Proclamation naming September 2019 as Suicide Prevention Month in Weatherford. Mayor Pro Tem Heidi Wilder presented the proclamation to Ms. Erica Chilcutt who is on the board of the American Foundation for Suicide Prevention.

Consent agenda, approved as one vote (5-0, on the motion of Curtis Tucker, second by Kevin Cleveland): Adopted Resolution R2019-20 authorizing representation in an IRS matter and delegating authority to execute form 2848 IRS Power of Attorney. Adopted Resolution R2019-19 sponsoring the application for funding from the Texas Department of Transportation for the Bose Ikard Elementary School Safe Routes to School infrastructure project. Adopted Ordinance O2019-43 amending the City's FY19 General City Budget.

Hold a PUBLIC HEARING and consider approval of Ordinance #O2019-42 for an amendment to Title XII – Zoning Ordinance: Chapter 4. Use Charts to amend the drinking establishments with less than 50% food sales in Sec. § 12-4-3 Use Charts to align with new Texas Alcoholic Beverage Commission (TABC) rules, and Title XII – Zoning Ordinance: Chapter 1. Enacting Provisions to amend related definitions. MCA2019-0001. City Planner Stan Hamrick presented this item, which is a proposed municipal code change to the zoning title. This proposed changed amends the zoning ordinance as follows: • Removes the conditional-use permit requirement for brewpubs in the central business (downtown) and C2 (interstate corridor) districts and updates the definition from a micro-brewery to a brewpub to align with TABC definitions. • Removes the private club and food requirements from drinking establishments and updates the definition to align with TABC definitions. Staff recommended approval. The Planning & Zoning Commission voted 6-1 to recommend approval at its meeting held August 14th. Mayor Paschall opened the public hearing at 6:40 p.m. As there were no speakers, Mayor Paschall closed the public hearing at 6:40 p.m. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this item. Motion carried 5 - 0.

Hold a PUBLIC HEARING on the proposed ad valorem tax rate of $0.49 per $100 valuation, including $0.3414 per $100 value for operations and $0.1486 for interest and sinking (debt service.) Finance Director Kyle Lester presented this item. On August 13th, the City Council voted to propose a tax rate for FY20 of $0.49 per $100 valuation, including $0.3414 per $100 value for operations and $0.1486 for interest and sinking (debt service). The City Manager's proposed budget is based on a tax rate of $0.4879; however, the City Council has allowed for the possibility of a higher rate, should that be deemed necessary. No action is required at this time; the second and final public hearing on the tax rate for fiscal year 2020 will be held on September 10, 2019. Mayor Paschall opened the public hearing at 6:42 p.m. As there were no speakers, Mayor Paschall closed the public hearing at 6:42 p.m.

Consider a FINAL PLAT, including waivers from certain requirements of Weatherford Municipal Code Title XI, Subdivision Ordinance, including Sec. 11-3-1(c)(4): two points of access from public roads to the subdivision; Sec. 11-3-1(h)(2): maximum 20 percent of collector street fronted by residential lots; Sec. 11-3-1(o): maximum block length of 1,600 feet; Sec. 11-3-1(p): maximum cul- de-sac length of 600 feet; Sec. 11-3-9(a): connection to City’s water system; Sec. 11-3-9(b): connection to City’s wastewater collection and treatment system; Sec. 11-5-5(a): improvement to substandard arterial street and future collector street; and Sec. 11-5-7(a)(1): side/rear yard screening along existing and future collector-or-above roadways, for the 43-lot Stagecoach Ranch addition, located on North Farm to Market Road 51, near its intersection with Misty Ridge Lane, and being 190.9 acres situated in the William W. Consider a FINAL PLAT for the one-lot Grand Adventure Addition, located at 2065 Tin Top Road and described as being four (4) acres situated in the T.W. Beall Survey, Abstract No. 166 and the J.L. Detiste Survey, Abstract No. 369, City of Weatherford, Parker County, Texas. SBD2019-0038. City Planner Stan Hamrick presented this item. The applicants have requested final plat approval for the one-lot Grand Adventures Addition, a 4-acre tract under development as an amusement facility. Preliminary plat and development agreement for the construction of the sewer extension was approved November 13, 2018. The applicant has completed the required improvements under the agreement and the City has accepted them. Staff recommended approval with the condition that, prior to filing the plat, the applicant must update the approval block to include correct language for a final plat: "Approved by the City of Weatherford for filing at the office of the County Clerk of Parker County, Texas." Consider authorizing the City manager to execute a supplemental agreement to an existing professional services contract with Pacheco Koch, LLC for the Interstate Access Justification Report at Interstate Highway 20 and Bethel Road. Director of Capital Projects Terry Hughes presented this item. He stated that Weatherford contracted with Pacheco Koch to conduct an Interstate Highway Access Justification Report (IAJR) for on/off ramps on I- 20 just east of Bethel Road. The IAJR was included in the TIRZ No. 1 project list because of the ramping system’s importance to traffic safety and economic growth and having an IAJR positions Weatherford to pursue funding for construction from the North Central Texas Council of Governments (NCTCOG). The initial work for the IAJR was based on a ramp design that would serve the area at Bethel Road (FM 1884). The initial report and schematic design were presented to TxDOT and Federal Highway Administration (FHWA) for review. After their review, FHWA expanded the schematic design requirements to include auxiliary lanes between Bethel Road and the ramps for South Main Street and report requirements to include a study area that extends west to South Bowie Drive, east to SH 171, north to South Main Street and south to BB Fielder Drive. Hold a Work Session to discuss the feasibility and options for a hotel/convention center. Trent Petty with Petty and Associates presented this information. He stated that Chapter 351.102(e) of the Texas Tax Code allows cities to pledge revenue using state and local hotel occupancy taxes, sales taxes and alcoholic beverage taxes to construct a hotel and convention center in which: 1. City owns the land under the hotel 2. City owns the convention center 3. Convention center must be located within 1,000 feet of the hotel Eligible projects receive a 10-year rebate of state hotel occupancy taxes and a significant portion of sales and alcoholic beverage taxes. The City must secure a qualified project (have a development agreement approved) by September 1, 2023 and must comply with Comptroller Rules 34 TAC § 3.12. The City must identify an acceptable hotel “flag” willing to operate the convention center Mr. Petty explained the basic structure of the development agreement options: Option 1. Master Developer Secured • Landowner secures and entitles area large enough to support project and desirable mixed uses • Hotel developer performs hotel feasibility study • City agrees to incentivize using a portion of the revenue from the project to reimburse hotel and convention center eligible expenses • City purchases land necessary to support hotel and convention center • Hotel developer [...]
