Staff reports for the Oct. 14 Planning & Zoning hearings

Why it matters. The staff report says the annexation area holds approximately 68 residential lots, 34 of 9,000 to 12,000 square feet and 34 of one acre, with approximately 48 two-acre lots staying outside the city limits; the fueling-station report says the request is identical to the permit the council approved Aug. 26, 2025, with no changes proposed.

Draft minutes of the commission's Aug. 12 meeting, attached to the Oct. 14 agenda for approval, record 6-0 votes on the Clairemont Addition rezoning at 703 West Park Avenue, with nine speakers in support, and on the 1726 North Main cases. Arlington Martin beat Arlington Sam Houston 63-14 and Arlington beat Granbury 58-13 on Thursday, per MaxPreps; Weatherford plays at Arlington Lamar at 7 p.m. tonight, with volleyball there at 5:30 p.m. Applications for the Weatherford ISD Facility Planning Committee are due today, the state burn-ban list stamped 8:25 a.m. Thursday carries 154 counties with Parker County on it, and today is sunny with a high near 88.

A third Ozone Action Day for the Dallas-Fort Worth area today, Parker County among the 13 counties on the NWS Air Quality Alert; sunny, high near 88; clear tonight, low around 64

The National Weather Service active-alerts feed for 32.7593 N, 97.7972 W listed one alert at 5:13 a.m.: an Air Quality Alert issued at 2:31 p.m. Oct. 8 by NWS Fort Worth, in effect until 5:45 p.m. Oct. 9, for Wise, Denton, Collin, Hunt, Parker, Tarrant, Dallas, Rockwall, Kaufman, Hood, Johnson, Ellis and Henderson counties. The alert says the Texas Commission on Environmental Quality has issued an Ozone Action Day for the Dallas-Fort Worth area for Friday, October 9, 2026, and that atmospheric conditions are expected to be favorable for producing high levels of ozone air pollution in the Dallas-Fort Worth area on Friday; the Ledger carried the same alert for Wednesday in its Oct. 7 edition and for Thursday in its Oct. 8 edition. The forecast: sunny today, high near 88, east wind 0 to 5 mph; tonight clear, low around 64, east southeast wind 0 to 5 mph; Saturday sunny, high near 88, south southwest wind 0 to 5 mph; Saturday night clear, low around 65; Sunday sunny, high near 89 with temperatures falling to around 87 in the afternoon, south wind 5 to 15 mph with gusts as high as 25 mph.

Heritage Park Estates: the Oct. 14 rezoning would bring about 68 lots of a 145-acre county subdivision at Causbie Road and Old Airport Road into the city, with gated private streets kept by a homeowners' association

The staff report for case ZCH-26-0014 on the Planning & Zoning Commission's Oct. 14 agenda says the applicant, Richard Green, is requesting a zoning amendment for a portion of the Heritage Park Estates development, a proposed single-family residential development at the northeast corner of Causbie Road and Old Airport Road, and that the overall Heritage Park property consists of approximately 145 acres and is currently being developed as a residential subdivision in Parker County. The amendment is associated with the voluntary annexation of a portion of the development into the city: the annexation area includes approximately 68 residential lots, approximately 34 lots ranging from 9,000 to 12,000 square feet and 34 one-acre lots, and the remaining portion, approximately 48 two-acre residential lots, will remain outside the city limits and is not included in the zoning request. The request is for SF 7.5 Single Family zoning with a Planned Unit Development overlay that establishes development standards specific to Heritage Park and incorporates the proposed concept plan. The report says the property has previously been platted through Parker County and that the portion brought into the city would be required to be replatted through the city; that the development will include gated private streets, private drainage facilities and a private trail system owned and maintained by a homeowners' association rather than the city; and that the overlay requires each home to incorporate a minimum of five specified architectural features. Access is proposed primarily from Old Airport Road, with Lockwood Lane serving as gated emergency access only and a future street stub-out proposed for future phases. The zoning amendment is being considered concurrently with the voluntary annexation and a Development Agreement that sets the development standards, public improvement responsibilities and utility provisions for the portion proposed for the city. Surrounding zoning is R1 One Family Residential to the north and AG Agriculture to the west, with the city's extraterritorial jurisdiction to the south and east; the General Plan designation is Suburban Living. Staff recommends approval. The Ledger's report on the Dec. 22, 2025 Commissioners Court minutes records the county's approval of the final plat for Heritage Park Estates, released from the city's ETJ, 145.030 acres with 70 lots, and its acceptance of a special warranty deed for additional right-of-way for the subdivision in Precinct Three.

1802 Old Brock Road fueling station: the Oct. 14 conditional-use request is identical to the one the council approved Aug. 26, 2025, staff says, with five conditions including no diesel advertising on billboards and No Overnight Parking signs

The staff report for case CUP-26-0007 says the applicant, Tony Rutigliano, is requesting a Conditional Use Permit for Fueling Station use on a 7.341-acre tract at 1802 Old Brock Road, zoned C2 Interstate Commercial with AG Agriculture on all four sides, with a General Plan designation of Regional Activity Center and Manufacturing and Warehouse. It says the original conditional use permit request was presented to the commission on August 13th of 2025, where it received a recommendation of approval, and was approved by the City Council on August 26th, 2025, and that the current request is identical to the previously approved permit with no changes proposed to the project: the site plan, building dimensions, site configuration and number of fuel pumps remain unchanged. The report does not state a reason for the new request. Staff recommends approval with five conditions: temporary signs, banners and other advertisements shall not be permitted on the property; the permit will be void if construction has not been started within 12 months of ordinance approval, and void if the certificate of occupancy has not been issued within 30 months of ordinance approval; no diesel advertising for the location on billboards, with an exception for one price sign; no advertising diesel for the location on trailblazers; and signage stipulating No Overnight Parking placed in and around the property.

North Weatherford Business Park plat returns to P&Z after the council's Aug. 25 denial; Hook'em Subdivision would combine two lots at East Simmons and Bois D Arc Street

The staff report for SBD-26-0008 says the commission previously voted 6-0 to recommend approval of the final plat for North Weatherford Business Park Addition, one lot on approximately 9.434 acres at 1726 North Main, at its August 12, 2026 meeting; that due to a concurrent lack of final action on the necessary annexation of the property, the plat was subsequently considered by the City Council and formally denied; and that as a result the plat is required to return to the commission for reconsideration. If approved, the plat would establish one legal lot, and all required public improvements must be completed and formally accepted by the city before the plat is recorded. The applicant is listed as Kellan Black and the existing zoning as AG Agriculture. The Ledger's report on the Aug. 25 council minutes records that Ordinance O2026-32, the annexation, failed for lack of a motion, that no hearing was held on the C1 rezoning, and that the council voted 5-0 to disapprove the final plat due to the lack of action on the annexation; the annexation and rezoning are on the council's Oct. 13 agenda. The staff report for SBD-26-0007, Hook'em Subdivision, one residential lot on approximately 0.336 acres at the northwest corner of East Simmons and Bois D Arc Street, says the purpose of the final plat is to combine two residential lots into one, that right-of-way dedication is required along Bois D Arc Street, and that staff reviewed the plat and determined it complies with the subdivision regulations, zoning requirements and other city development standards; the zoning is R2 Two Family Residential on the site and on all four sides. Staff recommends approval of both plats subject to all requirements of the Subdivision Ordinance.

Draft minutes of the P&Z's Aug. 12 meeting, attached to the Oct. 14 agenda: 6-0 votes to recommend the Clairemont Addition rezoning at 703 West Park Avenue, with nine speakers in support, and the Mathew Meadows, Stonegate, 616 Cove and 1726 North Main cases

The Oct. 14 agenda's item 2.a asks the commission to approve the minutes of its Aug. 12 meeting, and the draft minutes are attached. They record that six commission members were present and one absent, and that the commission voted 6-0 to recommend approval of a General Plan and Zoning Map Amendment from AG Agriculture to R3 Multifamily Residential with a Planned Unit Development overlay on an approximate 31.01-acre tract at 703 West Park Ave, case ZCH-26-0013, subject to two additions to the developer's agreement: the facade of any buildings not depicted in the renderings must be approved by the city and must match the style of the buildings shown in the renderings, and no certificates of occupancy shall be issued prior to substantial completion. The applicant spoke about the plans for the Clairemont Addition project and addressed questions; at the public hearing, which ran from 3:08 to 3:37 p.m., nine people spoke in support of the project and one questioned whether the funding mechanisms were in place, and the chair reported that two letters of support had been received. The commission voted 6-0 to recommend disapproval of the Clairemont Addition preliminary plat, four lots on the same 31.01 acres, after staff recommended disapproval due to outstanding corrections that had not yet been addressed. It also voted 6-0 to recommend approval of the preliminary and final plats for Mathew Meadows Estates, 27 residential lots on approximately 21.13 acres at 1609 Old Dicey Rd.; the final plat for Stonegate, two residential lots on approximately 0.508 acres along Cherry Street; the General Plan and Zoning Map Amendment from AG Agriculture to C1 General Commercial on the approximate 9.434-acre tract at 1726 North Main and the final plat for North Weatherford Business Park Addition on the same tract; and the final plat for 616 Cove, one lot on approximately 1.046 acres along Palo Pinto St. The meeting ran from 2:30 to 4:25 p.m. These are draft minutes until the commission approves them. The council took up the Clairemont, Mathew Meadows, Stonegate, 616 Cove and 1726 North Main items on Aug. 25; the Ledger's report on those minutes is on the meetings page.
