Consent agenda, approved as one vote (5-0, on the motion of Heidi Wilder, second by Matt Ticzkus): Accepted the annual "Red Flag" Identity Theft Prevention Program report. Approved Ordinance O2023-11 amending the FY23 Adopted Budget. The ordinance is captioned as follows: ORDINANCE NO. O2023-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEATHERFORD, TEXAS, ADOPTING AN AMENDED BUDGET FOR THE FISCAL YEAR OCTOBER 1, 2022 THROUGH SEPTEMBER 30, 2023; MAKING APPROPRIATIONS FOR THE SEVERAL DEPARTMENTS FOR SAID YEAR IN ACCORDANCE WITH THE CHARTER AND ORDINANCES OF THE CITY OF WEATHERFORD, TEXAS AND THE LAWS OF THE STATE OF TEXAS; PROVIDING FOR FILING OF THE BUDGET; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Approved the final plat for Ranger Highway Business Park II, one commercial lot on approximately 2.312-acre tract located at 1511 Ranger Highway, located in the extraterritorial jurisdiction of the City of Weatherford, Parker County, Texas. SBD2023-0005. Approved the final plat for Southpark Replat Lot 2-A-1 & 3, Block 2, two lots being 5.801 acres located at 1920 Martin Drive and 1823 Main Street, City of Weatherford, Parker County, Texas. SBD2023-0006. Consider acceptance of the FY23 2nd Quarter Investment Report for quarter ended March 31, 2023. This item was removed from the Consent Agenda for separate consideration. Finance Director Dawn Brooks presented this item. After discussion, on the motion of Heidi Wilder, second by Kevin Cleveland, the board voted unanimously to accept the report. Motion carried 5 - 0.
Hold a PUBLIC HEARING to consider adoption of Ordinance O2023-10 concerning a request for a conditional use permit regarding Auto Repair use on a 0.514 acre tract of land located at 1515 South Main Street, City of Weatherford, Parker County, Texas. CUP2023-0001. Director of Development and Neighborhood Services Kaleb Kentner presented this item. At their April 12, 2023 regular meeting, the Planning and Zoning Commission voted unanimously (7-0) to recommend approval of the conditional use permit, subject to the following conditions: 1. No vehicles, equipment, or trailers are permitted for display, storage, or sale. 2. Vehicles to be worked on inside bay(s) only. 3. Hours of operation for the business shall be limited to Monday – Saturday, 8:00 a.m. to 7:00 p.m. 4. Minimum parking requirements as outlined in Section 12-4-105 of the Title XII Zoning Ordinance shall apply. All surfaces with parking shall be appropriately striped and maintained. 5. All refuse and service areas shall be subject to current screening requirements as outlined in the Landscape and Tree Manual. Dumpsters shall be kept inside approved enclosures with doors shut. 6. All existing and new signage for the property shall be brought into conformance with current sign regulations as outlined in Section 12-4-101 of the Title XII Zoning Ordinance. Hold a PUBLIC HEARING and consider adoption of Ordinance O2023-08 concerning approval of amendments to the Title XII, Zoning Ordinance, Section 12-2-104, Conditional Use Permit. MCA2023-0001. Director of Development and Neighborhood Services Kaleb Kentner presented this item. At their April 12th, 2023 regularly scheduled meeting, the Planning & Zoning Commission voted unanimously (7-0) to recommend approval of the amendments as proposed by staff. After discussion, on the motion of Kevin Cleveland, second by Matt Ticzkus, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Consider adoption of Ordinance O2023-13, on first and final reading, amending portions of Title II "Commissions and Boards" of the official city code of the City of Weatherford, by amending Section 2-1-1 and repealing Chapter 7 to dissolve the Transportation Advisory Board. Director of Public Works Chad Marbut presented this item. Mr. Marbut explained the history of the Transportation Advisory Board and stated that with the adoption of the 2018 General Plan also referred to as the Comprehensive Plan, Chapter 213 of the Local Government Code requires the Planning and Zoning Commission to be the authority of all plans which include transportation. Staff is proposing the Council dissolve the Transportation Advisory Board and put those powers, duties, and authority under the Planning and Zoning Commission for efficiency purposes and to prevent redundancy. • Terry Hughes, 214 West Russell Street, spoke in favor of adopting this ordinance. On the motion of Matt Ticzkus, second by Heidi Wilder, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Discuss and consider authorizing the City Manager to formally reject a contract renewal for kiosk (wayfinding) signs with Baker Clearview Operating, LLC at its upcoming expiration in 2024. Director of Public Works Chad Marbut presented this item. Mr. Marbut stated that the original intent and purpose of the signs is obsolete. The subscriptions and the revenue associated with them have reduced by over fifty percent which is an indication of these signs not being utilized. On the motion of Kevin Cleveland, second by Matt Ticzkus, the Council voted unanimously to reject the renewal of this contract. Motion carried 5 - 0.
