Presentation of City's tourism video. Director of Communications and Marketing Blake Rexroat presented this video. No action was required or taken. Proclamation naming April 2019 as Sexual Assault Awareness Month in the City of Weatherford. Mayor Swancy presented this proclamation to representatives from Freedom House.
Consent agenda, approved as one vote (5-0, on the motion of Kevin Cleveland, second by Jeff Robinson): Awarded Bid #2019-14 Contract for Mowing to WCD Enterprises, LLC. based on lowest and most responsive overall bid that complied with requirements. Approved Ordinance O2019-08, amending Ordinance 374-2008-49, Title 13-Flood Damage Prevention. The ordinance is captioned as follows: ORDINANCE NO. O2019-08 AN ORDINANCE OF THE CITY OF WEATHERFORD, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEATHERFORD BY AMENDING TITLE 13, FLOOD DAMAGE PREVENTION; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; PROVIDING A SAVINGS CLAUSE; ESTABLISHING AN OFFENSE AND PROVIDING A PENALTY. Approved Resolution R2019-10 authorizing City of Weatherford representatives to perform activities associated with the City's investment accounts at TexSTAR. Approved Resolution R2019-11 authorizing City of Weatherford representatives to perform activities associated with the City's investment accounts at TexPool. Consider approval of the minutes of the City Council meeting held March 12, 2019. This item was removed from the Consent Agenda for separate consideration. On the motion of Jeff Robinson, second by Curtis Tucker, the Council voted to approve the minutes. Motion carried 4 - 0. Councilmember Heidi Wilder recused herself.
Hold a PUBLIC HEARING and consider approval of Ordinance O2019-07 adopting Standards of Care exempting the City of Weatherford Parks and Recreation Department from the requirements of the Texas Human Resource Code 42.041 (a). Jaycob Kirkpatrick, Assistant Director of Parks, Recreation & Special Events, presented this item. He stated that this ordinance exempts the city from child care licensing since we are not a child care facility. The ordinance is for the purpose of new summer camps/programming that Parks, Recreation & Special Events will be offering. The ordinance must be approved each year. Mayor Swancy opened the public hearing at 6:43 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 6:43 p.m. On the motion of Jeff Robinson, second by Kevin Cleveland, the Council voted unanimously to approve this item. Hold a PUBLIC HEARING and consider approval of Ordinance #O2019-10 for a zoning district change from C-2 Commercial/Interstate to C-2 Commercial/Interstate with a Conditional Use Permit (CUP) for a Dance Hall at 2132 Tin Top Road, described as being 1.30 acres, Lot 3-R1, Block 1 Weatherford Town Center Addition, City of Weatherford, Parker County, Texas. ZCH2018-0032. City Planner Stan Hamrick presented this item. The property is located near Hobby Lobby and Academy. The Planning and Zoning Commission (PZC) tabled this item and asked for the applicant to obtain a parking study. Council also tabled this item awaiting a recommendation from the PZC. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to remove this item from the table. Motion carried 5 - 0.
The request is for a zoning district change from C2 Commercial/Interstate to C2 Commercial/Interstate with a CUP for a proposed dancehall/nightclub with bar. The owner/applicant is Nightlife Ventures CBE, LLC. The property is generally located within the Weatherford Town Center between Kirkpatrick Drive and IH-20. Staff recommended denial; however, the PZC recommended approval (4-1) with the following conditions, which must all be met prior to occupancy: • Demonstrate timing difference in the parking requirements for shopping center uses. • Clean stains on exterior of building. • Repair the dilapidated fence to the north. • Provide screening for dumpsters (3 total) that meets city requirements. • Pick up litter and loose trash on property (ongoing) Mayor Swancy opened the public hearing at 6:48 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 6:48 p.m. The shopping center has joint shared parking and access agreements. The proposed use basically has more than enough parking spaces; however, if the adjacent businesses are full and operating, then the dancehall cannot use all of the other business' parking spaces. Hold a PUBLIC HEARING and consider a request for a zoning district change from AG Agricultural to C-1 Commercial for Professional and General Business Office at 2603 S Main Street, a 2 acre tract of land described as being Lot 1, Causbie Addition, City of Weatherford, Parker County, Texas. ZCH2019-0005. City Planner Stan Hamrick presented this item. He stated that the PZC considered this item and requested a joint work session with the City Council regarding this area of Weatherford and the city’s General Plan. Since the item was tabled by the PZC, Council cannot take action at this time. Mayor Swancy opened the public hearing at 6:57 p.m. He stated the public hearing would be continued at a later time. Hold a PUBLIC HEARING and consider approval of Ordinance #O2019-11 for a zoning district change from CBD Central Business District to CBD Central Business District with a Conditional Use Permit for a Counseling Office at 217 York Ave., a 0.072 acre tract of land described as being a portion of Lots 1 and 2, Carter’s Subdivision of Lot 1, Block 19, Original Town of Weatherford, City of Weatherford, Parker County, Texas. ZCH2019-0006. City Planner Stan Hamrick presented this item. He stated that the owner requests a CUP to lease the 800 square-foot building to Parnell E. Ryan, Ph. D. for a psychological counseling office. Mayor Swancy opened the public hearing at 6:59 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 6:59 p.m. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this request. Consider and/or act upon awarding Request for Proposal (RFP) # 2018-019 to Zuercher Technologies for a Computer-Aided Dispatch (CAD) and Records Management Software System (RMS). Police Chief Lance Arnold presented this item. The RFP was released on April 20, 2018 and was advertised in the newspaper of record for two consecutive weeks on April 21, 2018 and April 28, 2018. Six proposals were submitted; they were opened on May 30, 2018. The proposals were reviewed and evaluated by a multi-disciplinary city evaluation committee to determine the respondents’ ability to meet the 3,390 total functional and technical requirements deemed critical or desired by city staff. The evaluation criteria included functionality, technical capabilities, approach, vendor experience, and proposed staff experience. A vendor short list was identified, and those vendors conducted on-site scripted demonstrations in August 2018. The evaluation committee conducted reference checks and Zuercher Technologies LLC was selected as the preferred vendor. The project will be funded by a grant from the Office of the Governor, Public Safety Office, Criminal Justice Division for the Texas Conversion to the National Incident-Based Reporting System Program for $505,818 and not to exceed $145,684 from the General Fund. Consider authorizing the City Manager to execute a professional services agreement with BerryDunn and Associates for services related to the implementation of the Computer-Aided Dispatch (CAD) and Records Management Software System (RMS). Police Chief Lance Arnold presented this item. This professional services agreement will engage BerryDunn and Associates to the lead the implementation of the Zuercher Technologies CAD, RMS and Mobile. For the past year, BerryDunn and Associates has assisted the city in developing a request for proposal (RFP) and selecting a replacement for the current CAD/RMS system. Utilizing the services and experience of BerryDunn and Associates will help the city achieve full project implementation and success. This project will be funded by a grant provided by the Office of the Governor, Public Safety Office, Criminal Justice Division for the Texas Conversion to the National Incident-Based Reporting System Program in the amount of $225,000 and not to exceed $90,090 from the General Fund. Consider and/or act upon acceptance of the annual audit report for the fiscal year ended September 30, 2018, as presented by Pattillo, Brown & Hill, LLP, Certified Public Accountants. Accounting Manager Sidney Smith presented this item. She introduced Mr. Kent Willis with Pattillo, Brown & Hill, LLP who presented the city’s Comprehensive Annual Financial Report (CAFR) for year ended September 30, 2018. Mr. Willis began with an overview of the Single Audit Report, which was removed from the Consent Agenda for separate consideration. The firm rendered an unmodified opinion, which is the highest level of assurance the firm can provide. Mr. Willis stated that the city has been able to obtain a number of grants that help improve quality of life in the city. This shows that the city’s sources of income are diverse. Mr. Willis gave an overview of the CAFR. He stated that the firm completed an audit of the city’s financial statements for the year ended September 30, 2018. Auditors were onsite for approximately four to five weeks reviewing documents for reasonable assurance that the numbers in the audit report are correct. Mr. Willis stated that the firm rendered an unmodified opinion, which is the highest level of assurance the firm can provide. Mr. Willis then reviewed the government auditing standards report. This item was removed from the Consent Agenda for separate consideration. Mr. Willis from Pattillo, Brown & Hill, LLP discussed this item in conjunction with the previous item. On the motion of Heidi Wilder, second by Kevin Cleveland, the Council voted unanimously to accept this report. Motion carried 5 - 0.
Consider request to authorize the sale of alcohol at 705 North Main Street, a location less than 300 feet from the neighboring Church of God located at 803 North Main Street. City Manager Sharon Hayes presented this item. She stated that staff received a letter from the owner of the vacant convenience store at 705 North Main Street. The letter was a request for an exemption from the distance requirements in the city’s alcohol ordinance. Ms. Hayes stated that the property has been vacant since 2012. The city’s ordinance allowing alcohol sales has been in place over 10 years; neither the staff nor the Council take this lightly and, in over 10 years, the Council has only granted two exceptions. Having been vacant since 2012, the convenience store has been a blight to the neighborhood and a constant source of enforcement for the city. It has been vandalized, boarded up, unkept and there have been issues with high weeds and grass. Distance requirements between a church and an establishment selling alcohol is 300 feet from front door to front door. Ms. Hayes noted that the church and the convenience store are separated by Wheeler Street and the church’s parking lot. The measured distance from front door to front door is 250 feet.
