Consent agenda, approved as one vote (5-0, on the motion of Kevin Cleveland, second by Matt Ticzkus): Approved the minutes of the City Council meeting held August 9, 2022. Authorized the City Manager to execute Amendment No. 3 to the Development Agreement with Castlemont Homes for dedication of land to the City of Weatherford. Approved renewing Bid #2019-024 for annual concrete work to Devil Dog Concrete Construction based on lowest most responsive overall bid for combined concrete work not to exceed $392,950. Approved a Bank Depository contract to Plains Capital Bank, located in Weatherford, beginning November 1, 2022 and ending October 31, 2024. The contract may be extended for three (3) additional one-year periods under the same terms and conditions. Approved Resolution R2022-21 designating the Weatherford Democrat as the official newspaper for the City of Weatherford's legal publications for Fiscal Year 2022-2023. Approved a preliminary plat for the Wendy Lane Acres subdivision, 5 lots on 3.84 acres located at 1414 Wendy Lane, City of Weatherford, Parker County, Texas, SBD2022-0041, on recommendation of the Planning and Zoning Commission (PZC), subject to all requirements of the subdivision regulations and, specifically, the following conditions: 1. All sheets, including any civil plans incorporated into the proposed subdivision sheet(s), shall include title block. Sec. 11-4-3(d) 2. Show location and width of proposed sidewalks. Sec. 11-4-4(c) 3. Show location of proposed centralized mail collection location. Sec. 11-4-4(d) 4. The plat shows two lots labeled as Lot 1. Revise. 5. Show and provide dimensions for the existing Wendy Lane right-of-way. Sec. 11-4-5(a) 6. If the existing Wendy Lane right-of-way is less than 50’, dedication will be required. Sec. 11- 6-2(c) 7. Provide a statement of improvements that will be installed by the developer and a timeline when such improvements will be completed. Sec. 11-4-6(d) 8. Perimeter street improvements are required along Wendy Lane. EDCM 2.1.7 9. A downstream drainage assessment documenting the effects of the increase in stormwater runoff is required. If adverse effects are identified, mitigation will be required. EDCM 3.6. Approved a request for a final plat for the Wendy Lane Acres subdivision, 5 lots on 3.84 acres located at 1414 Wendy Lane, City of Weatherford, Parker County, Texas, SBD2022-0042, on recommendation of the PZC, subject to all requirements of the subdivision regulations and, specifically, the following conditions: 1. The plat shows two lots labeled as Lot 1. Revise. 2. Show and provide dimensions for the existing Wendy Lane right-of-way. Sec. 11-5-2(m) 3. If the existing Wendy Lane right-of-way is less than 50’, dedication will be required. Sec. 11- 6-2(c) 4. Include a note on the plat stating all pre-existing easements and/or dedications have been vacated or incorporated into the creation of this plat. Sec. 11-5-2(m) 5. Public improvements are required to be accepted before the final plat is recorded. A subdivision improvement agreement and surety are required to record the plat prior to acceptance of public improvements. Sec. 11-5-9(c)(1-2) 6. Hold a PUBLIC HEARING and consider adoption of Ordinance O2022-19 on the voluntary annexation of Tricor/South Bowie Trails an approximate 36.360 acres of land, more or less, situated in the Ferdinand Emma Survey, Abstract Number 421, in Parker County, Texas, and being a portion of Tract 1 described by deed to South Bowie Investments Partners, LP, as recorded under Volume 2385, Page 571, Official Public Records of Parker County, Texas, to enlarge and expand the boundaries of the City of Weatherford. (The applicant has requested this item be withdrawn.) Director of Development and Neighborhood Services Kaleb Kentner presented this item. Mr. Kentner stated that the application has been withdrawn; however, it was published as a public hearing. Mayor Paschall opened the public hearing at 6:33 p.m. As there were no speakers, Mayor Paschall closed the hearing at 6:33 p.m. No action was taken on this item. Hold a PUBLIC HEARING on the City Manager's Proposed FY23 Budget. Finance Director Dawn Brooks presented this item. Mrs. Brooks stated that by state law, the City is required to hold a public hearing on the budget. The budget has been properly filed with the City Secretary, notice of the hearing was published in the Weatherford Democrat and the budget has been placed in the City Hall lobby, the library, and on the City’s website for public review. Hold a PUBLIC HEARING and consider a request for a general plan and zoning map amendment from SF 7.5 Single-Family 7.5 Residential, AG Agriculture, and C1 General Commercial to SF 7.5 Single-Family Residential with a P Planned Unit Development overlay for a residential development on seven tracts totaling 123.90 acres, located on the west side of South Bowie Drive between Navaho Street and Newport Road, City of Weatherford, Parker County, Texas. ZCH2022-0010. (This application has been withdrawn.) Planner Brandon Fross presented this item. Prior to the August 10th, 2022, PZC meeting, the applicant formally requested to withdraw their zoning amendment request. Mayor Paschall opened the public hearing at 6:50 p.m. As there were no speakers, Mayor Paschall closed the hearing at 6:50 p.m. No action was taken on this item.
Consider naming the Public Safety Building Multipurpose Room in honor of Jerry L. Blaisdell. Assistant City Manager Lance Arnold presented this request providing a brief history of Mr. Blaisdell's career. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Vote to Propose the City of Weatherford Property Tax Rate for FY23. Finance Director Dawn Brooks presented this item. Before proceeding with the required public hearing, the governing body must hold a recorded vote to propose a tax rate for FY23. The FY23 proposed budget recommends setting the City's property tax rate at $0.4581 per $100 valuation. This rate is $0.001756 (0.3%) higher than the to the no-new-revenue tax rate of $0.456344 per $100 valuation and $0.0387 (19.1%) less than the voter approved rate of $0.566353 per $100 valuation. A public hearing for this proposed rate will be held September 13, 2022 and a vote to adopt the rate will also be held the same date; as the adoption of the tax rate is required to be held within seven days of the public hearing. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to propose a tax rate of 45.81 cents per $100 of valuation for the Fiscal Year 2023 budget. Motion carried 5 - 0.
Receive recommendation regarding funding outside agency requests for the City's FY23 Budget. Finance Director Dawn Brooks presented this item as well. The City received the following requests: Organization General Fund Hotel Tax Fund CASA Hope for Children $5,000 - Chamber of Commerce - $101,000 Children’s Advocacy Center of Parker County $5,000 - Doss Heritage and Cultural Center $5,000 - Freedom House, Manna Storehouse $5,000 - Parker County Committee on Aging $5,000 - Total: $25,000 $101,000 On the motion of Kevin Cleveland, second by Heidi Wilder, the Council voted unanimously to approve these requests as presented. Motion carried 5 - 0.
Consider authorizing the City Manager to execute a contract with Graham Associates, Inc. for professional consulting and engineering services related to Weatherford regional transportation strategy, implementation and funding needs. Director of Capital Projects Chad Marbut presented this item. Mr. Marbut explained that through this contract Graham Associates will provide resources, expertise, and advocacy in support of Weatherford's interests as we compete for regional infrastructure funds. On the motion of Heidi Wilder, second by Matt Ticzkus, the Council voted unanimously to approve this item. Motion carried 5 - 0.
