Statement of support for law enforcement. Mayor Hooks issued a statement of support for law enforcement for their essential role in safeguarding our freedoms and for facing dangers every day. He stated that the Council is proud to stand with law enforcement and encouraged all citizens to express their gratitude to the Weatherford Police Department and all the agencies that serve to protect our lives, rights and freedoms. Proclamation naming September 11 as Patriot Day. Mayor Hooks proclaimed September 11, 2015 as Patriot Day in the City of Weatherford and issued copies of the proclamation to Police Chief Mike Manning and Fire Chief Paul Rust in memory and support of first responders. Proclamation naming September 17-23 as Constitution Week. Mayor Hooks proclaimed September 17-23, 2015 as Constitution Week in the City of Weatherford and issued the proclamation to representatives of the local chapter of the Daughters of the American Revolution (DAR). The DAR invited everyone to attend their program at the Weatherford Public Library on Thursday, September 17 at 2:00 pm where they will feature music from the colonial times, including flutes, harps, and mountain dulcimers. Hold a public hearing on the proposed ad valorem tax rate of $0.4866 per $100 valuation, including $0.3150 per $100 valuation for operations and maintenance and $0.1716 per $100 valuation for interest and sinking (debt service). Kyle Lester, Budget and Strategic Planning Manager, introduced this item. This is the second of two required hearings. Discuss and consider outside agency funding requests via General Fund (GF) and Hotel Occupancy Tax (HOT) Revenue. Mr. Lester presented this item. The following GF requests have been made and total $77,050: Freedom House: $20,000; Manna Storehouse: $10,000; Crossroads Ministry: $6,000; Center of Hope: $6,050; Parker County Committee on Aging: $35,000. On the motion of Craig Swancy, second by Dale Fleeger, the Council voted to approve the GF requests. Motion carried 4 - 0.
Mr. Robinson recused himself from this vote. The following HOT Fund requests have been made and total $136,400: Doss Heritage & Culture Center: $30,000; Weatherford Chamber of Commerce: $106,400. Mr. Lester inquired about whether the Council would like to include $25k for Peach Festival overtime again this year. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve the HOT fund requests including $25k for the Chamber of Commerce for Peach Festival police expense. Motion carried 5 - 0.
Consider a Master Plat for Lakeway Estates, Phase II Addition, for property located north of Lakeway Drive, between Red Eagle Trail and West Lake Drive, City of Weatherford, Parker County, Texas. SBD2015-0008 Craig Farmer, Director of Planning and Development, presented this item. This is an 84 acre tract with 115 proposed lots beginning at 1.5 acres in size. The zoning is R-1 single family. Mr. Farmer explained that this item is technically a re-plat; the property was originally platted in 1959 and is referred to as a 'paper' plat because nothing was ever built under the original plat. One adjacent property owner, Mr. Martinez has been working with the developer, Tony Aaron, regarding right-of-way issues. CC090814 Page 2 of 4 Staff's recommendation is to approve this master re-plat, subject to the public hearing process on the preliminary and final plat, and subject to adjustments reflecting the developer's resolution of the right-of- way situation with Mr. Martinez. Mr. Farmer spoke about the waiver request for the number of allowable lots that front on Red Eagle Trail. According to the City's ordinances, lots should not front on a collector road. Mr. Farmer stated that the developer will work with the City regarding these lots; however, if the developer will lose lots, then the Planning and Zoning Commission recommended the waiver be granted. Consider and/or act upon approval of a Joint Operating Agreement with Parker County Emergency Services District (ESD) #3. Fire Chief Paul Rust presented this item. For the last 18 months, the City has been working under an agreement with ESD #3; currently the City is working under an extension of that agreement. The new agreement is for a 10 year period. Funding is based upon a share of the ESD #3 tax rate. Their cap is a 10 cent property tax rate and 4.815 cents of the 10 cents will come back to the City as a service provider. Operations will continue as they have for the last 18 months. The City receives an annual payment from the ESD and as their property values increase the payment will increase proportionately. On the motion of Heidi Wilder, second by Craig Swancy, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Consider and/or act upon approval of the Rules of Procedure for the City Council, Municipal Utility Board and the Boards, Commissions, and Committees of the City of Weatherford, as amended. City Secretary Malinda Nowell presented this item. Mrs. Nowell stated that the Rules of Procedure were first adopted in June 2012. Since Mr. Fleeger is new to the City Council this year, staff presented a copy of the Rules for review on August 11. Staff suggested minor amendments, which primarily pertained to the Agenda Order. Capitalization issues and other items as presented in the redline copy. Prior direction per the Council in August 2014 was that Council meetings would begin at 6:30 p.m. with work sessions and executive sessions being held after the regular session. On August 11, 2015, Council indicated some interest in moving the start time to 7:00 p.m. with occasional work sessions held at 6:00 p.m. Staff has received no other suggestions or comments from Council since the presentation on August 11. Council consensus was to maintain meeting start times at 6:30 p.m. with work sessions and executive sessions held after the regular session. On the motion of Craig Swancy, second by Jeff Robinson, the Council voted unanimously to approve the amended Rules of Procedure. Motion carried 5 - 0.
Consider appointments to the Animal Shelter Advisory Committee. On the motion of Craig Swancy, second by Jeff Robinson, the Council voted unanimously to appoint Dr. Kevin Buchanan for his first full term in the veterinarian position. Motion carried 5 - 0.
