5.a: Presentation of the Weatherford Police Department's Citizenship Award to Amber and Layla Smith. Commander Jason Hayes presented the Weatherford Police Department Citizenship Award to Amber and Layla Smith for their assistance in locating a missing individual on April 30th, 2024.

Consent agenda, approved as one vote: 7.a: Authorized the City Manager to utilize additional funds not to exceed $200,000 for contracted legal services with Taylor, Olson, Adkins, Sralla & Elam, LLP (TOASE) for the remainder of FY24. 7.b: Approved the purchase of asphalt pavement rejuvenator services, via a cooperative purchase agreement with the City of Highland Park, from Pavement Doctor Corp., LLC in an amount not to exceed $75,000. 7.c: Approved Resolution R2024-12 setting the rate per unit of electric power and water sold, and wastewater treated, to be transferred from the Municipal Utility Fund to the General Fund as gross receipts charge and a return on investment for Fiscal Year 2025. 7.d: Approved Resolution R2024-13 appointing the Chief Financial Officer as the Designated Officer for Tax Rate Calculations. 7.e: Approved the policies for General City Funding and Hotel Occupancy Tax Funding for Non-Municipal Organizations. 7.g: Authorized the City Manager to execute a contract with Yellow Rose Mapping, LLC to provide Aerial Based Topographic Survey services in an amount not to exceed $7,285 for a total aggregate fiscal year expenditure amount of $124,773. 7.h: Approved the purchase of public safety uniforms and protective equipment from Galls, LLC, under the North Texas Master Share Agreement #2021-073, for an additional $50,000. 7.f: Consider a request for final plat approval for QT 1948, being two (2) lots out of a 9.043 acre tract, generally located at the southeast corner of BB Fielder Road and South Main Street, said tract being situated in the A.M. Krouse Survey, Abstract No. 785 and the I&GN RR CO Survey, Abstract No. 1792, City of Weatherford, Parker County, Texas. SBD2024-0015. This item was removed from the Consent Agenda for separate consideration. • Danielle Ames, 3202 Oak Lane, expressed her concerns regarding the QT project. CC0625024 Page 2 of 9 On the motion of Matt Ticzkus, second by Luke Williams, the City Council voted unanimously to approve the final plat for QT 1948. The motion carried 5 - 0.

8.k: Consider moving the City Council meeting scheduled for July 23, 2024 to July 16, 2024. Item 8.k. was taken out of agenda order and considered first. On the motion of Matt Ticzkus, second by Heidi Wilder, the City Council voted unanimously to move the City Council meeting scheduled for July 23, 2024, to July 16, 2024. The motion carried 5 - 0.

8.a: Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-20, regarding a voluntary annexation of right-of-way for an approximate 8.217 acre portion of White Settlement Road and an approximate 5.986 acre portion of Pearson Ranch Road, Parker County, Texas. Senior Planner Monica Johnson presented a voluntary annexation of right-of-way regarding a portion of White Settlement Road and Pearson Rach Road and noted the annexation was in conjunction with the previously approved LaSalle Ranch land annexation and required per Texas Local Government Code Section 43.106. Mayor Paul Paschall opened the Public Hearing at 6:20 p.m. There being no speakers, Mayor Paschall closed the Public Hearing at 6:20 p.m. On the motion of Zack Smith, second by Luke Williams, the City Council voted unanimously to adopt Ordinance O2024-20, approving the voluntary annexation of right-of-way for an approximate 8.217-acre portion of White Settlement Road and an approximate 5.986-acre portion of Pearson Ranch Road. The motion carried 5 - 0. The ordinance is captioned as follows: ORDINANCE NO. 8.b: Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-21, regarding a voluntary annexation of a tract of land owned by Leverage Mockingbird L.P. Tract 1 being approximately 27.856 acres of land situated in the Will. C Kearby Survey, Abstract No. 2637, Parker County, Texas and being a portion of that certain called 44.2144-acre tract as described in Special Warranty Deed with Vendors Lein to Leverage Mockingbird, L.P., as recorded in Instrument No. 202308562, Public Records, Parker County, Texas. Senior Planner Monica Johnson explained that a portion of the proposed voluntary annexation area lies within Hudson Oaks’ ETJ and must be released before the City Council can act on this item. She noted that Hudson Oaks will consider the ETJ CC0625024 Page 3 of 9 release request on June 27th, and the applicants are requesting the City Council to table the annexation to the July 16th City Council meeting. Mayor Paul Paschall opened the Public Hearing at 6:22 p.m. There were no public comments. On the motion of Matt Ticzkus, second by Luke Williams, the City Council voted unanimously to leave the Public Hearing open and to table this item to the July 16, 2024, City Council meeting. The motion carried 5 - 0.

8.c: Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-18, regarding a request for a general plan amendment from CC Community Commercial to SL Suburban Living and a zoning map amendment from C1 General Commercial to R1 One-Family Residential on a 0.266 acre tract, generally located at 109 West Russell Street, City of Weatherford, Parker County, Texas. ZCH2024-0006. Senior Planner Monica Johnson presented a general plan amendment and zoning map amendment request for 109 West Russell Street, applicant John Chism. Mayor Paul Paschall opened the Public Hearing at 6:24 p.m. There being no speakers, Mayor Paschall closed the Public Hearing at 6:25 p.m. On the motion of Zack Smith, second by Matt Ticzkus, the City Council voted unanimously to adopt Ordinance O2024-18 approving the general plan amendment and zoning map amendment request. ZCH2024-0005. Senior Planner Monica Johnson presented a general plan amendment and zoning map amendment request for 111 West Russell Street, applicant Jason Watson. Mayor Paul Paschall opened the Public Hearing at 6:28 p.m. There being no speakers, Mayor Paschall closed the Public Hearing at 6:28 p.m. On the motion of Zack Smith, second by Heidi Wilder, the City Council voted unanimously to adopt Ordinance O2024-17 approving the general plan amendment CC0625024 Page 4 of 9 and zoning map amendment request. The motion carried 5 - 0. CUP2024-0005. Senior Planner Monica Johnson presented a request for a conditional use permit at 2610 South Main Street, applicant Kenny Russell. 8.g: Consider approval of final plans for Heritage Trails, being 188 lots on approximately 20.921 acres located on the northwest corner of Front Street and Tremont Street, City of Weatherford, Parker County, Texas. Senior Planner Monica Johnson presented the final plans for Heritage Trails, applicant Homeland Construction. • Brandon Cook, Homeland Construction President, 3209 Lakeway Drive, spoke about quality and construction plans for the project and addressed questions from the City Council. • Frank Morales, 139 Coral Reef Ct. N., Palm Coast, Florida, asset manager for the property representing DLP Capital c/o ALTA 21 LLC, affirmed a quality project. On the motion of Matt Ticzkus, second by Luke Williams, the City Council voted unanimously to approve the final plans as presented for Heritage Trails. The motion carried 5 - 0.

8.h: Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-22, regarding an amendment to the Title XII Zoning Ordinance to add "CCI" Commercial Corridor Interstate Overlay to Chapter 3 "Zoning Districts." Senior Planner Monica Johnson presented the proposed Commercial Corridor Interstate Overlay addition to Chapter 3 of the Zoning Ordinance. She reviewed the purpose, applicability, procedure, design standards, architectural guidelines, streetscape guidelines, and signs of the proposed CCI Overlay. Mrs. Johnson added that if approved, the Overlay will take effect January 1, 2025. Mayor Paul Paschall opened the Public Hearing at 6:58 p.m. • Lonnie Pennington, 110 Candle Ridge Court, expressed his concerns and opposed the proposed overlay. • John Chism, 109 Russell Street, expressed his support of the proposed overlay. There being no further speakers, Mayor Paschall closed the Public Hearing at 7:02 p.m. Consultant Jason Claunch with Catalyst Commercial addressed questions from the Council regarding the proposed height regulations in the Overlay. On the motion of Heidi Wilder, second by Luke Williams, the City Council voted unanimously to adopt Ordinance O2024-22 approving the municipal code amendment as presented with the exception of amending the height regulations in the Design Standards from five stories to four stories. 8.i: Hold a PUBLIC HEARING and consider adoption of Ordinance O2024-19, regarding a request for a zoning map and general plan amendment from Agricultural to Single Family 7.5, being 241 residential lots on approximately 114.70 acres, generally located North of the intersection of State Highway 180 and Ric Williamson Memorial Highway, City of Weatherford, Parker County, Texas. ZCH2024-0008. Senior Planner Monica Johnson explained that part of the proposed development in the zoning map and general plan amendment request is located within the ETJ of Hudson Oaks and must be released from Hudson Oaks before the City Council can take action on this item. She reviewed that Hudson Oaks will consider the ETJ release request on June 27th, and the applicants are requesting that the City Council table this item to the July 16th meeting. Mayor Paul Paschall opened the Public Hearing at 7:15 p.m. There were no public comments. On the motion of Matt Ticzkus, second by Heidi Wilder, the City Council voted unanimously to leave the Public Hearing open and to table this item to the July 16, 2024, City Council meeting. 8.j: Consider a request for preliminary plat approval for Selby Hill, being 241 residential lots on approximately 145.20 acres, generally located North of the intersection of State Highway 180 and Ric Williamson Memorial Highway, said tract being situated in the J.E Bridgeman Survey, Abstract No. 142625; Will C. Kearby Survey, Abstract No. 2637, City of Weatherford, Parker County, Texas. SBD2024-0016. Senior Planner Monica Johnson explained that, similar to Item 8.i., the applicants have requested this item be tabled until the July 16th City Council meeting to allow Hudson Oaks time to act on the request to release the property from its ETJ. On the motion of Matt Ticzkus, second by Zack Smith, the City Council voted unanimously to table this item to the July 16, 2024, City Council meeting. The motion carried 5 - 0.
