Hold a PUBLIC HEARING and consider approval of Ordinance 792-2016-38 regarding amendments recommended by the Development Advisory Committee and Planning and Zoning Commission to Title XII Zoning Ordinance Sec. 12-5-2. - Exterior construction and design requirements (masonry). MCA2016-0001 Craig Farmer, Director of Planning and Development, presented this item. He stated that masonry requirements have been on the books in the City of Weatherford since the 1970s. After the City CC072616 Page 1 of 4 Manager's Office organized a Development Advisory Committee (DAC), the current masonry ordinance was reviewed and changes were proposed to the DAC. The proposed amendments include: 1) that an accessory building less than 10x20 feet does not require masonry so long as it is strictly for storage; 2) that in subdivisions which consist of mostly wood frame houses, a wood frame house matching that neighborhood style is allowed; 3) that hardie board (also called hardie plank, cementitious fiber board) is an allowed material but does not count towards masonry requirements. These proposed amendments were recommended by both the DAC, and the Planning & Zoning Commission. Mr. Farmer noted that accessory/storage buildings that are visible from the street must have some type of fencing or landscape screening. Consider approval of Ordinance 793-2016-39 regarding amendments recommended by the Development Advisory Committee and Planning and Zoning Commission to Title IV Section 4-2-7 Permits (permit requirements and sheds). MCA2016-0002 Mr. Farmer presented this item as well. This is basically a companion ordinance to the previous item. It indicates that accessory structures not larger than 10x20 do not require a permit as long as there is no plumbing or electric. For well houses, as an example, Mr. Farmer clarified that a permit would not be required to replace the building, but a permit for the electric would be required. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted to approve this ordinance. Motion carried 4 - 0.
Consider approval of Ordinance 791-2016-37 on first reading for the voluntary annexation of Lockwood Phase 4, a 31.159 acre tract of land situated in and being a portion of the J.V. Shirley Survey, Abstract No. 2057, V.A. Holmes Survey, Abstract No. 658, & D. Ligon Survey, Abstract No. 2019, Parker County, Texas; being a portion of those tracts of land conveyed to NTX CC072616 Page 2 of 4 Lockwood in V. 1272 P. 567; DOC.# 201507146; DOC.# 201507147; DOC.# 201507148; that tract conveyed to NTX Lockwood in DOC.#201507136; official public records, Parker County, Texas. Mr. Farmer presented this item as well noting that the two required Public Hearings for this annexation had already occurred. The area requesting voluntary annexation is off of BB Fielder Road south of the Target area in Lockwood Estates. The second reading of the ordinance will occur at a special City Council meeting this Thursday, July 28th at 11:45 a.m. On the motion of Dale Fleeger, second by Kevin Cleveland, the Council voted to approve this item. Consider authorizing the City Manager to execute a design services contract with Freese and Nichols Inc. for the design of a debris and trash catchment system at the upper end of the Holland Lake Creek. Terry Hughes, Director of Capital Transportation, presented this item. One of the Holland Lake Watershed management elements is the removal of trash and debris from the water stream. This system will remove much of the debris near its source at I-20. The system is a storm water netting system that is easily cleaned and maintained. It allows the water to flow through the netting while collecting the trash and debris. This system will be installed near the new Roger Williams dealership and they have provided right-of-way and access easements. Staff will need to check the system after heavy rains. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted to approve this item. Motion carried 4 - 0.
Consider authorizing the City Manager to execute an engineering design contract with Freese and Nichols for the design of Town Creek Hike and Bike Trail Phase II. Mr. Hughes presented this item as well. The City of Weatherford applied for and received funding for Phase II of the Town Creek Hike and Bike Trail through the Transportation Alternative Program (TAP) last year. The program is an 80/20 federally funded program designed to provide alternative means of transportation to the public. Services included in the contract are basic trail design, traffic signal design, geotechnical design, hydraulics and hydrographic design, surveying, environmental permitting, bridge design and construction phase support. The City’s match is 20 percent of $299,936. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted to approve this item. Motion carried 4 - 0.
Provide staff direction regarding the Parker County Appraisal District’s (PCAD) request for a Resolution of approval for the construction of an addition to the PCAD current building. City Manager Sharon Hayes presented this item. She explained that PCAD is requesting approval for the construction of an addition to their building and stated that PCAD has requested a response by July 30th. At least three-fourths of the taxing entities will need to approve the request in order for PCAD to move forward. Their request would cost the City of Weatherford an estimated $2,945 per year for 15-20 years, depending on the length of the mortgage. Council discussed whether the addition is necessary, the reason for the request, and the lack of information regarding whether this addition is necessary. Dale Fleeger moved to approve, with the second by Jeff Robinson. The motion failed 2 - 2 with Heidi Wilder and Kevin Cleveland voting in opposition. CC072616 Page 3 of 4

On the motion of Kevin Cleveland, second by Dale Fleeger, the Council voted to move forward with the agreement with Identity Mutual. Motion carried 4 - 0.
