Hold a Public Hearing and consider approval of ordinance 809-2016-55 on a request for a Zoning District Change from AG - Agriculture District to R1 - Single Family Residential District for property located at 109 Hall Street, City of Weatherford, Parker County, Texas. Being an approximately 0.230 acre tract of land situated in the John C. Chapman Survey, Abstract No. 249, Weatherford, Parker County, Texas. ZCH2016-0013 Craig Farmer, director of planning and development, presented this item. This lot is approximately 2,000 square feet. It is zoned AG which is for larger lots and requires larger setbacks. The applicants wants to add-on and is requesting R1 zoning with the smaller residential setbacks. Mayor Swancy opened the public hearing at 6:45 p.m. Debra Harris was called to speak but declined. Mayor Swancy closed the public hearing at 6:46 p.m. On the motion of Kevin Cleveland, second by Dale Fleeger, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Enter Name of Meeting Body and Date Page 2 of 7 Hold a Public Hearing and consider approval of ordinance 814-2016-60 on a request for a Zoning District Change from C1 - Commercial District to CBD - Central Business District for properties located on the west side of the 300 block of York Street between W. Bridge Street and W. Water Street, City of Weatherford, Parker County, Texas. Being an approximate 5.64 acre tract situated in and being a portion of Block 38, and Block 38 ½, Original Town of Weatherford, in the City of Weatherford, Parker County, Texas. ZCH2016-0012 Mr. Farmer presented this item as well. He spoke about the area that is included in the proposed CBD. Many of these buildings are currently zoned C1, which has setbacks; these buildings do not and cannot meet the setbacks. Also, in C1, several of the uses require parking. The CBD has no setbacks, and no parking requirements. Staff has initiated this request with approval of the City Manager's Office at the request of the property owners. Mr. Farmer stated that no one spoke against this item at the Planning & Zoning Commission meeting last week. Mayor Swancy opened the public hearing at 6:50 p.m. As there were no speakers, Mayor Swancy closed the hearing at 6:50 p.m. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve this item. Hold a Public Hearing and consider approval of ordinance 815-2016-61 on a request for a Zoning District Change from C2-Commercial Interstate District, and AG - Agriculture District to C2 - Commercial Interstate with Conditional Use Permit (CUP) for Motor Vehicle Sales and Rentals for 10.374 acre tract located near 901 West Interstate 20, City of Weatherford, Parker County, Texas. ZCH2016-0015 Mr. Farmer presented this item as well. This is the request for the Honda dealership. Kaitlyn Drive is on the west and is proposed to be extended. Drainage concerns will be considered during the platting stage; this item is strictly the zoning case. The applicant has met with the adjacent neighborhood and has worked out a compromise. The applicant has agreed to install better fencing than chain-link around the detention pond. Mr. Farmer stated that the Planning & Zoning Commission recommended approval at their meeting last week. Mayor Swancy opened the public hearing at 6:57 p.m. Charley O'Daniel was called to speak on behalf of the applicant. Shannon Nave, applicant’s engineer, was called to speak. Hold a Public Hearing and consider approval of ordinance 816-2016-62 on a request for a Zoning District Change from C1-Commercial District, and AG - Agriculture District to C2 - Commercial Interstate with Conditional Use Permit (CUP) for Motor Vehicle Sales and Rentals for a 5.294 acre tract located near 801 West Interstate 20, City of Weatherford, Parker County, Texas. ZCH2016-0015 Mr. Farmer presented this item as well. This is the companion case to the previous item. This portion is 5.294 acres and is located immediately to the east of the previous tract. The Planning and Zoning Commission also recommended approval of this item. Shannon Nave, applicant's engineer stated that this tract, the eastern tract, will be a future collision center. The applicant anticipates beginning construction on the dealership in May or June. The collision center is projected within the next five years. Mayor Swancy opened the public hearing at 7:02 p.m. As there were no speakers, Mayor Swancy closed the hearing at 7:02 p.m. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to approve zoning change to C2 Commercial Interstate with a Conditional Use Permit (CUP) for motor vehicle sales and rentals. Enter Name of Meeting Body and Date Page 4 of 7 Consider and/or act upon approval of the 2016 Parks and Open Space Master Plan. Shannon Goodman, director of parks, recreation, and special events, presented this item. This master plan has been in progress for approximately two years. The Parks and Recreation Advisory Board met in November and approved the plan by a vote of 6-0. Staff and the board are very excited to present this plan to the Council. Mr. Goodman introduced Dennis Sims with Dunkin Sims Stoffels, Inc. Mr. Sims gave a brief overview of the plan. He stated that upon adoption by the Council, this master plan document will be submitted to Austin for approval. Upon approval, the city will then be eligible to apply for parks grant funding. Mr. Sims stated that there were two separate public input meetings in two separate settings; however, the top five priorities of the citizens that participated at both meetings were very similar. Those priorities were as follows: Trails (Hike & Bike) Walking Trails Open Space/Nature Recreation Center Indoor Recreation Natural Areas Playgrounds Bicycling Splash Pad Swimming Pool Mr. Sims briefly discussed addressing these priorities, timetables, and costs. Consider and/or act upon approval of a Preliminary Plat for the Pleasant Valley Phase III Addition being an approximate 12.875 acre tract of land situated within the J.F. Bandy Survey Abstract No. 182, and the Noah Staggs Survey, Abstract No. 1199, City of Weatherford, Parker County, Texas. SBD2016-0047 Mr. Farmer presented this request for approval of a preliminary plat. Both the applicant and the engineer were present. This request is approximately 13 acres near Ranger Highway. Staff’s emergency access matrix was developed out of this case. The applicant will be installing a temporary turn around. The development will have approximately 47 lots. The applicant has negotiated an agreement for the emergency access with the adjacent manufactured home park. The access does meet all the fire department requirements, and the Planning & Zoning Commission recommended unanimous approval at their meeting last week. The access easement is in the city's name. It will be gated with a Knox Box. The access is for emergency use only; it will not be open to the public and it will not be open on a regular basis. The gate will remain closed and locked when not in emergency use. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve the Preliminary Plat. Consider authorizing the city manager to execute a contract with Reytech Services, LLC for the construction of erosion control and sanitary sewer repair on Underwood Branch, public Bid #2013-003 Terry Hughes, director of capital transportation, presented this item. He stated that in October 2016, the capital improvements department finalized the bid package for the East Fork Underwood Branch Erosion Control and Sanitary Sewer Repair Project. An invitation to bidders for the construction of the project was advertised on October 22 and October 29, 2016. Bids were opened publicly on November 15, 2016 with four bidders having responded. The lowest qualified responsive bidder was Reytech Services, LLC. with a total bid of $192,028.70. This project is south of Silverstone and will repair a very intense drainage problem. The project will be funded with Storm Water Utility funds. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Discuss and consider action to authorize the use of eminent domain to condemn property necessary for the construction of stream and floodplain improvements within the Holland Lake Creek Watershed across the properties located at 1109 Timber Creek Drive, 1113 Timber Creek Drive, 1117 Timber Creek Drive, 1121 Timber Creek Drive, and 1129 Timber Creek Drive and to adopt Resolution R2016-28. Mr. Hughes presented this item as well. Implementation of the capital improvements program developed through the Holland Lake Watershed study completed in July of 2014 included major stream and floodplain improvements along Holland Lake Creek within the Timber Creek Estates. These improvements necessitate the ownership and management of the riparian area adjacent to Holland Lake Creek. Much of the real property needed to effect the required improvements has been purchased. Resolution R2016-28 authorizes the uses of eminent domain to condemn the portions of the property located at 1109 Timber Creek Drive, 1113 Timber Creek Drive, 1117 Timber Creek Drive, 1121 Timber Creek Drive, and 1129 Timber Creek Drive that are needed to complete the construction of stream and floodplain improvements. Consider appointments to the Municipal Utility Board, the Planning & Zoning Commission, the Weatherford Housing Authority, and the Transportation Advisory Board. On the motion of Kevin Cleveland, second by Jeff Robinson, the Council voted unanimously to: Appoint Paul Paschall to the Utility Board replacing Bob Glenn at the end of this month; and Appoint John Thomas to the Transportation Advisory Board replacing Wade Calhoun; and Appoint Richard Simmons to the Planning & Zoning Commission replacing Gale Bradford. Motion carried 5 - 0.
No appointments to the Weatherford Housing Authority were made at this time.

Notify Council of the need for a work session at the January 10, 2017 meeting. City Manager Sharon Hayes advised the Council that a work session to discuss the proposed permitted uses charts will be held at the next City Council meeting. Ms. Hayes also mentioned the unveiling of the employee art project “Caution: Artists at Work” which will take place on Friday the 16th at 3:30 p.m.
