Consent agenda, approved as one vote (5-0, on the motion of Jeff Robinson, second by Kevin Cleveland): Approved the minutes of the City Council meeting held January 9, 2018. Adopted Resolution R2018-01 ordering the May 5, 2018 General Election, authorizing the Mayor to execute the “Notice of General Election”, and authorizing the Mayor to contract with the Parker County Elections Administrator to administer early and Election Day voting. Approved Resolution R2018-02 authorizing the Weatherford Police Department to apply for grant funding offered by the Office of the Governor, State Homeland Security Program (SHSP) for night vision goggles for our local Special Weapons and Tactics (SWAT) team known as the Weatherford/Parker County Special Operations Group (SOG). Approved the Business Retention and Expansion Policy. the following items on the Consent Agenda. Motion carried 5 - 0.

Duncan Survey, Abstract 391, and the W.M. Cozart Survey, Abstract 245, and being a portion of a called 5-acre tract of land describes in the contract of sale and purchase as recorded in volume 1878, page 1449, Real Records, Parker County, Texas. Hold a PUBLIC HEARING and consider approval of ordinance 889-2018-04, a request for a zoning district change to allow a C-1 Commercial to an R-1 One-Family Residential Zoning District at a property described as being a portion of Block 2, J.G. Batte’s Subdivision of the Oliver Davis Survey, Abstract 372, and located at 206 S. Tower Street in the City of Weatherford, Parker County, Texas. ZCH2017-0039. Mr. Farmer presented this item as well. This property has been used as residential for years. The applicant is trying to sell the property but is experiencing difficulty since it is zoned commercial. Hold a PUBLIC HEARING and consider approval of ordinance 890-2018-05, a request for a zoning district change to allow an R1 One-Family Residential to a PD Planned Development Zoning District for Multi-Family at a property located on the north side of the approximate 3000 block of East Bankhead Highway and described as being a 32.03 acre tract of land, containing 19.92 acres, out of the L.P. Duncan Survey, Abstract 391, as recorded in Volume 2002, page 38, Deed Records, City of Weatherford, Parker County, Texas. ZCH2016-0007. Mr. Farmer presented this item as well. He stated this item was tabled more than a year ago awaiting adoption of the General Plan. The Planning & Zoning Commission (PZC) discussed a second way in/out at length and the applicant's representative, Mr. Chuck Stark, stated there will be an all-weather emergency access from day one. The total number of units is 256 with a density of approximately 15.6 per acre. New elevations were provided. The development includes a recreation center, pool, and other amenities. The applicant is providing carports and garages. The breakdown of apartment size is approximately 40 percent 1-bedroom; approximately 40 percent 2-bedrooms; approximately 20 percent 3- bedrooms; and no efficiency units. ZCH2017-0042. Mr. Farmer presented this item. The applicant requested this item be tabled until the next PZC on January 24th. The Commission voted 5 - 0 to table this item until its next meeting. Receive Quarterly Financial Report and discuss and consider approval of Ordinance 891-2018-06 for Budget Amendments for fiscal year 2018. Kyle Lester, Assistant Director of Finance, presented this item. After the first quarter of each year, City staff takes an inventory of all items that were budgeted for the previous fiscal year, but were unable to be spent. These items are subsequently added to the current year’s budget in order to complete the originally planned projects, with priority given for projects with active purchase orders. For FY18, these items total $1,495,963. A brief synopsis of these roll-over items are as follows: a. $500k originally budgeted for land purchase in FY17. This item will be rolled into non-departmental and transferred into the General Capital Projects fund for use on the City’s Capital Improvement Plan (CIP). b. $300k for potential economic development agreement payments. As of the end of the fiscal year, $150k remained unspent. Staff would like to add that to the FY18 budget for potential economic development payments. After this year, any amount left over will be designated as a reserve for future payments. c. Jeff Robinson and Kevin Cleveland voted in opposition. Consider and/or act upon approval of a contract with Ana Site Construction, LLC for the construction of the Upper Holland Lake Watershed Regional Detention System for an amount not to exceed $715,955.00. Terry Hughes, Director of Capital Projects, presented this item. Design work for an underground storm water system that will connect the Trace Ridge Addition, Lockwood Addition and Hidden Lake Estates to a regional detention system was completed in November 2017. The project was advertised and bid in the same month. The city received four qualified bids ranging $715,955 to $877,703. The low bidder was Ana Site Construction, LLC from Pilot Point, Texas. The low bidder is experienced in storm water construction work and has a number of references. Funds are available in the Storm Water Utility Fund. The existing pond will be redesigned when the future Hidden Lake Estates is developed. The pond will be retained, and the aesthetics will be improved. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Discuss and consider approval of Resolution R2018-03 of changes and recommendation for adoption of the 2018 General Plan. Mr. Farmer presented this item. He spoke about the development of the General Plan. He thanked PZC members Allison Baker and Todd Spinks, Ph.D. for their detailed input into the final product. The plan is a large document because it is a reference document. It incorporates high-level plans from other city departments. Mr. Farmer spoke about the possibility of amending the General Plan to include a 2050 urban boundary and ETJ (extra territorial jurisdiction) which will include discussion about future annexations and the possibility of releasing portions of the city's ETJ. Mr. Farmer introduced Karen Walz with Strategic Community Solutions. Ms. Walz reviewed the technical aspects of the plan. Mr. Farmer discussed the implementation strategy in exhibit 12.1. The top 10 short-term actions include: The top 10 long-term actions include: A successful plan will change. It was suggested that those who participated in creating the plan be resurveyed in approximately one year to ensure priorities are still the same. On the motion of Dale Fleeger, second by Jeff Robinson, the Council voted unanimously to move forward with the General Plan and to approve it as is and modify it as needed. Motion carried 5 - 0.
Mayor Swancy called for a 10-minute recess. The Council reconvened at approximately 8:35 p.m. Consider a request for a final plat for Lots 2R-6R, Block 41, in the 1400 Block of Lexington Street at the intersection of Fifth Street, of the Carter’s Addition, an addition to the City of Weatherford, Parker County, Texas, John Trimble Survey, Abst. 1293. SBD2017-0027. Mr. Farmer presented this item stating that staff and the PZC recommended approval. On the motion of Kevin Cleveland, second by Jeff Robinson, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Consider a preliminary plat for Lots 1 through 20, block 1; Lots 1 through 13, Block 2; Lots 1 though 3, Block 3 Prince and Park Addition, situated between South Tower Street and Cherry Street at the southernmost extensions of East Columbia Street, Windmill Meadows Addition. SBD2017-0046. Mr. Farmer presented this item. The lots meet or exceed the city’s requirements for width, area, and footage; however, the applicant requested waivers for lot depth on Lots 10, 11, and 14 of block 1, and Lots 9 and 10 of block 2. The PZC voted unanimously (5 - 0) to recommend approval with waivers for lot depth at its January 10th meeting. Heidi Wilder voted in opposition. Consider waivers for a minor plat for a property described as being 9.074 acres out of the D. Harry Survey, Abstract 627, located in the 2600 Block of Greenwood Road within the Extraterritorial Jurisdiction (ETJ) of the City of Weatherford, Parker County, Texas. SBD2017- 0056. Mr. Farmer presented this item as well. The project requires waivers for the requirement for city water and sewer extensions. Staff supports both waivers. If waivers are granted, the plat will proceed with the minor platting process. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve the minor plat with waivers. Motion carried 5 - 0.
Discuss and consider the awarding of a contract for the construction of Town Creek Hike and Bike Trail Phase II to C. Green Scaping, LP in the amount of $951,652.60. Mr. Hughes presented this item. The city opened bids for the Town Creek Hike and Bike Trail, Phase II on December 12, 2017. The trail was nominated for funding through the North Central Texas Council of Governments (NCTCOG) and the Texas Department of Transportation (TxDOT) utilizing the Transportation Alternatives Program (TAP) in May 2014. The TAP is an 80/20 funding program designed to augment safe and convenient transportation alternatives within a community. The city received three bids for the project and all bidders were to be prequalified by TxDOT prior to bidding. Two of the three bidders did not meet the prequalification requirement and were considered non-responsive, which leaves a single bidder. The C. Green Scaping, LP bid is within two percent of the engineer’s opinion of cost and the engineer recommends award of the contract to C. Green Scaping, LP in the amount of $951,562.60. The city's portion of the contract is $190,312.52. This traffic light will be located at Holland Lake and Santa Fe and staff is requesting the traffic light be installed before the trail is constructed. Discuss and consider approval of an Interlocal Agreement with the North Central Texas Council of Governments to perform a flood risk study along 9.6 miles of Town Creek within the City of Weatherford. Mr. Hughes presented this item. NCTCOG received Federal Emergency Management Administration (FEMA) funding to assist and partner with local governments to provide a flood risk assessment study within certain watershed areas in the region. The Town Creek Watershed is one of the watersheds selected for the study and the interlocal agreement provides for city and federal funding. The city's portion of the study is $72k. The federal funding portion would be $216k. The final product will include a flood risk report, flood risk map, and flood risk database. The study will be based on updated and current watershed conditions and will identify possible risk and mitigation areas and areas. Funds are available in the storm water utility fund. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the interlocal agreement with NCTCOG on the flood risk study for Town Creek. Motion carried 5 - 0.
Discuss and consider approval and funding of an Advanced Funding Agreement with the Texas Department of Transportation for the design and construction of a traffic signal at the intersection of BB Fielder Road and FM Highway 1884. Mr. Hughes presented this item. The city has been in discussion with TxDOT concerning the safety of the intersection of B.B. Fielder Road and FM Highway 1884 for several months. The Local Project Advanced Funding Agreement for state project CSJ 1601-02-032 will commit the City to funding a traffic signal at the intersection and commit TxDOT to designing and constructing the signal. FM Highway 1884 is scheduled for a complete upgrade to a five-lane urban section highway by 2023 and the new signal will be designed to accommodate the new section of highway. Construction is scheduled for this summer. The Advanced Funding Agreement is in the amount of $150,000. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve the advance funding agreement for design and construction of the traffic light at B.B. Fielder and FM Highway 1884. Motion carried 5 - 0.

Staff report on the Data Driven Approaches to Crime and Traffic Safety Operational Model. Police Chief Lance Arnold presented this report which was for informational purposes only. Chief Arnold stated he is familiar with this model and that TxDOT is encouraging the use of this model. There will be more traffic stops. Positive outcomes are realized in both large and small cities. Of reported incidents, theft/property crimes are the highest crime. Persons crimes are low. Both survey respondents and officers reported that illicit drug use is the biggest problem in Weatherford. There are very few random violent crimes in Weatherford. Most drug arrests come from traffic stops; very few come from houses unless the police are called for a domestic disturbance. No action was required or taken. Presentation of the City's 2017 Annual Report. City Manager Sharon Hayes provided copies of the Annual Report to the City Council.
