Mayor Swancy announced this item will be covered later during this meeting. Presentation by Retail Coach. City Manager Sharon Hayes announced that Retail Coach made a presentation on Thursday at the Economic Development Board Meeting; however, they were not able to attend tonight. The presentation is anticipated for the Council's second meeting in September. Mayor Swancy announced that the Council will not address the annexations tonight, that no comments will be taken on the annexations tonight, and that the dates set aside for the public hearings are September 12 and September 14. Following comments by unrecognized members of the audience, and an outburst from the audience, Mayor Swancy asked for the room to be cleared. After a brief moment, Mayor Swancy invited attendees that would be civil and act accordingly to return to the room.
Consent agenda, approved as one vote (5-0, on the motion of Dale Fleeger, second by Heidi Wilder): Approved the minutes of the City Council meeting held August 8, 2017. Approved Resolution R2017-19 authorizing the Weatherford Office of Emergency Management to accept grant funding offered by the Office of the Governor, Emergency Management Division, for an Emergency Response Trailer. Approved a request to enter into a purchase agreement with Axon Enterprises (TASER) for a 5- year purchase agreement for 41 X26P Taser Units. Approved Ordinance 853-2017-37 amending the city’s fee schedule. Approved an increase the General Fund’s full-time position count. Ratified the appointment of Lela Morris to the Weatherford Economic Development Board as the Weatherford College representative.
Hold a PUBLIC HEARING on the proposed ad valorem tax rate of $0.4992 per $100 valuation, including $0.3437 per $100 valuation for operations and maintenance and $0.1555 per $100 valuation for interest and sinking (debt service). Kyle Lester, Assistant Director of Finance, presented this item. He stated this is the first of two required public hearings. Mayor Swancy opened the public hearing at 6:41 p.m. Eva Earl Rutledge, 209 West Russell Street, asked the Council to consider a lower tax rate. As there were no other speakers, Mayor Swancy closed the public hearing at 6:43 p.m. Hold a PUBLIC HEARING and consider approval of ordinance 854-2017-38, a zoning change request for property zoned C1 Commercial to C1 Commercial with a Conditional Use Permit (CUP) to allow a tattoo service (cosmetic microblading) located 908 South Main Street, Suite F also described as Lot S 55, Block 5 in the Anderson Subdivision, City of Weatherford, Texas. ZCH2017-0019 Craig Farmer, Director of Planning and Development, presented this item. The location is on South Main and the use is for microblading which is an accessory use for a salon. Mr. Farmer noted that several salons in town provide this service as a minor part of their business. Hold a PUBLIC HEARING and consider approval of ordinance 855-2017-39, a zoning change request for property zoned RL Residential Lake Lot to RL Residential Lake Lot with a Conditional Use Permit (CUP) for an accessory dwelling located at 112 Marina View Court also described as Leasehold Lot 35 Lake Weatherford, City of Weatherford, Texas. ZCH2017-0020 Mr. Farmer presented this item as well. All lake lots are city-owned and are held by license holders. The lots 'front' on the lake side, and the rear is considered the road side. The lots have a lesser setback from the center of road. Mr. Farmer stated that this is for a residential unit above the garage. The accessory residential structure can be rented as apartment in the future. The Council can set additional conditions if necessary. Mayor Swancy opened the public hearing at 6:50 p.m. Tim Swearingin spoke on behalf of the owners stating that they have given no indication that they plan to rent it and that it is mainly for accessibility for any current or future health issues. As there were no other speakers, Mayor Swancy closed the hearing at 6:51 p.m. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to approve this item. Hold a PUBLIC HEARING and consider approval of ordinance 856-2017-40, a Zoning Change request for property zoned PD Planned Development to R1-Residential Single Family for a single-family subdivision located at the northeast intersection of Newport Road and Charles Street also described as an approximate 25.656 acre tract of land, being in the Joseph Sentell Survey, A-1245, City of Weatherford, Parker County, Texas. ZCH2017-0021 Craig Farmer, Director of Planning and Development, presented this item. Mr. Farmer stated that this property is currently zoned PD for a private school that was proposed in the past. That project did not come to fruition. This zoning case returns the property to R1 single family. Mayor Swancy opened the public hearing at 6:54 p.m. As there were no speakers, Mayor Swancy closed the hearing at 6:54 p.m. On the motion of Dale Fleeger, second by Jeff Robinson, the Council voted unanimously to approve this item. Discuss and consider adoption of ordinance 857-2017-41 amending Title IX, Chapter 14 Public Rights of Way Management ordinance enacting amendments for network facilities (small cell infrastructure) to comply with Chapter 284 of the Texas Local Government Code. Manny Palacios, Director of Transportation and Public Works, presented this item. He spoke about SB1004 which has been passed and goes into effect on September 1. The law creates chapter 284, a new chapter in the Texas Local Government Code. The ordinance and design manual allow the city some control over locations and aesthetics. Up to five cell vendors can be located on one pole; however, no one else can be located within 300 feet of that pole. If it is a small pole, staff will review the engineering design to make sure the pole can hold the weight. The fee schedule approved in this meeting's consent agenda is the maximum that the city can charge. Discussion included whether the city should build/own infrastructure for this purpose; that this small cell infrastructure will not replace structures located on city water towers; that the vendor has liability if it is their pole; that the city is liable if managing their structure on a city pole; that each pole is connected with underground fiber; that rights of way will be torn up while the vendor is laying their fiber; that the city is prohibited from running fiber for [...]
Consider a request for a final plat for Phase I of the Johnson Estates Subdivision, located at the most southerly extension of Cherry Street, Jade Lane, and Allen Street, more generally described as being in the Oliver Davis Survey A-372, and the Sarah Monk Survey, A-906, City of Weatherford, Parker County, Texas. SBD2017-0037 Mr. Farmer presented this item as well. He stated that the Council has previously seen the master and preliminary plats for this project. This subject property has a substantial amount of floodplain. The applicant wants to build one house. Some waivers were granted in the master and preliminary plat stages and the applicant has met all requirements. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the final plat. Motion carried 5 - 0.

Mr. Lester reviewed updates to the budget since the last Council meeting: • Added • Funding for PCAD charges: + $18,076 • CitySourced Request (311 enhancement): +$6,000 • Needed IT Storage Space: +$6,000 • TOTAL: +$30,076 • Changed • 3-year transfer of $50k to Animal Shelter Fund changed to non-recurring; will budget transfer if funds are available in FY19 and FY20 There is nothing in the animal services contract with Parker County that would require them to contribute to the animal shelter’s road project. The plan was to move $50k over the course of three years to proceed with the road around the shelter. The first year will be out of one-time funds. The second and third years will be determined when those budgets are set.
