Item 8.g on the City Council's Oct. 13 agenda asks the council to authorize the city manager to enter into an interlocal agreement between the City of Weatherford and Parker County for the operation, management and maintenance of downtown properties. The staff report says the city currently maintains and repairs the stone walls, sidewalks and bollards around the Courthouse Square, plants and manages the flower beds in the medians, maintains the trees, and paves and stripes the parking lots, and that the proposed agreement formalizes these responsibilities at all four corners of the downtown square and adds the county parking lots at York Avenue and West Spring Street, which the city does not currently maintain. Under the agreement, per the report, the city would have exclusive authority to operate, manage and maintain the properties, including setting parking and pedestrian rules, installing signage and related improvements, and approving license or encroachment agreements for business use; the county retains use of the properties for official county business, including court operations, and county-sponsored special events would go through the city's special event permit process. The agreement grants the city a right of first refusal should the county sell the properties; the initial term is ten years, with automatic ten-year renewals unless either party gives 180 days notice of non-renewal. The report says the agreement does not transfer property ownership and has no bearing on any responsibility to TxDOT roadways, lists the financial impact as N/A, and says staff recommends approval.
