Discuss and consider approval of a developer's agreement to allow Mr. Jack Willhite at 1890 Mineral Wells Highway to continue the sale of fireworks for a one year period after the effective date of the 2015 Western Loop annexation. City Manager Sharon Hayes presented this item. On July 13, 2015, staff met with Jack Willhite and his granddaughter Terri Presley regarding Jack's Fireworks located at 1890 Mineral Wells Highway within the proposed annexation area. They requested permission to continue to sell fireworks from the location after it becomes part of the City of Weatherford. Ms. Hayes noted that section 43.002 of the Local Government Code states that a municipality cannot prohibit certain land uses after annexation but that the sale/use of fireworks is one limitation the City can enforce. Staff proposed a one year development agreement with Mr. Willhite which allows Mr. Willhite to come to the City in person annually and apply for an extension of the agreement. The agreement also requires the posting of a sign on the property indicating that the use of fireworks is prohibited inside the City of Weatherford. Terri Presley spoke on behalf of Mr. Willhite. She operates the business for her grandfather and asked for a three-year agreement stating that one year is not enough time to find a new location, purchase or lease property, and move the business. If approved by Council, the annexation becomes effective today, August 4, 2015. On the motion of Craig Swancy, second by Heidi Wilder, the Council voted unanimously to approve Ordinance 732-2015-21. Motion carried 5 - 0.
