt Ordinance 591-2012-40. Motion carried 5-0.
Consider and/or act upon the first and final ratification of the property tax revenue increase reflected in the Proposed FY13 Weatherford Municipal Annual Budget. Chad Janicek, Director of Office of Management and Budget, stated that this ratification is in no way related to the tax rate, which is proposed to remain the same, it simply ratifies that the City expects to receive more dollars in property tax revenue next year. On the motion of Heidi CC 092512 Page 3 of 5 Wilder, second by Craig Swancy, the Council voted unanimously to ratify the tax revenue increase reflected in the proposed budget. Motion carried 5-0.
Consider and/or act upon the adoption of Ordinance 592-2012-41 adopting the proposed ad valorem tax rate of 46.36 cents per $100 of valuation for the 2012 tax year. Chad Janicek, Director of Office of Management and Budget, advised that Council has proposed an unchanged tax rate of 46.36 cents, which is below the effective and rollback tax rates. Jeff Robinson moved that property taxes be implemented by the adoption of an unchanged tax rate of $0.4636 per $100 valuation through approval of an ordinance authorizing the levying of ad valorem taxes for Fiscal Year October 1, 2012, through September 30, 2013. This tax rate will raise more total property taxes than last year's budget by $198,773, or 4.03%. Of that amount, $96,381 is tax revenue to be raised from new property added to the tax roll this year. Ms. Wilder seconded the motion. Motion carried 5-0.
Consider and/or act upon approval of an Interlocal Agreement for Development of Hazard Mitigation Plans. Fire Chief Paul Rust stated that the North Central Texas Council of Governments (NCTCOG) approached the City about development of a Hazard Mitigation Plan. The plan will identify our natural hazards, such as areas prone to flooding. After the City supplies the data, NCTCOG will write the plan at no cost to the City, other than staff time. Once the plan is completed, the City will be eligible to apply for federal grant money for hazard mitigation. On the motion of Craig Swancy, second by Waymon Hamilton, the Council voted unanimously to approve the agreement. Motion carried 5-0.
Consider an appointment to the Historic Preservation Commission. Mr. Swancy stated that the City has lost some members of the Historic Preservation Commission and asked for applicants with a vested interest in downtown or may live near downtown.

Future agenda items: CC 092512 Page 4 of 5 For December or January, Ms. Wilder asked that the Council look at a policy that defines the type of revenue and addresses a penalty clause so that if the City pursues penalties, the policy would help to implement and solidify the City’s position in court. Mr. Hamilton asked for an update from the Parks Department regarding the Little League contract.
Action on executive session items: To take action if necessary, pursuant to Chapter 551, Texas Government Code, VTCS, (Open Meetings Law) in accordance with the authority contained in: Section 551.087- Deliberations regarding economic development negotiations: 1. AMG Technology Investment Group, LLC, dba Nextlink Broadband. 2. Weatherford Entertainment, LLC On the motion of Heidi Wilder, second by Craig Swancy, the council voted unanimously to approve the economic development agreement with AMG.
