Consent agenda, approved as one vote (5-0, on the motion of Heidi Wilder, second by Jeff Robinson): Approved the minutes of the City Council meeting held April 24, 2018. Approved Ordinance 891-2018-16 amending the FY18 Adopted General City Budget. Approved Ordinance 890-2018-15 amending Title II, Commissions and Boards, Chapter 10 - Weatherford Economic Development Board, Sec. 2-10-4.
Hold a PUBLIC HEARING and consider approval of Ordinance 892-2018-17 for a zoning district change to allow a C1 Commercial to R1 One-Family Residential for property located at 309 S Rusk Street, and described as being .356 acres being Lot 4R1, Block 8 of the Yeoman’s Addition, City of Weatherford, Parker County, Texas. ZCH2018-0008. Craig Farmer, Director of Development and Neighborhood Services, presented this item. Mr. Farmer stated the subject property is currently zoned C1. The applicant is requesting residential zoning. Mr. Farmer stated that staff has begun hearing from some property owners that they are having issues obtaining financing when the use of the property does not conform to the zoning. Mayor Swancy opened the public hearing at 6:36 p.m. As there were no speakers, Mayor Swancy closed the public hearing at 6:36 p.m. On the motion of Jeff Robinson, second by Heidi Wilder, the Council voted unanimously to approve the zoning change. Motion carried 5 - 0.
Consider approval of a thirty (30)-year license agreement with automatic three (3)-year renewals for use of the sidewalk and right of way for the Houston Place Building at 102-106 Houston Avenue for building overhang, arcade/awning and restaurant purposes. On the motion of Dale Fleeger, second by Kevin Cleveland, the Council voted unanimously to remove this item from the table. Motion carried 5 - 0.
Mr. Farmer presented this item as well. He stated that staff has amended the proposed agreement to reflect an annual increase in accordance with the CPI. Mr. Farmer stated that the primary reason for the 30-year term is due to the permanent structure which overhangs on City and TxDOT right-of-way. Additionally, the Texas Alcoholic Beverage Commission requires a license agreement in order for the restaurant to serve alcohol in the outside service area. Mr. Farmer stated that Mr. Eggleston, the property owner, requested that the agreement include that if the restaurant removes the tables and fencing and does not use the Palo Pinto side, he would like a reduction of 25% in the annual fee. Likewise, if the tables and restaurant space are not used on Houston Street, Mr. Eggleston asked for an additional 25% reduction. At no point would the annual license fee be less than 50% of what is proposed in this agreement. Councilwoman Wilder stated she is against the reduction of the license. If the restaurant does not use the sidewalk and/or public space and the license fee is reduced, then the rights-of-way will be opened back up for public use. If the planned restaurant should close, then the owner of building could reassign the use of the agreement to another restaurant. On the motion of Kevin Cleveland, second by Dale Fleeger, the Council voted to approve the agreement. Motion carried [...]
