Discuss current ordinances regarding ingress/egress in subdivisions. Sharon Hayes, City Manager, introduced this item. Mr. Farmer provided a single family subdivision access checklist. He spoke about two items appearing on tonight’s Regular Session agenda and the two areas of the City’s code that addressed ingress/egress for subdivisions. One ordinance is in the adopted 2009 International Fire Code which refers to emergency access and is not at all related to platting. The second ordinance pertains to the reduction of congestion, connectivity to adjacent streets, neighborhoods and future roadways. Mr. Farmer used the following checklist to walk the Council through the Chisholm and Pleasant Valley items on tonight’s Regular Session agenda. CC102715 Page 1 of 9 Mr. Farmer stated that staff will use this checklist on future subdivisions where ingress and egress might be of concern. Discuss draft payday lenders ordinance. City Manager Sharon Hayes presented this item. Ms. Hayes noted that this item is also on tonight's Regular Session agenda in case the Council would like to take action on it today. Regulations for payday lenders have been discussed for some time now and with state's failure to address them in the legislature, cities have begun adopting local ordinances to attempt to regulate them. Proclamation naming November 11, 2015 as Veterans Day. Mayor Dennis Hooks issued the proclamation to local veterans and members of the American Legion.
Hold a PUBLIC HEARING and consider approval of Ordinance 751-2015-40 requesting a Zoning Change for property zoned R1 One-Family Residential to R2 Two-Family Residential use, located at 319 West Park Avenue, more specifically described as being Lots 1, 2, 3 and 4, Block 1, Clary CC102715 Page 3 of 9 Addition, an addition to the City of Weatherford, Parker County, Texas. ZCH2015-0004 Craig Farmer, Director of Planning and Development, presented this request. All properties in this vicinity are zoned R1. The applicant is proposing R2 which allows single family, but also townhomes and duplexes. The applicant is considering a duplex on each of the four lots, which is a total of four structures, each with two living units. R2 zoning does provide for the proposed use and the request does fit within the future land use plan. Mr. Farmer noted that the Planning and Zoning Commission reviewed the case and approved the request by a vote of 5-1. Mayor Hooks opened the Public Hearing at 6:40 p.m. The following spoke: Applicant Michael Clary provided a copy of a letter that he mailed to 19 addresses in the vicinity. Of those, only one was returned to him. Mr. Clary stated that he has tried to sell this property on and off since 2010, that he is requesting multi-family zoning and proposing four duplexes with a total of eight living spaces. Consider adoption of Ordinance 748-2015-37 to establish the 100-200 block East Church street as CC102715 Page 5 of 9 a one-way street. Manny Palacios, Director of Transportation and Public Works, presented this item. Mr. Palacios stated that his department has received multiple complaints of pedestrian and motorist safety concerns from this subject area. Staff developed this concept plan to make Church Street one way with traffic traveling westbound between Walnut and College Streets. The concept adds sidewalks, handicap ramps, and an additional seven parking spaces and two handicap spaces. Traffic traveling on Elm Street will continue with north/south two-way traffic. Mr. Palacios met with businesses and property owners in the area and they are in favor. One concern was headlights possibly shining in home windows but that is not anticipated to cause a problem due to the slope of the road. Private driveways will remain accessible. The Transportation Advisory Board recommended approval. Staff is considering landscaping options. The aerial fire truck will be able to maneuver the one way street. Stamped pave stones will be used in the area. They are reinforced and a fire truck can drive over them without damaging or breaking the curb. Consider a Master Plat for Chisholm Addition, for property located north of Peaster Highway (FM 920) in the 1500-1800 block, City of Weatherford, Parker County, Texas. SBD2015-0019 Craig Farmer, Director of Planning and Development, presented this item. This development will be 253 lots with two entrances on Peaster Highway, and one road that ties into Hall Street on the east side of the development. Additionally, there are two proposed future stub-outs on the north side of this development. Mr. Farmer stated that this proposal meets the City's emergency access and ingress/egress requirements. He also noted that a Traffic Impact Analysis (TIA) will be required. On the motion of Jeff Robinson, second by Craig Swancy, the Council voted unanimously to approve this item. Motion carried 5 - 0.
**This item was tabled at the October 13, 2015 Council Meeting** Consider a Master Plat for Pleasant Valley Phase III Addition, for property located at the end of Pleasant View Drive, City of Weatherford, Parker County, Texas. SBD2013-0029 Craig Farmer, Director of Planning and Development, presented this item. He stated that the applicant asked for this item to be continued until the next meeting. On the motion of Jeff Robinson, second by Craig Swancy, the Council voted unanimously to leave this item on the table. Motion carried 5 - 0.
Discuss and consider adoption of ordinance 749-2015-38 adopting the new Texas Administrative Code (TAC), Title 25 section 228 "Texas Food Establishment Rules." City Manager Sharon Hayes presented this item. These changes came out of the last legislative session where the food establishment rules were moved from section 229 to section 228 in title 25 of the TAC. On the motion of Dale Fleeger, second by Heidi Wilder, the Council voted unanimously to approve this item. Motion carried 5 - 0.
Discuss and consider adoption of Resolution R2015-29 supporting Proposition7 in the November 3, 2015 election. City Manager Sharon Hayes presented this item. Ms. Hayes stated that during the last legislative session, Senate Joint Resolution 5 approved November 3 ballot wording for Proposition 7 which provides additional funding estimated to generate approximately $3M between now and 2020, if approved by voters. On the motion of Heidi Wilder, second by Dale Fleeger, the Council voted unanimously to approve this resolution of support for Proposition 7. Motion carried 5 - 0.
Discuss and consider adoption of Ordinance 752-2015-41 addressing payday and car title lenders operating within the city limits. City Manager Sharon Hayes presented this item. This proposed ordinance was discussed in tonight's Work Session. The only change is that the ordinance will be made effective January 1, 2016 instead of immediately. This change will allow staff to notify the lenders and put all the forms and paperwork into place. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the ordinance effective January 1, 2016. Motion carried 5 - 0.
Consider adoption of Resolution R2015-30 setting a date and ordering a Special Election to fill a vacancy in Council member place no. 4, authorizing the Mayor to execute the "Notice of General Election", and authorizing the Mayor to contract with the Parker County Elections Administrator to administer early and Election Day voting. City Secretary Malinda Nowell presented this item. Councilman Swancy announced his candidacy for Mayor on October 9 and submitted his letter of resignation to seek election as Mayor in May 2016. As authorized by voters in the November 2010 Charter Amendment, Council terms are three years. As such, article XI, section 11 of the Texas Constitution requires the City to hold a special election to fill a vacancy within 120 days from the date of resignation. Staff has worked with the Parker County Elections Administrator and they have agreed to hold the Election on Saturday, January 30, 2016. The cost is estimated not to exceed $8,000. Councilman Swancy may continue serving until his successor is duly qualified. The filing period is October 30 through November 30. The complete election calendar is under review by outside attorneys and is anticipated to be available on October 28. On the motion of Dale Fleeger, second by Jeff Robinson, the Council voted to approve Resolution R2015-30. Motion carried 4 - 0.
Mr. Swancy recused himself. Discuss and consider appointments to the Youth Advisory Council. Malinda Nowell presented this item as well. During the last month and a half, staff has accepted more than 20 applications for nine seats on the Youth Advisory Council (YAC). Staff met with Angela CC102715 Page 7 of 9 Sweeney and Marie Ornelas, the teacher liaisons from Weatherford ISD, to consider the applicants and offer the following recommendations based on: strength of application; showing leadership and involvement in school and/or extra-curricular activities; teacher recommendation; grade level; and diversity. Staff recommends WHS seniors Marlysia Earls, Savannah Simmons, and Carter Gass; Victory Baptist Academy senior Robert Catuto; WHS juniors Robert Chavez, and Walker Paschall; and WHS sophomores Laura Terry, Damen Musser, and Max Meisner. On the motion of Craig Swancy, second by Heidi Wilder, the Council voted unanimously to appoint or reappoint the aforementioned students. Motion carried 5 - 0.
