Wildlife expert, Bonnie Bradshaw, will give a presentation regarding coyote sightings inside the city of Weatherford. Director of Municipal and Community Services Dustin Deel spoke briefly about the recent concern of coyote sightings in the area and introduced wildlife expert Marcus Stephens of 911 Wildlife Services who gave the presentation in the absence of Ms. Bradshaw. Mr. Stephens stated that pets are not by nature on coyote’s food chain and that trapping and removing coyotes from the urban environment does not typically work. There is no danger of coyotes being a hazard to humans. The coyote’s diet consists mostly of rats, mice, rabbits, squirrels, trash, fruits and grass. However, they will carry off dead animals and defend themselves if chased or attacked by small animals. There have been reports of coyotes attacking animals but these cases are extremely rare. Coyotes do not normally attack things that will fight back. Mr. Stephens explained that coyotes are one of the best forms of pest control in urban environments. Mr. Deel notified the Council that there will be a public town hall meeting regarding this issue at Curtis Elementary School on Thursday, March 16 at 6:30 p.m. At that time, the experts will go more in depth and answer questions from citizens pertaining to their concerns.
Consent agenda, approved as one vote (3-0, on the motion of Heidi Wilder, second by Dale Fleeger): Approved the minutes of the City Council meetings held February 28, 2017 and March 7, 2017. Approved Resolution R2017-11 designating an official newspaper for the City of Weatherford’s legal publications and authorizing the City Manager to execute a contract with the Weatherford Democrat for the remainder of fiscal year 2016-17. Awarded Bid #2017-006 ADA Restroom Trailer to Montondo Trailer based on lowest and most responsive overall bid that complied with requirements. Approved a cooperative purchase agreement with Intermountain Slurry Seal Inc. for Micro- surfacing various City streets. Approved Resolution R2017-08 authorizing the Weatherford Police Department to apply for grant funding offered by the Office of the Governor, Criminal Justice Division, for officer safety equipment. Approved Resolution R2017-09 authorizing the Weatherford Police Department to apply for grant funding offered by the Office of the Governor, Criminal Justice Division, for versatile patrol vehicles. Consider contracting with Ray Associates Inc. to update the City of Weatherford classification and compensation study for an amount not to exceed $46,000. This item was removed from the consent agenda . City Manager Sharon Hayes discussed this item and explained that in the February 28, 2017 meeting a presentation was given to Council by Ray Associates regarding a compensation study. It was requested that this item be brought back for consideration. After discussion, a work session was requested by Council to explore options of implementing and sustaining increases in pay should the compensation study determine the need. carried 3 - 0.
Hold a PUBLIC HEARING and consider approval of Ordinance 830-2017-14 requesting a zoning district change for property zoned Agriculture (AG) to a Planned Development District (PD) of an approximate 17.696 acres tract of land out of the R. Inman Survey, Abstract No. 726, City of Weatherford, Parker County, Texas. ZCH2017-0004 Stan Hamrick, City Planner, presented this item. Mr. Hamrick explained that the property is an approximate 17.696 acre tract of land. The project is proposed to be a subdivision with individual lot townhomes. As the attached zoning map shows, the northern two-thirds is in the City and zoned Agriculture (AG). The southern portion is outside the City limits. The project is compatible with the surrounding uses and located between a single-family housing addition and the large commercial area off of Main Street and just South of I-20. The applicant is requesting annexation of the portion of the property that is not in the city limits. The site plan has a number of problems, including orphan lots, buildings facing B.B. Fielder and other challenges due to the unique site. Applicant requests, and staff agrees, that the zoning be approved prior to incurring additional expenses on finalizing an acceptable site plan. Hold a PUBLIC HEARING and consider approval of Ordinance 831-2017-15 requesting a zoning district change for property zoned RL Residential Lake Lots to RL Residential Lake Lots with CUP Conditional Use Permit for an accessory dwelling located at 2123 East Lake Drive. City of Weatherford, Parker County, Texas. ZCH2017-0003 Mr. Hamrick presented this item as well. The property is a lake lot owned by the City of Weatherford. The applicant licenses the property from the City of Weatherford. The applicant would like to build an accessory dwelling unit. The Residential Lake Zoning (RL) allows an accessory dwelling unit with a CUP. The Council, upon recommendation of the Planning & Zoning Commission, may approve with conditions or deny a CUP. Because a CUP is a zoning case, the adjacent property owners within 200 feet have been notified in writing and a legal notice placed in the newspaper. On a zoning case, the applicant needs to demonstrate that the CUP will not be detrimental to the adjacent properties and will not adversely affect the neighborhood. The existing structure is a 720-square foot residence in need of substantial repairs that the applicant is proposing to remodel and expand to 1,000 square feet. Hold a PUBLIC HEARING and consider approval of a Final Residential Replat for an approximate 1.389 acre tract of land at the corner of Jameson and Denton Streets, situated on Lot 8 & 11, Block 1, Yeoman Addition, an addition to the City of Weatherford, Parker County, Texas. (SBD2016-0012) Mr. Hamrick presented this item as well. This property is zoned Residential Multi-family. Applicant is proposing to plat five lots for duplex dwellings, a total of ten units. The replat has been reviewed by all the necessary departments and has been approved. The replat had to be approved by the Planning & Zoning Commission and the City Council because the plat was for five lots and the minimum number of lots staff can approve administratively is four. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted to approve the Residential Replat. Motion carried 3 - 0.
Consider approval of Ordinance 828-2017-12 on first and final reading for the involuntary annexation of “Coy Road”, 77 acres of land more or less located wholly or partially in the James D. Long survey, Abstract 800, the Samuel Barber Survey, Abstract 151, the Stephen F. Jones Survey, Abstract 748, the Isaac C. Spence Abstract 1193 and the Hannibal Good Survey, Abstract 536, Parker County, Texas. City Manager Sharon Hayes presented this item. At the Special City Council meeting held January 10, 2017, the Council voted unanimously to approve Resolution R2017-02 setting two public hearings on the proposed involuntary annexation along Interstate Highway 20 West which encompasses approximately 77 acres and is generally located west along IH-20 and south along Coy Road. One non-annexation agreement was offered to the property with an agriculture exemption according to the Parker County Appraisal District, as required by law. The non-annexation agreement guarantees the continuation of the extraterritorial status of the land and its immunity from annexation by the City for five (5) years, in accordance with the agreement. If the party wished to execute the non-annexation agreement, it was to be returned to the City by 5:00 p.m. on or before Monday, February 13, 2017. Consider approval of Ordinance 829-2017-13 on first and final reading for the involuntary annexation of “Dennis Road West”, 188.50 acres of land more or less located wholly or partially in the F. L. Green Survey, Abstract 495, the J. Spruill Survey, Abstract 1185, the J. R. Witt Survey, Abstract 1658, the J. Bolliger Abstract 2085 and the Hannibal Good Survey, Abstract 536, Parker County, Texas. At the Special City Council meeting held January 10, 2017, the Council voted unanimously to approve Resolution R2017-03 setting two public hearings on the proposed involuntary annexation along Interstate Highway 20 West which encompasses approximately 188.50 acres generally located along Spur 312 and IH-20, west of Jones Road and Dennis Road. One non-annexation agreement was offered to the property with an agriculture exemption according to the Parker County Appraisal District, as required by law. The non-annexation agreement guarantees the continuation of the extraterritorial status of the land and its immunity from annexation by the City for five years, in accordance with the agreement. Discuss and consider approval of Resolution R2017-10 setting two public hearings on the voluntary annexation of a 17.696 acres tract of land out of the R. Inman survey, abstract no. 726, Parker County, Texas; being all that certain tract of land conveyed to Stice and recorded in volume 1860, page 726, real records, Parker County, Texas. Mr. Hamrick presented this item. On January 27, 2017, the City of Weatherford received a voluntary annexation request from Mr. Todd Huckabee of Crockett National Bank concerning the 17.696 acres of land. Upon approval of Resolution R2017-10, Council will hold the required public hearings on: • Tuesday, March 28, 2017 at 6:30 p.m. • Thursday, March 30, 2017 at 11:45 a.m. The first and final reading of the ordinance will be held on April 25, 2017. Information regarding filed bills and legislation of interest to the City of Weatherford. Ms. Hayes explained that every two years when the legislature meets, staff makes an effort to track bills that will impact the City. March 10, 2017 was the deadline and approximately 8,000 bills were filed. Approximately 1,300 could affect municipalities, and 80 percent of them could have a negative impact. City staff relies heavily on Texas Municipal League (TML) to keep informed. One of the most notable bills that could affect the City is Senate Bill 1004 regarding small cell deployment. This bill allows for the installation of smaller towers throughout the City’s system which disallows the ability to control the City’s right-of-way’s. Ms. Hayes suggested that if Council is not in favor of this bill that a letter of opposition be written to the state representatives as well as any other bills the City might support or oppose. Other bills that are being closely monitored by TML are ones regarding annexations, preemption, debt, land use, ballot proposals, short-term rental, civil rights, plastic bag ban, affordable housing and offset fees. Staff will continue to track and update Council on any additional bills that might need to be supported or opposed throughout the session.
