Proclamation naming September 17-23, 2018 as Constitution Week. Mayor Swancy issued the proclamation to Ms. Harriett Helm and members of the local chapter of the Daughters of the American Revolution.
Consent agenda, approved as one vote (5-0, on the motion of Heidi Wilder, second by Jeff Robinson): Approved the minutes of the City Council meeting held August 28, 2018. Approved Ordinance 912-2018-27 for a zoning district change to allow a C2 Commercial/ Interstate Zoning District to an Industrial Zoning District at a property located in the 2600 block of E. Bankhead and described as being 10.478 acres situated in and being a portion of the Maria Antonio Mesa Survey, Abstract 856, and being a part of the Samuel Bond Survey, Abstract 165, City of Weatherford, Texas. ZCH2018-0011. The ordinance was captioned as follows: ORDINANCE 912-2018-27 AN ORDINANCE AMENDING THE ZONING DISTRICT BOUNDARIES OF THE ZONING DISTRICT MAP OF THE CITY OF WEATHERFORD, TEXAS, CONCERNING CERTAIN PARCELS OR TRACTS OF LAND IDENTIFIED IN AS BEING 10 478 ACRES SITUATED IN AND BEING A PORTION OF ALL THAT CERTAIN LOT, TRACT OR PARCEL OF LAND CONVEYED TO GASARAJ LTD , LP BY DEED RECORD IN VM 1893, PAGE 331, AND BEING A PART OF THE SAMUEL BOND SURVEY, ABSTRACT 165, AND ALSO BEING THE SAME TRACT OF LAND CONVEYED TO LOVE’S COUNTY STORE, INC IN VM 1651, PAGE 919, AND LOCATED IN THE 2600 BLK OF E BANKHEAD DRIVE WITHIN THE CORPORATE LIMITS OF THE CITY OF WEATHERFORD, TEXAS, HERETOFORE ZONED 02 COMMERCIAL/INTERSTATE SHALL HENCEFORTH BE ZONED I INDUSTRIAL, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT, AND PROVIDING A SAVINGS CLAUSE. Discussion and consideration of all matters incident and related to the issuance and sale of “City of Weatherford, Texas, General Obligation Refunding Bonds, Series 2018”, including the adoption of ordinance 920-2018-35 authorizing the issuance of such bonds and providing for the redemption of the obligations being refunded. Assistant City Manager Brad Burnett presented this item. He stated that staff monitors debt service at all times and the City has an opportunity to refund the 2006 and 2008 bond issues. Mr. Burnett introduced Marti Shew of Hilltop Securities who represents the city as its financial advisor. Ms. Shew stated that six banks participated and a couple of those banks offered multiple proposals with different call features. The First National Bank option that is callable anytime with the interest rate of 2.57% was recommended. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Discuss and consider nominees for the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election/Ballot. Mayor Swancy announced that City Secretary Malinda Nowell researched the nominees and recommended the following: Place 11 – Randy Criswell (Incumbent) Place 12 – Bert Lumbreras Place 13 – Byron Black (Incumbent) Place 14 – Bert Echterling On the motion of Curtis Tucker, second by Kevin Cleveland, the Council voted unanimously to approve these nominations. Motion carried 5 - 0.
Receive recommendation from Council regarding funding outside agency requests for the City's FY19 Budget Finance Director Kyle Lester stated that each year, the City of Weatherford receives requests from local organizations for distributions from General Fund and Hotel Occupancy Tax revenue. Staff facilitates this request process and provides the applications to the City Council, who funds the requests at their discretion. Council must determine which organizations, and to what extent, they would like the City to support financially for FY18/19. The requests are as follows: General Fund: $20,000 • Casa-Hope for Children: $5,000 (funded in FY18 at $5,000) • Freedom House: $5,000 (funded in FY18 at $5,000) • Manna Storehouse: $5,000 (funded in FY18 at $5,000) • Parker County Committee on Aging: $5,000 (funded in FY18 at $5,000) Hotel Fund: $101,000 • Weatherford Chamber of Commerce: $96,000 (funded in FY18 at $96,000) • Doss Heritage & Cultural Center: $5,000 (funded in FY18 at $20,000) After discussion, Mr. Lester stated that the aforementioned amounts will be included in the budget for final adoption.
Report on Solid Waste Division and Financial Study Dustin Deel, Director of Municipal and Community Services, stated that staff needed additional time to review the report and will bring it back to the Council in the near future.

Future agenda items: • Ms. Wilder requested an agenda item to discuss making the pond at Clear Lake a park. • Mr. Tucker asked to reconsider the ordinance about urban chickens. Ms. Wilder then requested information on how all citizens could voice their opinion on this matter and to discuss the financial aspects.

Consider the use of eminent domain to condemn property and consider a resolution authorizing the filing of eminent domain proceedings for the purpose of obtaining easements across an approximately 25 acre tract of land located in the J H Letsinger Survey, Abstract 2564 and S Olinger Survey, Abstract 1027, described in Volume 1791, Page 380, Deed Records of Parker County, Texas, for construction and maintenance of a pipeline and outfall facility for the reclamation of treated wastewater and for other public purposes permitted by law. On the motion of Heidi Wilder, second by Jeff Robinson, the Council voted unanimously to approve that the City Council of the City of Weatherford authorize the use of the power of eminent domain to acquire a drainage and grading easement, an access easement, a utility easement and a temporary construction easement described in Resolution R2018-15, as presented, on an approximately 25 acre tract of land located in the J H Letsinger Survey, Abstract 2564 and S Olinger Survey, Abstract 1027, described in Volume 1791, Page 380, Deed Records of Weatherford, Parker County, Texas, for public use in construction and maintenance of a pipeline and outfall facility for the reclamation of treated wastewater, and to adopt Resolution R2018-15, as presented. Motion carried 5 - 0.
