Proclamation naming November 11, 2018 as Veterans' Day in the City of Weatherford. Mayor Swancy issued the proclamation to members of the American Legion.
Consent agenda, approved as one vote (5-0, on the motion of Jeff Robinson, second by Kevin Cleveland): Approved the minutes of the City Council meeting held October 9, 2018. Authorized the City Manager to renew a support contract with Tyler Technologies for a financial management suite.
Hold a PUBLIC HEARING and consider a request for a zoning district change from AG Agriculture to an AG Agriculture with a Conditional Use Permit (CUP) for a Commercial Animal Enterprise on less than 10 acres at a property located at 220 Otto Drive and described as being 4.96 acres, located in the John McCullough Survey, City of Weatherford, Texas. ZCH2018-0018. On the motion of Kevin Cleveland, second by Curtis Tucker, the Council voted unanimously to remove this item from the table. Motion carried 5 - 0.
Director of Development and Neighborhood Services Craig Farmer presented this item. City Council asked the Planning & Zoning Commission (PZC) to re-examine this case based on new information the Council received at their meeting on September 25th. Commissioners reviewed the information at the Planning and Zoning meeting held October 10th but took no action, thereby leaving their previous recommendation of denial in place. Staff's original recommendation of approval remains unchanged. The applicant considered a number of sites over the past few years. The proposed site is located at the end of Otto Drive. Due to the remote nature at the end of the road, staff did not require many improvements. The CUP is specifically for dog kennels for overnight boarding. The outer runs and play areas for the animals are covered. Staff supports the request for a CUP. The site is suitable for the use with no major issues and aligns with the General Plan. Juanita Myers, 5201 Partridge Road, Fort Worth, spoke regarding this project. Ms. Myers stated they did purchase the property before the General Plan was adopted and they have done everything staff has requested. The business will utilize City water instead of the well that is onsite. They are ready to start construction now and really want to be in the City. Heidi Wilder and Jeff Robinson voted in opposition. Conditions in the referenced document were as follows: • Small business that will primarily function as a dog and cat boarding facility with indoor/outdoor kennels with the option of expanding to include grooming in the future • 25% of kennels will be dedicated to a 501(c)(3) dog and cat rescue organization (Mutts & Mittens) • Hours of operation tentatively set for 7am-6pm weekdays, Saturday 8am-12pm, and Sundays by appointment • Attendant will be onsite during overnight hours to monitor animals • Occasional scheduled weekend events to include customer appreciation functions, adoption events for rescue organization, seminars, dog training, etc. • Approximately 6,384 square foot one-story haydite block building with insulated walls and 10- foot ceiling with a pitched roof with a 1,200 square foot brick office/lobby attached to the front • Interior of kennels will be divided into sections of 10 kennels per room in order to mitigate potential noise issue • Six-foot privacy fence will be placed around the perimeter • Exterior motion detector lighting placed at the front and back of the building at the roofline with lights directed away from neighboring properties • Fire sprinkler system will be installed inside the building and kennels as required per city code • Permits will be obtained as required by Animal Control Authority • [...]
Hold a PUBLIC HEARING and consider approval of Ordinance 931-2018-46 for a zoning change for property currently zoned AG Agriculture to I Industrial with a Conditional Use Permit for a Transfer Station for property located at 3306 Old Brock Road and described as being an approximate 14.638 acre tract of land in the I.C. Spence Survey, Abstract 1193 and the S.F. Jones Survey, Abstract 748, City of Weatherford, Parker County, Texas. ZCH2018-0022. Mr. Farmer presented this item stating that the Council has seen a similar case before and that it was withdrawn by the applicant in 2017. This is a new case. The previous case was for the expansion of the landfill and for a transfer station. The request is now only for the transfer station. Mr. Farmer stated that the property was annexed in 2017 as part of the western annexation along IH-20. Before that, the property was in unincorporated county area and was not subject to the zoning regulations of the City. Mr. Farmer briefly explained the processes conducted at a transfer station. This type of zoning request does require a CUP. Staff recommended approval to the PZC with the following conditions: a. Screening to effectively restrict 75 percent of the view to adjoining property and public roads to a height of not less than eight (8) feet consisting of a wall; fence; earth berm; or densely planted evergreens. b. Hold a PUBLIC HEARING and consider approval of Ordinance 932-2018-47 for a zoning district change from C1 Commercial to CBD Central Business District for antiques storage and sales at 202 W. Bridge Street, and described as being 0.186 acres and a part of Lot 4, Block 39, City of Weatherford, Texas. ZCH2018-0023. Mr. Farmer presented this item as well. He stated that C1 zoning has larger setbacks and parking requirements. Other properties in the area were rezoned to remove those setbacks and parking requirements. The applicant has requested rezoning to CBD which is the same zoning as present across the street from this subject property. The PZC recommended approval 7-0. Mayor Swancy opened the public hearing at 8:42 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 8:42 p.m. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve the ordinance for the zoning district change. Hold a PUBLIC HEARING and consider approval of Ordinance 933-2018-48 for a zoning district change from I Industrial to a Planned Development (PD) for the Eureka Street Townhomes Subdivision, a 50-lot townhouse development, located in the 1000 block of E. Eureka Street, and described as being a 13.869 acre tract in the John E. Miller Survey, Abstract 890, City of Weatherford, Texas. ZCH2018-0024. Councilman Curtis Tucker recused himself from this discussion due to potential conflict of interest. He stated that a signed affidavit has been provided to the City Secretary. Mr. Farmer presented this item. The General Plan calls for ‘suburban living’ density. The applicant is interested in patio homes with a zero lot line on one side. The PD will be for R2; however, the applicant is only proposing patio homes. The PZC considered the site plan and recommended approval by 7-0. Mayor Swancy opened the public hearing at 8:45 p.m. Scott Crawford, 12409 Bella Vineyard Drive in Fort Worth, spoke on behalf of the applicant. Mr. Crawford, an engineer with BHB, stated he did the civil layout and will be doing the civil planning for this property. With regard to the railroad, Mr. Crawford stated that Mr. Teague is comfortable building this type of product in this location. Mr. Tucker recused himself. Hold a PUBLIC HEARING and consider approval of Ordinance 934-2018-49 amending Title XII – Zoning Ordinance: Chapter 2. Zoning Procedures and Administration to address non- conforming single-family residences in §12-2-2 Non-conforming uses and structures. MCA2018- 0001 Mr. Farmer presented this item stating there have been several recent rezoning cases where single-family homes exist in commercial districts and the owners have requested residential rezoning. Mr. Farmer stated that confusion in the 2010 revised Title XII Zoning ordinance was remedied in the January 2016 adoption of detailed use charts that do not allow construction of a new residence in a commercial district such as along South Main Street. A problem has been created for existing single-family homes in commercial or industrial districts. The use chart amendments made those existing structures non-conforming. Owners have a right to make repairs; however, if the non-conforming structure is damaged more than 50 percent, it cannot be repaired or replaced without special permission from the Zoning Board of Adjustments (ZBA). This costs money, creates substantial delays and is not guaranteed approval because of a state- mandated adjacent property notice. Hold a PUBLIC HEARING and consider approval of Ordinance 935-2018-50 amending Title XII – Zoning Ordinance: Chapter 3. Zoning Districts to address front setbacks in §12-3-3 RE Residential Estate, and §12-3-5 R1 One Family Residential. MCA2018-0002 Mr. Farmer presented this item. He stated there has been a continuing problem in the Trace Ridge subdivision with setbacks shown on plats that conflict with the actual location of built homes. The zoning ordinance, in both Section 12-3-3 RE Residential Estate and 12-3-5 R-1 One-Family Residential, provides that on plats where building lines, setback lines or front yard lines are shown on recorded plats, that the minimum setback or front yard shall be the one shown on the plat, not the one in the zoning ordinance. The developer of Trace Ridge and various contractors desired to have a reduced front setback from the 35 feet shown on the plat to 25 feet. They petitioned the home owner's association to waive the requirement in the early 2000s which was approved. Based on that approval, a number of homes were permitted with front setbacks of 25 feet which is less than shown on the plat. However, the action of a home owner's association cannot override an ordinance requirement approved by the City Council or a line shown on a recorded plat. Discuss and consider approval of Resolution R2018-19 authorizing the city manager to execute a Local Transportation Project Advanced Funding Agreement with the Texas Department of Transportation for funding of landscaping improvements along State Highway 171 (South Main Street). Director of Capital Projects Terry Hughes presented this item. Community gateway enhancements and funding partnerships are top priorities in the new, award-winning, Weatherford General Plan. Weatherford seized the opportunity to apply for Federal and State funding to improve the southern gateway to Weatherford utilizing the Texas Department of Transportation (TxDOT) Green Ribbon funding program in April of this year. The funding commitment was awarded by TxDOT on August 21, 2018. The program is a partnership with landscaping construction costs paid with Federal and State dollars, and design cost paid by local funding. The project will replace the pavestones in the medians along State Highway 171 with native and near native plantings, irrigation and other aesthetic elements designed to not only invite visitors into our community but to make the statement that you are in a "True Texas" community. One proposed feature that is not covered by the Green Ribbon funding program is a Weatherford "True Texas" monument sign. Quarterly Code Compliance Report. Mr. Farmer presented this update. He introduced the City's new Chief Building Official Katherine McKelvey and Code Compliance Manager Allynn Fisher. This report was for informational purposes only. Council suggested outreach to neighborhoods to help address code issues. No action was required or taken.
